NO. 95-4293 CIVIL TERM Defendants COMPLAINT 1. The Plaintiff, Lower Allen Township (herein "Township"), is a first class township organized and existing under the laws of the Commonwealth of Pennsylvania, having its principal office at Township Municipal Building, 1993 Hummel Avenue, Camp Hill (Lower Allen ToWnship), Cumberland County, Pennsylvania 17011. 2. The Defendant, John 0, Vartan, t/a Independent American Investments, has a place of business at 3601 Vartan Way/ Harrisburg, Dauphin County, Pennsylvania 17110. 3, The Defendant, The Buonarroti Trust, a Pennsylvania trust, has a place' of business at 3601 Vartan Way, Harrisburg, Dauphin County, Pennsylvania 17110. 4, The Defendant, Vartan Enterprises, Inc. , is a Pennsylvania corporation, has a place of business at 3601 Vartan Way, Harrisburg, Dauphin County/ Pennsylvania 17110. 5. Pursuant to the aU\Jhorizations of Section 501(1), ~ agg., of the Pennsylvania Municipalities Planning Code of July 31, 1968 (herein "Act"), 53 P.S. 5501(1), ~ ~., the Board of Commissioners of Township amended the Codified Ordinances of I,ower Allen Township, 1985 (herein "ordinances"), by enacting Ordinance No. 86-10, effective April 2, 1987, a copy of part of which is section 1169.03, marked Exhibit No.1, hereto attached and made part hereof, dealing, inter AliA, with the charging of applicant with the charges of the Township Engineer for all matters relating to review, comments, and recommendations with respect to subdivision and land development plans. 6. section 503(1) of the P~nnsylvania Municipalities Planning Code (herein "Act"), effective February 20, 1989, 53 P.S, 5503 (1) , provides that "... subdivision and land development ordinances may include...(l) provisions for the submittal and processing of plans, including the charging of review fees, . , . Rev.iew fees may include reasonable and necessary charges by the township's professional consultants or engineer for review and report thereon to the municipality. Such review fees shall be based upon a schedule established by ordinance or resolution. Such review fees shall be reasonable and in accordance with the ordinary and customary charges of the municipal engineer or consultants for similar services in the community, but in no event shall the fees exceed the rate or cost by the engineer or consultant to the municipality when fees are not reimbursed or otherwise imposed on appl icants. . . , " 7. Pursuant to the authorization of section 503(1) of the Act, 53 P.S. 510503(1), the Board of Commissioner~ of Township, amended section 1069.03 of the Codified Ordinances of Lower Allen - 2 - Township, 1985, (herein uOrdinancesU) by enacting Ordinance No. 90~5, ~ffective May 14, 1990, a copy of part of which is marked Exhibit 2, attached hereto and made part hereof, implementing Section 503(1) of the Act, 53 P.S. 510503(1), dealing, inter AliA, with charging applicants with engineering fees for review of plans for subdivision and land development. 8. On January 14, 1991, the Board of Commissioners of Township adopted Resolution 91-R-ll, copy of which is marked Exhibit No.3, attached hereto and made part hereof, establiShing, inter AliA, fees and charges under Section 1169.03 of the Ordinances, for review by the Township Engineer of subdivision and land development plans which fees and charges are reasonable and necessary tor review of subdivision and land development plans and report thereon to the Township, are reasonable and in accordance with the ordinary and customary charges by the Township Engineer for similar services in the TownShip, and do not exceed the rate or costs charged by the Township Engineer to the Township when fees are not reimbursed or otherwise imposed on an applicant. 8. On or about May 18, 1988, Defendant, John o. Vartan, t/a Independent American Investments, filed or caused to be filed West Shore Liberty Center Preliminary/Final Land Development Plan (herein UWest Shore Liberty Center PlanU) dated May 18, 1988. On or about January 5, 1990, Defendant, Vartan Enterprises, Inc., filed a revised West Shore Liberty Center Plan. On or about - 3 - October 10, 1991, Defendant/ Vartan Enterprises, Inc" filed a revised West Shore Liberty Center Plan, On or about June 9, 1992, Defendant, Vartan Enterprises, Inc., filed a revised West Shore Liberty Center Plan. And on or about November 5, 1992, Defendant, The Buonarroti Trust, filed a revised West Shore Liberty Center Plan, In dealing with the Township and other regulatory bodies, such as Pennsylvania Department of Environmental Resources, the Defendants on one or more occasions acted interchangeably as appl icants. 9, Herbert, Rowland & Gubic, Inc., 369 East Park Drive, Harrisburg, Pennsylvania 17111, is and has been the duly appointed Township Engineer (herein "Township Engineer") since 1981. 10. At the request of Codes Administrator, John M. Eby, the Township Engineer reviewed the original West Shore Liberty Center Plan and revisions thereof and reported thereon to the Board of Commissioners and appropriate employees of Township. For such services rendered and as are more fully set for in the invoices, the Township Engineer billed the Township as follows: (a) Invoice No. 92216, dated August 28, 1992, in amount of $42.50, copy of which is marked Exhibit No.4, attached hereto and made part hereof. (b) Invoice No. 922719, dated October 30, 1992, in the amount of $609.58, copy of which is marked Exhibit No.5, attached hereto and made part hereof. - 4 - (c) Invoice No. 922427, dated September 25, 1992, in the amount of $175.14, copy of which is marked Exhibit No.6, attached hereto and made part hereof, (d) Invoice No. 923080, dated November 27, 1992, in the amount of $282.42, copy of which is marked Exhibit No.7, attached hereto a~d made part hereof, (e) Invoice No. 923493, dated December 24, 1992, in the amount of $225.68, copy of which is marked Exhibit No. 8, attached hereto and made part hereof. (f) Invoice No. 930016, dated January 29, 1993, in , $435.55, copy of which is marked Exhibit the amount of No. 9, attached hereto and made part hereof, (g) Invoice No. 93039, dated February 26, 1993, in the amount of $85.00, copy of which is marked Exhibit No. 10, attached hereto and made part hereof, 11. The fees and charges of the Township Engineer set forth in paragraph 10 hereof are reasonable and necessary, are based upon a schedule established by resolution, and are reasonable and in accordance with the ordinary and customary charges by the Township Engineer for similar services in the Township and do not exceed the rate or costs charged by the Township Engineer to the Township when such fees and charges are not reimbursed or otherwise imposed on applicant. - 5 - '133 Admlnlltration and Enforcement 1169.01 (dl The approval of a lubdivilion or land development plat or of .ny improvement inltalled, or the qrantinq of a permit for the ule of land or erection of a Itructure thereon, Ihall not conltitute a reprelentation, quarantee, or warranty of any kind or nature by the municipality or any official, employee, or appointee thereof, of the lafdty of any land, improvement, property or use from any caule whatsoever, and shall create no liability upon, or a cause of action aqainlt the municipality or such official, employee or appointee for any damage that may relult purluant thereto. 1169.02 FILING FEES. At the time of filing, all Plats shall be accompanied by a check payable to the Township, in the amount specified herein, to defray the cost of reviewing the proposed Plats and required data. (a) The fee for filing a Preliminary Subdivision Plat and a Final Subdivision Plat shall be established by Resolu- tion of the Board of Commil.ioners. (bl The fee for filing a Preliminary Land Development Plat and a Final Land Development Plat shall be established by Resolution of the Board of Commissioners. 1169.03 ENGINEERING FEES. (al At the time of filing of a Preliminary Plat, Applicant shall deposit with the Township an estimated amount determined or approved by the Engineer sufficient to cover th~ charges of the Engineer to the Township for all matter a relating to review, com- ments and recommendations with respect thereto, including but not limited to meetings with Applicant or Applicant's consultants and site inapection. (bl At the time of filing of a Final Plat, Applicant shall deposit with the Township an estimated amount determined or approved by the Engineer sufficient to cover the charqes of the Engineer to the Townlhip for all matters relating to review, comments and recommendations with respect thereto, including but not limited to meetings with Applicant or Applicant's consultantl, site inspection, and preparing or reviewing cost estimates of improvements required under Article 1181 or otherwise. (cIOn or before the date on which the Final Plat il to be considered by the Board of Commissioners, Applicant shall depolit ~\tt the Townlhip an estimated amount determined or approved by . the ~ngineer sufficient to cover the charges of the Engineer to Exhibit No. 1 134 ~ini.tration and Enforcement 1169.03 the Townlhip relating to review, commentl, and recommendationl with respect tp the Final Plat, lite inspection, attendance at meetingl with Applicant, Consultant, or contractor or sub-contrac- tor, inspecting required improvements during construction, final inspection on completion of inst~llation or required improvements, and other engineering verification required by the Ordinance. (d) If the aforesaid deposits are insufficient to cover the charges of the Engineer to the Township for the aforesaid services rendered or any other engineering services rendered relating to the Plat, Township shall bill Applicant for such deficiency. Applicant shall pay Township the amount of such bill. If the aforesaid deposits exceed said charges of the Engineer to the Township, the balance remaining shall be refunded to the applicant without interest after final release by the Board of commissioners of any security posted with respect to maintenance or repair of the improvements required by Article 1181. (e) Failure of the Applicant to make any required de90Sit or to pay any bill submitted under or within the time specif:cd in ths Section 1169.03 shall be a reason for disapproval of the Plat or revocation of any building or zoning permit issued to Applicant or Applicant's heirs, successors, or assigns. 1169.04 OTHER FEES. (a) Fees for all other permits required for or by the Town- ship or Lower Allen Township Authority for opening roads, connecting to sanitary sewer, building, zoning, etc. shall be paid by cash or a check to the Township (b) At the time of filing of a Final Plat, Applicant shall deposit with the Township an estimated amount to cover the costs of advertising any ordinance accepting dedication of applicable required improvements and to cover the costs of recording the ordinance and any deed of dedication, easement and right-of-way with respect thereto. If the aforesaid deposit is insufficient to cover such costs, Township shall bill Applicant for such deficiency. Applicant shall pay Township the amount of such bill. If the aforesaid deposit exceeds the costs of advertising and recording, the balance remaining shall be refunded to Applicant without interest after final release bI Board of Commissioners of any security posted with respect to ma ntenance or repair of the improvements required by Article 1191. . (c) A'. or before the date on which the Final Plat is to be consiIered by the Board of Commissioners, Applicant shall deposit with the Township an estimated amount determined by the Board of Commissioners sufficient to cover the costs of any eminent domain . 135 - Administration and Enforcement 1169.05 proceedings which may be instituted by the Township for the in- stallation of any off-site improvements required under Article 1161, including but not limited to filing fees, engineering, surveys, appraisalS, expert witnesses, discovery, court costs, condemnee damages, attorney's fees. If the aforesaid deposit is insufficient to cover said costs, Township shall bill Applicant for such deficiency. Applicant shall pay Township the. amount of such bill. If the aforesaid deposit exceeds such costs, the balance remaining shall be refunded to Applicant without interest after such proceedings shall become final. (d) Failure of the Applicant to make any required deposit or to pay any bill submitted under or within the time specified in this Section 1169.04 shall be a reason for disapproval of the Final Plat or revocation of any building or zoning permit issued to Applicant, or Applicant'S heirs, successors, or assigns. 1169.05 ALTERATIONS. (a) Where, owing to special conditions, a literal enforce- ment of the provisions of these regulations will result in unrea- sonable hardship, the Board of Commissioners, on the recommenda- tion of the Planning Commission, may make such reasonable alteration thereto as will not be contrary to the public interest and so that the spirit of these regulations shall be observed and substantial justice done. (b) An application for an alteration shall be submitted in writing by the Applicant at the time the preliminary plat is filed with the Planning Commission. The application shall state fully the grounds and all the facts relied upon by the applicant. (c) In subdivisions where lots are created for the purpose of seasonal occupancy (for use on weekends, vacations, or for hunting or fishing), the requirements of these regulations con- cerning the width and construction of cartways, curbs or side- walks, and the requirements of plat speCifications and procedures may be modified or waived, subject to the following conditions: (1) The lot area shall be one acre or larger, and (2) Facilities for water supply and sewage disposal shall be approved by the Pennsylvania Department of Environ- mental Resources and be acceptable to the Board of Commissioners and to the Planning Commission. (d) In granting any alteration the Board' of Commissioner.s shall record its action and the grounds for granting any altera- tion to the Applicant applying for the alteration. Applicant shall pay Township the amount of such bill. If the aforesaid deposit exceeda the costs of advertising and recording, the balance remaininq ahall be refunded to Applicant without interest after final release by Board of Commissioners of any security posted with respect to maintenance or repair of the improvements required by Article l181. (c) At or before the date on which the Final Plat is to be conaidered by the Board of Commisaioners, Applicant ahall deposit with the Town,hip an estimated amount determined by the Board of Commissioners sufficient to cover the costs of any eminent domain proceedinqs which may be instituted by the Township for the in- stallation of any off-site improvements required under Article ll81, including but not limited to filing fees, enqineerinq, surveys, appraisals, expert witnesses, discovery, court costs, condemnee damaqes, attorney's fees. If the aforeaaid deposit is insufficient to cover said costs, Township shall bill Applicant for such deficiency. Applicant shall pay Township the amount of such bill. If the aforesaid deposit exceeds such costs, the balance remaininq ahall be refunded to Applicant without interest after such proceedinqa shall become final. (d) Failure of the Applicant to make any required deposit or to pay any bill submitted under or within the time speCified in this Section l169.04 shall be a reason for disapproval of the Final Plat or revocation of any bUilding or zoninq permit issued to Applicant, or Applicant's heirs, successors, or assiqns. 1169,05 MODIFICATIONS. (a) The Board of Commissioners may grant a modification of the requirements of one ~r more pr~vision8 of these requlations' if the literal enforcement will exact undue hardahi~ becauae of peculiar conditions pertaining to the land in question, prOVided ,uch modification will not be contrary to the public intereat and that the purpose and intent of these requlations is observed. (b) An application for a modification shall be submitted in writing by the Applicant ~t the time the preliminary plat is filed. The Application shall state fully the grounds and all the facts relied upon by the Applicant. The application for modification may be referred to the Planning Commission for advisory comments. Pursuant to the authorizations of section 501 (1), ~ ~., of the Pennsylvania Municipalities Planning Code of July 31, 1968 (herein "Act"), 53 P.S. 5501(1), ~ ~., the Board of ... .. commissioners of Township amended the Codified ordinances of Lower Allen Township, 1985 (herein "Ordinances"), by enacting Ordinance No. 86-10, effective April 2, 1987, a copy of pllrt of which is section 1169.03, marked Exhibit No.1, hereto attached and made part hereof, dealing, inter AliA, with the charging of applicant with the charges of the Township Engineer for all matters relating to review, comments, and recommendations with respect to subdivision and land development plans. 6. section 503 (1) of the Pennsylvania Municipalities Planning Code (herein "Actrr), effective February 20, 1989, 53 P.S. 5503(1), provides that "...subdivision and land development ordinances may include... (1) provisions for the submittal and processing of plans, including the charging of review fees,...Review fees may include reasonable and necessary charges by the township's professional consultants or engineer for review and report thereon to the municipality. Such review fees shall be based upon a schedule established by ordinance or resolution. Such review fees shall be reasonable and in accordance with the ordinary and customary charges of the municipal engineer or consultants for similar services in the community, but in no event shall the fees exceed the rate or costs by the eng ineer or consultant to the municipality when fees are not reimbursed or otherwise imposed on appl icants. . . . " - 2 - . 7. pursuant to the authorization of section 503(1) of the Act, 53 P.S. 510503(1), the Board of commissioners of Township, amended section 1069.03 of the codified ordinances of Lower Allen Township, 1985 (herein "ordinances") by enacting ordinance No. 90- 5, effective May 14, 1990, a copy of part of which is marked Exhibit No.2, attached hereto, and made part hereof, implementing section 503(1) of the Act, 53 P.S. 510503(1), dealing, inter ftllA, with charging applicants with engineering feos for review of plans for sUbdivision and land development. 8. On January 14, 1991, the Board of commissioners of Townlthip adopted Resolution 91-R-ll, copy of which is marked Exhibit No.3, attached hereto and made part hereof, establishing, inter AliA, fees and charges under section 1169.03 of the Ordinances, for review by the Township Engineer of subdivision and land development plans which fees and charges are reasonable and necessary for review of subdivision and land development plans and report thereon to the Township, are reasonable and in accordance with the ordinary an cuatomary charges by the Township Engineer for similar sarvices in the Township, and do not exceed the rate or oosts charged by the Township Engineer to the Township when fees are not reimbursed or otherwise imposed on the applicant. 9. On or about May 18, 1988, Defendant, John o. Vartan, t/a Independent Amer ican InvElstments, filed or caused to be filed a ,. - 3 - . West Shore Liberty Center Preliminary/Final Land Developmel,t Plan (herein "West Shore Liberty Center Plan") dated May 18, 1988. 10. On or about January 5, 1990, Defendant, John O. Vartan, tla Independent American Investments, filed or caused to be filed a revised West Shore Liberty Center Plan dated January 5, 1990. 11. On or about October 10, 1991, Defendant, Vartan Enterprises, Inc., filed or caused to be filed a further revised West Shore Liberty Center Plan dated October 10, 1991. 12. On or about June 9, 1992, Defendant, Vartan Enterprises, Inc., filed or caused to be filed a further revised West Shore Liberty Center Plan dated June 9, 1992. 13. On or about November 5, 1992, Defendant, The Buonarroti Trust, filed or caused to be filed a further revised West Shore Liberty Center Plan dated November 5, 1992. 14. Herbert, Rowland & GUbic, Inc., 369 East Park Drive, Harrisburg, Pennsylvania 17111, is and has been the duly appointed Township Engineer (herein "Township Englneer") since 1981. 15. At the request of Codes Administrator, John M. Eby, the Township Engineer reviewed the original West Shore Liberty center Plan and revisions thereof and reported thereon to the Board of Commissioners and appropriate employees of Township. For such servioes rendered and as are more fully set forth in the invoices, the Township Engineer billed the Township as follows: - 4 - .. (a) Invoice No. 92216, dated August 28, 1992, in the amount of $42.50, copy of which is marked Exhibit No.4, attached hereto and made part hereof. (b) Invoice No. 922719, dated October 30, 1992, in , the amount of $609.5B, copy of which is marked Exhibit No.5, attached hereto and made part hereof. (c) Invoice No. 922427, dated September 25, 1992, in the amount of $175.14, copy of which is marked Exhibit No.6, attached hereto and made part hereof. (d) Invoice No. 923080, dated November 27, 1992, in the amount of $282.42, copy of which is marked Exhibit No.7, attached hereto and made part hereof. (e) Invoice No. 923493, dated December 24, 1992, in the amount of $255.68, copy of which is marked Exhibit No.8 attached hereto and made part hereof. (f) Invoice No. 930016, dated January 29, 1993, in the amount of $435.55, copy of which is marked Exhibit No.9 attached hereto and made part hereof. (g) Invoice No. 930391, dated f'ebruary 26, 1993, in the amount of $85.00, copy of which is marked Exhibit No. 10 attached hereto and made part hereof. 16. The allegations of paragraphs 1 to and including 16 are incorporated herein by reference as though herein fully set forth. 18. plaintiff, Lower Allen Township, makes claim against and oharges the Defendant, John o. Vartan, tla Independent American Investments, for the charges of the Township Engineer to the Plaintiff for review of the original West Shore Liberty Center Plan dated May 18, 1988, and all revisions thereof and all reports thereon as more fully set forth in paragraphs 9 to and including 16 of this Complaint in the amount of $1,855.87. 19. Defendant, John o. Vartan, tla Independent American Investments, or his agents, servants, or employees acting within the scope of their employment, or Engineer acting within the scope - 6 - of his employment, prepared or caused to be prepared the original West Shore Liberty Center Plan, all revisions thereto, and all supporting documents required by the Lower Allen Township subdivision and Land Development ordinance necessitating review and reports with respect thereto by the Township Engineer. 20. The Plaintiff, Lower Allen Township, has demanded payment from the Defendant, John o. Vartan, tla Independent American Investments, of the sum due, namely $1,855.87, but the Defendant, John O. Vartan, tla Independent American Investments, has refused and still reuses to pay the same or any part thereof. WHEREFORE, Plaintiff demands judgment against the Defendant, John o. Vartan, tla Independent American Investments, in the amount of $1,855.87, with interest and costs of suit. COUNT-II Lower Allen Township, plaintiff v. Vartan Enterprises, Inc., Defendant 21. The Plaintiff, Lower Allen Township, has demanded payment from the Defendant, Vartan Enterprises, Inc., of the sum due, namely $1,855.87, but the Defendant, Vartan Enterprises, Inc., has refused and still reuses to pay the same or any part thereof. Defendant, The Buonarroti Trust, or its agents, servants, or employees acting within the scope of their employment, or Engineer acting within the scope of his employment, p~epared or caused to be prepared the original West Shore Liberty Center Plan, all revisions thereto, and all supporting documents required by the Lower Allen Township Subdivision and Land Development Ordinance necessi tating review and reports with respect thereto by the Township Engineer. 28. The Plaintiff, Lower Allen Township, has demanded payment from the Defendant, The Buonarroti Trust, of the sum due, namely - 9 - -133 Administration and Enforcement 11~9.01 (d) The approval of a l~bdiv~'iQn or land development pl.~ or of. any imprpvement installed, or the granting of a pe~it for the ule of land or erection of a structure thereon, shall not constitute a representation, guarantee, or warranty of any kind or nature by the municipality or any official, employee, or appointee thereof, of the safety of any land, improvement, property or ule from any cause whatsoever, and shall create no liability upon, or a cause of action against the municipality or luch official, employee or appointee for any damage that may result pursuant thereto. 1169.02 FILING FEES. At the time of filing, all Plats shall be accompanied by a check payable to the Township, in the amount specified herein, ~o defray ths cost of reviewing the proposed Plats and required data. (a) The fee for filing a Preliminary Subdivision Plat and a Final Subdivision Plat shall be established by Resolu- tion of the Board of Commissioners. (b) The fee for. filing a Preliminary Land Development Plat and a Final Land Development Plat shall be establiGhed by Resolution of the Board of Commissioners. 1169.03 ENGIN~ERING FEES. (a) At the time of filing of a Preliminary Plat, Applicant shall deposit with the Township an estimated amount dete~ined or approved by the Engineer sufficient to cover the charges of the Engineer to the Township for all matters relating to review, com- ments and recommendations with respect thereto, including but not limited to meetings with Applicant or Applicant's consultants and site inspection. (b) At the time of filing of a Final Plat, Applicant shall deposit with the Township an estimated amount determined or approved by the Engineer sufficient to cover the charges of the Engineer to the Township for all matters relating to review, comments and recommendations with respect thereto, including but not limited to meetings with Applicant or Applicant's consultant., site inspection, and preparing or reviewing cost estimates of improvements required under Article 1181 or otherwise. (c) On or before the date on which the Final Plat is to be considered by the Board of Commissioners, Applicant shall deposit ~itt the Township an estimated amount determined or approved by . the E.ngineer sufficient to cover the charges of the Engineer to Exhibit No. 1 134 . Administration and Enforoement 1169.03 the Township relating to reviewt oo~ents, and reoommendAtions ',with' nspect tp the Final Plat, dte in.pection, attendance at. meetings with Applicant, ConSUltant, or contractor or sub-contrac- tor, inspeoting required improvements during oonstruotion, final inspeotion on completion of installation or required improvements, and other engineering verification required by the Ordinance. ld' If the aforeSAid deposits are insufficient to cover the charges of the Engineer to the Township fOf the aforesaid service. rendered or any other engineering services rendered relating to the Plat, Township shall bill Applioant for such deficiency. Applicant shall pay Township the amount of .uoh bill. If the aforesaid deposits exceed said charges of the Engineer to the TownShip, the balance remaining shall be refunded to the applicant without interest after final release by the Board of Commissioners of any security posted with respect to maintenance or repair of the improvements required by Articlu 1181. Ie) Failure of the Applicant to make any required deposit or to pay any bill submitted under or within the time specif~~d in ths Section 1169.03 shall be a reason for disapproval of the Plat or revocation of any building or zoning permit issued to Applicant or Applicant's heirs, successors, or assigns. 1169.04 OTHER FEES. la) Fees for all other permits required for or by the Town- ship or Lower Allen Township Authority for opening roads, oonnecting to sanitary sewer, bUilding, zoning, etc. shall be paid by cash or a check to the Township ~ lb) At the time of filing of a Final Plat, Applicant shall deposit with the Township an estimated amount to cover the costs of advertising any ordinance accepting dedication of applicable required improvements and to cover the costs of recording the ordinance and any deed of dedication, easement and right-of-way with respect thereto. If the aforesaid deposit is insufficient to cover such costs, Township shall bill Applicant for such deficiency. Applicant shall pay Township the amount of luch bill. If the aforesaid deposit exceeds the costs of advertiSing and recording, the balance remaining shall be refunded to Applicant without interest after final release by Board of Commissioners of any security posted with respect to maintenance or repair of the improvements required by Article 1181. (d) Failure of the Applicant to make any required deposit or to pay any bill submitted under or within the time specified in this Section 1169.04 shall be a reason for disapproval of the Final Plat or revocation of any building or zoning permit issued to Applicant, or Applicant's heirs, successors, or assigns. . . 1169.05 ALTERATIONS. (a) Where, owing to special conditions, a literal enforce- ment of the provisions of these regulations will result in unrea- sonable hardship, the Board of commissioners, on the recommenda- tion of the Planning Commission, may make such reasonable alteration thereto as will not be contrary to the public interest and so that the spirit of these regulations shall be observed and substantial justice done. (b) An application for an alteration shall be submitted in writing by the Applicant at the time the preliminary plat is filed with the Planning Commission. The application shall stat. fully the grounds and all the facts relied upon by the applicant. (c) In subdivisions where lots are created for the purpose of seasonal occupancy (for use on weekends, vacations, or for hunting or fishing), the requirements of these regulations con- cerning the width and construction of cartways, curbs or side- walks, and the requirements of plat specifications and procedures may be modified or waived, subject to the following conditions: (1) The lot area shall be one acre or larger, and (2) Facilities for water supply and sewage disposal shall be approved by the Pennsylvania Department of Environ- mental Resources and be acceptable to the Board of Commissioners and to the Planning Commission. (d) In granting any alteration the Board'of Commissioner.s shall record its action and the grounds for granting any altera- tion to the Applicant applying for the alteration. . ........ .....
