On that date, plaintiff, while acting in the scope and courBe of his employment, was Buddenly and violently Btruck on his right side by a 250lb lifting hoist which fell from a crane bridge attached overhead. 7. The impact from this incident caused plaintiff to sustain numerous injuries and damages. 8. The lossea, injuries and damages to plaintiff as hereinafter described, were caused by the negligence of the addi tional defendant, its subcontractor, (the defendant), and their agents, servants, or employees in some or al.l of the following particulars: (a) In failing to properly install the crane bridge; (b) In failing to properly install endstops in the crane bridge; (c) In failing to inspect and maintain the crane bridge dnd lifting hoist; (d) In causing or permitting a dangerous, hazardous and unsafe condition to exist with respect to the crane bridge and 2 lifting hoist, (e) In failing to repair the defect in the crane bridge when defendant knew or should have known of its existence, and that it created a serous risk of injury to persons beneath it, (f) In failing to assemble and inspect properly the crane bridge and lifting hoist, (g) In failing to discover the crane bridge's defective condition and/or design. 9. All of Plaintiff's alleged injuries and damages are as a direct and proximate r.esult of Plaintiff's own negligence in the manner in which he acted on the day of the incident in either using the crane bridge assembly before it was completed and tested; operating the lifting hoist in a careless and negligent manner; standing at a location and performing activities which resulted in the lifting hoist becoming unattached from the crane bridge and falling upon him; or in otherwise acting in a careless and negligent manner, which negligent actions or inactions will -8- be further developed during the discovery phase of this case. 20. Allor a part of Plaintiff's alleged injuries and damages are barred by operation of comparative Negligence Act of the commonwealth of pennsylvania. 21. Plaintiff's claim for injuries and damages are barred by operation of the Doctrine of Assumption of Risk in that plaintiff placed himself in a position where he was subject to becoming injured when he knew or should have known that the activities in which he was involved and the position in which he was standing were dangerous while in close proximity to the lifting hoist. 22. All of Plaintiff's alleged injuries and damages are a direct and proximate result of the negligent actions or inactions of parties other than Defendant carlisle.
