WILLIAMSON, his Heirs, Executors, Administrators and Assigns, No. 95- CIVIL TERM Defendants CIVIL ACTION - QUIET TITLE COMPLAINT 1. The Plaintiffs herein are PAUL R. HAVERSTOCK and NORMA K. HAVERSTOCK, his wife, adult individuals who reside at 24 Andes Drive, Mechanicsburg (Upper Allen Township), Cumberland County, Pennsylvania. 2. The Defendants herein are GEORGE J. WILLIAMSON, an adult individual whose present residence and whereabouts are not known and cannot be ascertained, and his Heirs, Executors, Administrators and Assigns, the identity and whereabouts of which are not known and cannot be ascertained. 3. The property which is the subject of this action (hereinafter referred as "the subject property") is bounded and described as follows: ALL THAT CERTAIN, piece or parcel of land situate in the Township of Lower Allen, County of Cumberland, and state of Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point on the north side of New York Avenue, two hundred forty (240) feet in an easterly direction from a point at the northeast corner of the intersection of New York Avenue and Schuylkill Avenue; thence running in an easterly direction along the northern line of New York Avenue a distance of forty (40) feet to a point; thence turning at right angles and running in a northerly direction a distance of one hundred fifty (150) feet to a point on the southern side of Nina Alley; thence along the southern line of Nina Alley in a westerly direction at right angles a distance of forty (40) feet to a point; thence at right angles in a southerly direction a distance of one hundred fifty (ISO) feet to the point of BEGINNING. An abstract of Plaintiffs' title for the subject property is attached hereto and made a part hereof, marked Exhibit "A". 5. The subject property described in Paragraph 3, above, is the same property that was acquired by the Defendant George J. Williamson by deed of Columbian Land Improvement Company of Harrisburg, Pennsylvania, dated May 7, 1894, and recorded in the office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Deed Book "G", Volume 5, Page 90. Williamson sold, transferred, assigned or otherwise conveyed the subject property to any other person (except as described in Paragraph 7, below), nor is there any record of any estate in the Office of the Register of wills of Cumberland county, pennsylvania, for the Defendant George J. Williamson by which his interest in the subject property was transferred or conveyed unto his Heirs. 7. The subject property was sold by the Tax Claim Bureau of Cumberland County, Pennsylvania, on October 21, 1963, as the property of the Defendant George J. Williamson, for delinquent county, township and school district real estate taxes for the years 1959, 1960, 1961 and 1962, and same was purchased at the tax sale by Milton Aronauer, who subsequently received a deed therefor from the said Tax Claim Bureau dated March 6, 1964, and recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Deed Book "D", Volume 21, Page 52. '''I';, Notice of the tax sale described in Paragraph 7, above, was given by the said Tax Claim Bureau by posting and publication as required by law and notice was also sent by M^'fllf~ H M., .d' I' -4- I :.^ "I" , M^llIIU II '.t,l :.1111 certified mail to the Defendant George J. Williamson at the following address: George J. Williamson Lot No. 109, New York Avenue Camp Hill, Pennsylvania 17011 but said mail notice was returned with the post office notation "Addressee Unknown." 9. The non-delivery of the certified mail notice as described in Paragraph 8, above, raises a question as to whether proper notice of the sale was given as required by law, which in turn raises a question as to validity of the tax sale, all of which questions together constitute a cloud upon the title to the subject property. 10. The subject property was sold and conveyed by the said Milton Aronauer to the said Plaintiffs herein by Deed dated January 9, 1971 and recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Deed Book "Y", Volume 23, Page 420, a true copy of which is attached hereto and made a part hereof, marked Exhibit "B". 11. At the time of the conveyance described in paragraph 10, above, Plaintiffs were the owners of Lot 108 on the aforesaid Plan of Columbian Land Improvement Company, which Lot 108 -5- '. .;~. adjoins the subject property on the east and upon which Lot 108 was constructed a residential dwelling house known and numbered as 2308 New York Avenue, which house the Plaintiffs occupied as their residence from at least 1960 until July 9, 1971. 12. Plaintiffs sold and conveyed their home at 2308 New York Avenue to John Larry Bowen and Kathleen Joyce Bowen, his wife, by Deed dated July 9, 1971 and recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Deed Book "E", Volume 24, Page 244. 13. Plaintiffs entered into a contract for the sale and conveyance of the subject property to the said John Larry Bowen and Kathleen Joyce Bowen, his wife, as evidenced by Articles of Agreement dated July 9, 1971, which were not recorded, a true copy of which Articles is attached hereto and made a part hereof, marked Exhibit "C". 14. Plaintiffs and their contract vendees have continuously, since at least January 9, 1971, to the present, being a period in excess of twenty-one (21) years, been in possession, If".'. <I"", ownership and control of the subject property and have enjoyed M^I4t lr~ Ii t.,l. c :>1 III -6- 15. the exclusive use and benefit of the same by cultivating and maintaining a grass lawn and shrubs thereon and by using and enjoying same as a yard and parking area for the residence at 2308 New York Avenue. Plaintiffs and their contract vendees have continuously, since January 9, 1971, being a period in excess of twenty-one (21) years, claimed full, complete and sole ownership in and titled to the described property by the recorded deed of conveyance of Milton Aronauer dated January 9, 1971, by: (a) the payment of the realty transfer tax upon the recording of the said deed of conveyance; (b) by the execution and delivery of Articles of Agreement dated July 9, 1971; (c) by the cultivation and maintenance of a hedge or line of shrubs along the western boundary line of the subject property as a means of enclosure and to noticeably separate the subject property from the lands adjoining it on the west; (d) and by the payment of the annual county, township and school district real estate taxes accessed against the subject property for each year from 1971 to the present. 1"'''''.''111.1 M"'IlINIt M,l".llll -7- 16. since at least January 9, 1971, to the present, being a period in excess of twenty-one (21) years, neither the Defendants herein nor anyone claiming by, from or under them or on their behalf have asserted any right, title, interest or claim in and to the subject property, nor have they attempted to enter into possession of or to exert control over the subject property, nor have they interrupted in any other way the aforesaid possession, use, benefit and enjoyment of the subject property by the Plaintiffs herein and their contract vendees. 17. The aforesaid possession, use, control and enjoyment of the subject property by the Plaintiffs herein and their contract vendees since at least January 9, 1971, has been actual, adverse, continued, visible, notorious, distinct and hostile to all others, and said possession has been particularly adverse and hostile to and inconsistent with any right, title, interest, claim, use, benefit, enjoyment or possession in or of the subject property by the Defendants herein, or any of them, or anyone claiming by, from or under them or acting on their behalf. For the reasons set forth above, a perfect and indefeasible title in fee in and to the subject property has become vested in the Plaintiffs herein by reason of adverse possession and by reason of the applicable statute of limitations of the Commonwealth of Pennsylvania. WHEREFORE, Plaintiffs herein respectfully request your Honorable Court pursuant to Rule No. 1066 of the Pennsylvania Rules of civil Procedure: a. To enter an Order directing the Defendants herein to commence an Action in Ejectment or to assert any right, title or interest in which they may claim against the Plaintiff and the subject property within thirty (30) days after notice of said Order; and b.
