by law for the same, and upon Motion of Marlin R. MCCaleb,
Esquire, attorney for the Plaintiffs, it is hereby ordered and
directed that judgement by default be, and the same hereby is,
entered in favor of the Plaintiffs, Paul R. Haverstock and
Norma K. Haverstock, his wife, and against the Defendants,
George J. Williamson, his heirs, executors, administrators and
assigns.

asserting any right title, interest or claim inconsistent with
the right, title, interest and claim of the Plaintiffs herein
as set forth in Plaintiffs' Complaint with respect to the lands
herein described:
ALL THAT CERTAIN, piece or parcel of land situate in the
Township of Lower Allen, county of Cumberland, and state of
Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point on the north said of New York Avenue,
two hundred forty (240) feet in an easterly direction from
a point at the northeast corner of the intersection of New
York Avenue and Schuylkill Avenue; thence running in an
easterly direction along the northern line of New York
Avenue a distance of forty (40) feet to a point; thence
turning at right angels and running in a northerly
direction a distance of one hundred fifty (150) feet to a
point on the southern side of Nina Alley; thence along the
southern line of Nina Alley in a westerly direction at
right angles a distance of forty (40) feet to a point;
thence at right angles in a southerly direction a distance
of one hundred fifty (150) feet to the point of BEGINNING.
BEING Lot No. 109, on a Plan of and as laid out by the
Columbian Land Improvement Company, recorded in Misc.
Record Book No. 14, Page. 287.
unless the said Defendants shall, within thirty (30) days after
service and publication of the notice of this order, commence
an Action in Ejectment or other appropriate action to assert
any claim they may have in and to the said lands against the
Plaintiffs herein; and upon the failure of the Defendants, or
any of them, to commence such action against the Plaintiffs
within thirty (30) days after such service and pUblication, the
Prothonotary of Cumberland County, Pennsylvania, is directed,
upon praecipe of the Plaintiffs, to enter final judgment herein
in favor of the Plaintiffs and against the Defendants pursuant

Paul R. Haverstock and Norma K. Haverstock, his wife,
Plaintiffs in the above-captioned matter by their attorney,
MARLIN R. McCALEB, Esquire, respectfully represents as follows:
1. The Plaintiffs herein commenced the within Action to

Quiet Title against the above-named Defendants by Complaint,
properly endorsed with Notice to Defend pursuant to Pa.R.C.P.
No. 1009, filed in the above court to the above term and number
on August 8, 1995.
2. The said Complaint was served upon the Defendants
herein, George J. Williamson, his heirs, executors,
administratore and assigns, by newspaper publication generally
in The Cumberland Law Journal on August 25, 1995, and in the
Metro .est section of The Patriot-News on August 29, 1995,
pursuant to an Order of Court dated August 14, 1995, as more
fully appears in the Affidavit of Service filed herein on
October 4, 1995, pursuant to Pa.R.C.P. No. 1066{a).

3. More than twenty (20) days have elapsed since the
Complaint was served as aforesaid and since the last appearance
of the newspaper publications as aforesaid.
4. No appearance has been entered on behalf of any of the
above-named Defendants, nor has any Answer or other pleading
been filed herein on behalf of any of the above-named
Defendants.
WHEREFORE, Plaintiffs, through their attorney, respectfully
requests your Honorable Court to enter judgment by default in
their favor and against the said Defendants, to grant
Plaintiffs the relief requested in the Complaint, and to enter
the Order attached hereto as a final order in the above-
captioned matter.

COMPLAINT
1.
The Plaintiffs herein are PAUL R. HAVERSTOCK and NORMA K.
HAVERSTOCK, his wife, adult individuals who reside at 24 Andes
Drive, Mechanicsburg (Upper Allen Township), Cumberland County,
Pennsylvania.
2.
The Defendants herein are GEORGE J. WILLIAMSON, an adult
individual whose present residence and whereabouts are not
known and cannot be ascertained, and his Heirs, Executors,
Administrators and Assigns, the identity and whereabouts of
which are not known and cannot be ascertained.

The property which is the subject of this action
(hereinafter referred as "the subject property") is bounded and
described as follows:
ALL THAT CERTAIN, piece or parcel of land situate in the
Township of Lower Allen, County of Cumberland, and state of
Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point on the north side of New York Avenue,
two hundred forty (240) feet in an easterly direction from a

direction along the northern line of New York Avenue a distance
of forty (40) feet to a point; thence turning at right angles

point; thence at right angles in a southerly direction a

BEING Lot No. 109, on a Plan of land as laid out by the
Columbian Land Improvement company, recorded in Misc. Record
Book No. 14, Page 287.

An abstract of Plaintiffs' title for the subject property
is attached hereto and made a part hereof, marked Exhibit "A".
5.
The subject property described in Paragraph 3, above, is
the same property that was acquired by the Defendant George J.
Williamson by deed of Columbian Land Improvement Company of
Harrisburg, Pennsylvania, dated May 7, 1894, and recorded in
the office of the Recorder of Deeds of Cumberland County,
Pennsylvania, in Deed Book "G", Volume 5, Page 90.

There is no document of record in the Office of the
Recorder of Deeds of Cumberland County, Pennsylvania, by which
the Defendant George J. Williamson sold, transferred, assigned
or otherwise conveyed the subject property to any other person
(except as described in Paragraph 7, below), nor is there any
record of any estate in the Office of the Register of wills of
Cumberland county, pennsylvania, for the Defendant George J.
Williamson by which his interest in the subject property was
transferred or conveyed unto his Heirs.

The subject property was sold by the Tax Claim Bureau of
Cumberland County, Pennsylvania, on October 21, 1963, as the
property of the Defendant George J. Williamson, for delinquent
county, township and school district real estate taxes for the
years 1959, 1960, 1961 and 1962, and same was purchased at the
tax sale by Milton Aronauer, who subsequently received a deed
therefor from the said Tax Claim Bureau dated March 6, 1964,
and recorded in the Office of the Recorder of Deeds of
Cumberland County, Pennsylvania, in Deed Book "D", Volume 21,
Page 52.

Notice of the tax sale described in Paragraph 7, above,
was given by the said Tax Claim Bureau by posting and
publication as required by law and notice was also sent by

certified mail to the Defendant George J. Williamson at the
following address:

Camp Hill, Pennsylvania 17011
but said mail notice was returned with the post office notation
"Addressee Unknown."

The non-delivery of the certified mail notice as described
in Paragraph 8, above, raises a question as to whether proper
notice of the sale was given as required by law, which in turn
raises a question as to validity of the tax sale, all of which
questions together constitute a cloud upon the title to the
subject property.

The subject property was sold and conveyed by the said
Milton Aronauer to the said Plaintiffs herein by Deed dated
January 9, 1971 and recorded in the Office of the Recorder of
Deeds of Cumberland County, Pennsylvania, in Deed Book "Y",
Volume 23, Page 420, a true copy of which is attached hereto
and made a part hereof, marked Exhibit "B".

At the time of the conveyance described in paragraph 10,
above, Plaintiffs were the owners of Lot 108 on the aforesaid
Plan of Columbian Land Improvement Company, which Lot 108

adjoins the subject property on the east and upon which Lot 108
was constructed a residential dwelling house known and numbered
as 2308 New York Avenue, which house the Plaintiffs occupied as
their residence from at least 1960 until July 9, 1971.

Plaintiffs sold and conveyed their home at 2308 New York
Avenue to John Larry Bowen and Kathleen Joyce Bowen, his wife,
by Deed dated July 9, 1971 and recorded in the Office of the
Recorder of Deeds of Cumberland County, Pennsylvania, in Deed
Book "E", Volume 24, Page 244.

Plaintiffs entered into a contract for the sale and
conveyance of the subject property to the said John Larry Bowen
and Kathleen Joyce Bowen, his wife, as evidenced by Articles of
Agreement dated July 9, 1971, which were not recorded, a true
copy of which Articles is attached hereto and made a part
hereof, marked Exhibit "C".

Plaintiffs and their contract vendees have continuously,
since at least January 9, 1971, to the present, being a period
in excess of twenty-one (21) years, been in possession,

ownership and control of the subject property and have enjoyed

the exclusive use and benefit of the same by cultivating and
maintaining a grass lawn and shrubs thereon and by using and
enjoying same as a yard and parking area for the residence at
2308 New York Avenue.
Plaintiffs and their contract vendees have continuously,
since January 9, 1971, being a period in excess of twenty-one
(21) years, claimed full, complete and sole ownership in and
titled to the described property by the recorded deed of
conveyance of Milton Aronauer dated January 9, 1971, by:
(a) the payment of the realty transfer tax upon the
recording of the said deed of conveyance; (b) by the
execution and delivery of Articles of Agreement
dated July 9, 1971; (c) by the cultivation and
maintenance of a hedge or line of shrubs along the
western boundary line of the subject property as
a means of enclosure and to noticeably separate the
subject property from the lands adjoining it on
the west; (d) and by the payment of the annual
county, township and school district real estate
taxes accessed against the subject property for
each year from 1971 to the present.

since at least January 9, 1971, to the present, being a
period in excess of twenty-one (21) years, neither the
Defendants herein nor anyone claiming by, from or under them or
on their behalf have asserted any right, title, interest or
claim in and to the subject property, nor have they attempted
to enter into possession of or to exert control over the
subject property, nor have they interrupted in any other way
the aforesaid possession, use, benefit and enjoyment of the
subject property by the Plaintiffs herein and their contract
vendees.

The aforesaid possession, use, control and enjoyment of
the subject property by the Plaintiffs herein and their
contract vendees since at least January 9, 1971, has been
actual, adverse, continued, visible, notorious, distinct and
hostile to all others, and said possession has been
particularly adverse and hostile to and inconsistent with any
right, title, interest, claim, use, benefit, enjoyment or
possession in or of the subject property by the Defendants
herein, or any of them, or anyone claiming by, from or under
them or acting on their behalf.

For the reasons set forth above, a perfect and
indefeasible title in fee in and to the subject property has
become vested in the Plaintiffs herein by reason of adverse
possession and by reason of the applicable statute of
limitations of the Commonwealth of Pennsylvania.
WHEREFORE, Plaintiffs herein respectfully request your
Honorable Court pursuant to Rule No. 1066 of the Pennsylvania
Rules of civil Procedure:
a. To enter an Order directing the Defendants
herein to commence an Action in Ejectment or to assert
any right, title or interest in which they may claim
against the Plaintiff and the subject property within
thirty (30) days after notice of said Order; and
b. Upon default thereof by Defendants, to enter a
final Order directing that the Defendants herein, or any
of them, be forever barred from asserting right, title or
interest in and to the subject property that is
inconsistent with the claim of Plaintiff herein as set
forth above, and also granting to and vesting in the
Plaintiffs, their heirs and assigns, all right, title and
interest in and to the subject property, and further
directing that a certified copy of such Order be recorded
in the Office of the Recorder of Deeds in and for

MOTION FOR SPECIAL ORDER DIRECTING SERVICE BY PUBLICATION
TO THE HONORABLE, THE JUDGES OF SAID COURT:
Plaintiffs, Paul R. Haverstock and Norma K. Haverstock,
his wife, by their attorney, Marlin R. McCaleb, Esquire,
pursuant to Pa.R.C.P. No. 430, move your Honorable Court for a
special order permitting service of the Complaint in this
action by publication generally upon the Defendants herein for
the following reasons:
1. The last-known residence for the Defendant George J.
Williamson, as of May 7, 1894, was the City of Harrisburg,
Dauphin county, Pennsylvania, and no more recent or precise
address can be found for him.
2. The Defendant George J. Williamson is believed to be
deceased but no further information concerning his whereabouts,
his death, his estate, his heirs or next-of-kin can be found

among the pertinent records of the Offices of the Recorders of
Deeds of Cumberland or Dauphin Counties, or the Offices of the
Registers of wills of Cumberland or Dauphin Counties.
3. Plaintiffs have been unable to ascertain the

identities or the present whereabouts of the heirs, executors,
administrators or assigns of the Defendant George J. Williamson
for the reasons set forth in the Affidavit attached hereto and
made a part hereof.
4. For the foregoing reasons, the heirs, executors,
administrators and assigns of the Defendant George J.
Williamson are unknown and cannot be ascertained.
5. Unless the Court allows service by publication
generally upon said Defendant, his heirs, executors,
administrators and assigns, Plaintiffs will be unable to
maintain this action and injustice will result.
WHEREFORE, Plaintiffs request your Honorable Court to
enter a special order directing service of the Complaint upon
the Defendant George J. Williamson, his heirs, executors,
administrators and assigns, by publication generally pursuant
to Pa. R.C.P. No. 4JO{b) and Cumberland County Local Rule No.
1009-1.

AFFIDAVIT IN SUPPORT OF PLAINTIFFS' MOTION FOR SPECIAL ORDER
MARLIN R. McCALEB, hereby certifies and says:
1. That I am the attorney for Paul R. Haverstock and
Norma K. Haverstock, his wife, the Plaintiffs in the above-
captioned action to quiet title.
2. At my direction, an investigation has been conducted
into the whereabouts of the Defendants herein. The efforts to
locate said Defendants have included the fOllowing:
a. The deed by which the Defendant George J.
Williamson acquired title to the subject premises, dated May 7,
1894, and recorded in the Office of the Recorder of Deeds of
Cumberland County, Pennsylvania, in Deed Book "G", Volume 5,
Page 90, recices that he was then a resident of the City of
Harrisburg, Dauphin County, Pennsylvania, but provided no
specific street address or any other information by which he
might now be located.
b. Despite diligent search of the land records in
the Office of the Recorder of Deeds of Cumberland County,

Pennsylvania, no recorded document has been located evidencing

the sale or other disposition of the subject property by the
said George J. Williamson and in fact the property was sold for
delinquent real estate taxes in 1963 as the property of George
J. Williamson, with no known address for him.
c. The undersigned has reviewed the tax assessment
and voter registration records in Dauphin and Cumberland
counties, as well as the land records in the Offices of the
Recorders of Deeds of Dauphin and Cumberland Counties, in an
effort to uncover any evidence of the residence or whereabouts
of George J. Williamson or the identity of his heirs,
executors, administrators or assigns, but was unable to find
any such evidence, or any evidence of his owning any other
property in either county.
d. If the Defendant George J. Williamson was an
adult when he acquired the property in 1894, he would be at
least 122 years old today and he is therefore believed to be
deceased. The undersigned has reviewed the estate records in
the Offices of the Registers of Wills of Dauphin and Cumberland
counties in an attempt to ascertain whether the said George J.
Williamson died a resident of either county, and if so, the
identity of his heirs, executors, administrators, assigns or
next-of-kin, but was unable to find any record of his death or
his estate in either county.
e. The undersigned has reviewed the telephone

directory for HarriSburg, Pennsylvania, in an attempt to locate
any relatives, heirs or next-of-kin of George J. Williamson.

Williamson, Jr.", one telephone listing for "George
Williamson", and two listings for "George E. Williamson" but no
other listings for any other name similar to the Defendant
George J. Williamson. All five individuals were contacted but
none claimed any knowledge of George J. Williamson, nor any
relationship to him.
f. The undersigned has been unable to identify any
relatives, neighbors, friends or employers of the said George
J. Williamson, or any other persons who could provide
information as to his whereabouts or next-Of-kin.
3. Because of the passage of time since the last known
residence of George J. Williamson in 1894, the undersigned
believes it is pointless to make inquiry of postal authorities
concerning an address for him.
4. If the Defendant George J. Williamson died a resident
of some county other than Cumberland or Dauphin County, or some
state other than Pennsylvania, there is no practical way to
locate or identify his heirs, assigns or next-of-kin.
5. The allegations of this Affidavit are true and correct
to the best of my knowledge, information and belief. I
understand that false statements herein are made subject to the
penalties of 18 Pa.c.s.~ 4904, relating to unsworn
falsification to authorities.
