THIS AGREEMENT made
between ROGER RUSSELL,
hereinafter referred to as

THEODORE D. STOUCH and ELLEN D. STOUCH, husband and wife, R.D.
'I, Box 137F, Newburg, PA 17240, hereinafter referred to as
OWNERS, whereby the former undertook and agreed to erect and
construct a dwelling house on the certain lot of ground situate
in Upper Hifflin Township, Cumberland County, Pennsylvania, more
fully bounded and described on the attached Exhibit "A".
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
CONTRACTOR, for and in consideration of the sum of ($ 1.00)
Dollar to him in hand paid by OWNER, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for himself and his subcontractors, and
all parties acting through or under him, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by him
or any of them against the said buildings and the lot of ground
appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said CONTRACTOR, for himself, his subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said real estate and/or buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be
an independent covenant.

of Upper Mifflin, Cumberland County, Pennsylvania;
being known as Lot 8 as shown on a Final Subdivision
Plan for J. Thomas Derick prepared by Eric L.
Diffenbaugh, Professional Land Surveyor, dated March
16, 1995, and recorded in the Office of the Recorder of
Deeds in and for Cumberland County, Pennsyl~ania, in
Subdivision Plan Book , Page , and being more
fully bounded and described as follows:
BEGINNING at an existing iron pin located on the
northern edge of a 50 foot wide private right-of-way,
at corner of lands now or formerly of Leroy M.
Pomraning, said pin also located at the Southwest
corner of the tract herein conveyed; thence by lands of
Pomraning North 19 degrees 02 minutes 15 seconds West
Four Hundred Eighty-six and ninety-seven hundredths
(486.97) feet to an existing iron pin located at the
corner of lands of Pomraning and J. Thomas Derick;
thence along lands to be retained by Derick North 70
degrees 56 minutes 57 seconds East One Hundred Forty-
two and fifty-three hundredths (142.53) feet to an
existing iron pin; thence continuing along lands to be
retained by J. Thomas Derick South 37 degrees 40
minutes 32 seconds East Four Hundred Thirty-seven and
fifty-seven hundredths (437.57) feet to a set iron pin
located at the corner of lands of Pomraning and Derick;
thence South 41 degrees 21 minutes 27 seconds West
Seventy five and seventy-one hundredths (75.71) feet to
an existing iron pin; thence North 29 degrees 57
minutes 07 seconds West Forty and two hundredths
(40.02) feet to an existing iron pin; thence South 51
degrees 23 minutes 45 seconds West Fifty One and
Seventy-six hundredths (51.76) feet to a point; thence
along the Northern edge of the said 50 foot private
