John Otto with respect to the allegations he has made concerning the installation of the sewer line. Enclosed for your information is a copy of Hr. Otto's most recent correspondence in which he suggests he is seeking $1,467.19 to restore his yard "to its full beauty prior to CSA's excavation". It is the position of CSA that the excavation work done on the Otto property was properly performed and, at most, there lIIay have been some minor damage to a few plants and some minor damage to the driveway area. Pursuant to the Easement Agreement that you signed with CSA in connection with this project, you assumed the obligation to "restore any disrupted areas" on the Otto property as a result of the work performed. Accordingly, .should Hr. Otto feel it appropriate to commence any litigation against CSA relative to the allegations of failure to make appropriate restoration, CSA would be obliged to join you as a additional defendant and suggest that it is your responsibility to pay any monies owed for restoration. At this point, CSA is interested in resolving the case, but is not about to succumb to what we believe to be unreasonable demands on the part of Hr. Otto. I can certainly understand why the damage to your property that was allegedly caused by the CSA. Many people complain about what they believe to be unreasonable actions or activities of authorities. Unfortunately, there is no body that regulates the rates or activities of authorities other than the Authority Board of Directors itself. State law permits authorities to establish their own rates, rules for service or procedures. 1\ customer has only a few alternatives when it com~s to protesting those charges. First, a customer has the right to file suit in Common Pleas Court to receive compensation for damage done. That, of course, requires a lawyer and resources. The only other alternative is to protest the actions to the elected officials who aoooint the members of the authority. While authority members are appointed, the people who assign them those positions are not. OPINION AND ORDER OF COURT BAYLEY, J., February 9.1998:- On August 9, 1995, plaintiffs, John Otto and Carolyn Otto, instituted this suit against defendants Earl F. Smilh, II, E. Lee Koch, James Slyder and Carlisle Suburban Authority, Defendants filed preliminary objections to the complaint on August 25, 1995, Plaintiffs, as of course, filed an amended complaint on September 1, 1995.1 In paragraph 6 of their amended complaint, plaintiffs aver: On July 10, 1991, Plaintiffs (Grantors) executed a contract with the CARLISLE SUBURBAN AUTHORITY (Grantee) for the purpose of laying and connecting new sewer and water lines to the existing mains on Plaintiffs [sic] property. Workmen did not save top soil [sic] and their backhoe and excavated debris damaged Plaintiffs [sic] blacktop driveway and destroyed lawn and plants, See Exhibit lOA." (Emphasis added,) The contract attached as Exhibit A to the complaint is dated June 10, 1991, not 1. Pa, Rule of Civil Procedure 1028(c)(1). 95-4276 CIVIL TERM July 10, It Is titled "DEED OF EASEMENT, RIGHT-OF.WAY AND RIGHT OF ENTRY AGREEMENT," The document sets forth that the Carlisle Suburban Authority had undertaken construction of a building sewer/sewer lateral to connect a property "Immediately to the East of [the Otto's] property across Pennsylvania Route 34," The Ottos granted and conveyed to Carlisle Suburban Authority "[a] permanent easement and a free, uninterrupted and unobstructed right-of-way" on their property to allow for the construction of that "building sewer/sewer lateral line." The agreement further provided: The [Carlisle Suburban Authority], in connection with the exercise of any of the rights and privileges herein granted, shall restore the surface of the said premises of [the Otto's], as nearly as practical to its contour and condition as existed prior to the exercise of said rights and privileges, within ninety days of termination of each occurrence. Plaintiffs aver in paragraph 7 of their amended complaint: Plaintiffs [sic] contract with the CARLISLE SUBURBAN AUTHORITY has been breached [sic] Plaintiffs [sic] driveway, lawn and plants have not been " . , restored to Its original contour and condition. . . within ninety days . , .' A copy of the contract Is attached as Exhibit 'B.' (Emphasis added.) Plaintiffs sought judgment against defendants in the amount of $1,500 for lawn, plant and driveway damage, and $2,000 consequential damages. Defendants filed a motion for judgment on the pleadings that was briefed and argued on January 28, 1998, The individual defendants seek to be dismissed because they were not parties to the written contract dated June 10, 1991, which plaintiffs have sued upon. All defendants seek a dismissal of the action based on the -2- ...~ 95-4276 CIVIL TERM four year statute of limitations for contract actions set forth in the Judicial Code at 42 Pa,C.S, Section 5525.2 The written contract dated June 10, 1991, that plaintiffs have sued upon was entered into solely with the Carlisle Suburban Authority, Plaintiffs plead that Earl F. Smith, II, Is the chairman of the Carlisle Suburban Authority, E. Lee Koch is the superintendent of the Authority, and James Slyder Is the contractor for the Authority. .3. Plaintiffs cannot recover damages against the individual defendants based on their complaint seeking damages for the alleged breach of their written contract with the Authority, Accordingly, judgment will be entered in favor of the individual defendants. As to the defense of the statute of limitations, plaintiffs averred in their amended complaint that: On or about June 16, 1991, and in recognition of thoir failure to separate topsoil and undersoll, defendants delivered about one cubic yard of fill dirt containing rocks, stones and weeds. . ., (Emphasis added,) Plaintiffs further averred that they instituted a civil action for breach of their contract with the Authority against defendants before a District Justice, and that suit was dismIssed without preJudice on July 10, 1995.' Defendants raised the defense of the statute of limitations in new matter. Pa, Rule of Civil Procedure 1 030(a) , 3, Plaintiffs did not file an appeal from the dismissal by the District Justice of their suit under Pa, Rule of Civil Procedure DJ 1002. Rather, they filed a complaint under Pa. Rule of Civil Procedure 1007, 95-4276 CIVIL TERM the time of breach. Romeo & Sons, Inc. v. Yezbak & Sons, Inc., 539 Pa, 390 (1995), Considering the date of the alleged breach as June 18, 1991, the last date work was performed, the applicable dates are: Date of Contract June 10, 1991 Defendants' date of breach June 18, 1991 Suit Instituted before a District Justice June 6, 1995 Suit dismissed by District Justice without prejudice July 10, 1995 Complaint filed In this case August 9, 1995 The four year statute of limitations In 42 Pa.C,S. Section 5525 ended on June 17, 1995, four years from the date the last work was performed on the subject contract which was June 18, 1991. Thus, plaintiffs' suit filed before the District Justice on June 6, 1995, was within the four year statute of limitations. The dismissal of a complaint wilhout prejudice from the entry of a voluntary nonsuit does not toll the statute of limitations, WIlliams Studio Division of Photography by Tallas, Inc. v. Nationwide Mutual Fire Insurance Company, 380 Pa. Super, 1 (1988). The reason for that rule Is to prevent plaintiffs from extending a period of limitations based on plaintiffs' own conduct. See Rosenberg v. Nicholson, 408 Pa, Super. 502 (1991). In contrast, the dismissal of plaintiffs' action without prejudice by the District Justice In the present case did not result from plaintiffs' conduct. Shulenberger, which action was Docketed with District Justice Shulenberger at CV-283-95. A copy of Plaintiffs' Complaint demonstrating that said action is identical to the claims filed in this action is attached hereto and marked as Exhibit A. 17 A hearing on the action filed by Plaintiffs against Defendants before District Justice Shulenberger was held before District Justice Shulenberger on July 10, 1995. At that hearing, judgment was entered in favor of the Defendants. 18 The dismissal of the action by the District Justice was issued pursuant to a Order on July 10, 1995, copy of said Order being attached hereto and marked as Exhibit B. 19 District Justice Shulenberger dismissed Plaintiffs' action due to the statute of limitations issues (see letter from District Justice Shulenberger attached hereto and marked as Exhibit C). 20 The above captioned action, which is essentially an appeal of District Justice Shulenberger's July 10, 1995 judgment in favor of the Defendants, was initiated by the filing of a Complaint with the Cumberland County Prothonotary on August 9, 1995. 21 The appropriate method to file an appeal of a District Justice's judgment is to file a Notice of Appeal with the Prothonotary pursuant to PaRCP DJ 1002. 22 Plaintiffs did not file a Notice of Appeal as required by PaRCP DJ Rule 1002. 23 Plaintiffs' claim suggests that one or more of the Defendants negligently damaged Plaintiffs' landscaping while performing excavation work at Plaintiffs' property. 24 Plaintiffs' claim as it relates to negligence is barred by the applicable statute of limitations. 25 Plaintiffs suggests a claim that may sound in contract as it relates to the right-of-way agreement entered into between Plaintiffs and Carlisle Suburban Authority on June 14, 1991. 26 Plaintiffs' claim that is pled in a breach of contract nature is barred by the applicable statute of limitations. 27 Defendant Earl F. Smith II did not perform any of the work which is the subject of this litigation. 28 Although Defendant E. Lee Koch did perform some work involving the water and sewer connections, Defendant Koch did not perform any of the work which is the subject of this litigation nor is it alleged that Defendant Koch caused any of the alleged damage to Plaintiff's property.
