Dear Mr. Aie 110 I
This will confirm that our office will undertake repre-
sentation of you in matters relating to the loan of money made
by you to your son and daughter-in-law, william Aiello and Sara
Aiello, of 204 S. Front Street, Wormleysburg, PA. We will under-
take representation to attempt to arrange repayment of the loan
for you and, absent that, we will undertake representation to attempt
to enforce the loan as a lien against the property at 204 S. Front
Street, Wormleysburg, PA and/or enforce a constructive trust in
that property on your behalf.
Our fee rate for such representation will be based upon
our standard rate of $125 per hour for out-of-court services.
Services in court, should any action be brought on your behalf
which results in litigation requiring a trial or hearing, will be
billed at the rate of $150 per hour, as will any appellate work.
Out-of-pocket expenses including, but not limited to, reproduction
expenses, certified or registered mail charges, title abstracting
fees, fax and long-distance telephone charges will be reimbursed
by you on a dollar-for~dollar basis. Reproduction charges will
be billed at $.20 per page and fax charges will be billed at $1.00
per page. Our billings will be rendered to you during the first
week of each month for services rendered during the preceding month.
Payment is required within fifteen (15) days.
We will be prepared to commence representation as soon
as we receive from you a signed copy of this letter of representation
and a retainer fee from you in the amount of $300. The retainer
fee will be credited against fees incurred.

Please be advised that I have liled a revised complaint which corrects errors. loan
dates, amounts of loans and interest rates agreed to by all parties, ( Sara L, Aiello,
William A, Aiello and Samuel M. Aiello), at the time the loans were granted, No other
agreements were made involving the loans with all the parties involved with the loan~
that is William and Sara Aiello and Samuel Aiello
The revised complaint is in agreement with I'lacey & Wright letter to Sara Aiello

Aiello who has retained our services with respect to the loans of
money made by Samuel Aiello to the both of you to facilitate the
purchase and improvement of 204 S. Front Street, Wormleysburg,

On January 21, 1992, Mr. Aiello loaned to the both of

The improvements at 204 S. Front Street, Wormleysburg, PA
have now been completed. However, you have failed to proceed with
completion of the refinancing of the property and the repayment of
Mr. Aiello's loans. Mr. Aiello desires that the refinancing be
accomplished as soon as possible and that he be repaid the full
Bum of the loans, together with accumulated interest. This problem
can be resolved very simply by completion of the refinancing process
which will enable you to repay the loans to Mr. Aiello.
Mr. Aiello has aSked me to assure you that the requests
set forth in this letter are completely independent of any personal

AND NOW, the Plaintiff, Samuel M. Aiello, by his
attorneys, Placey & Wright, Esquires, f ilea this Complaint against
the Defendants alleging I
1. The Plaintiff, Samuel M. Aiello, is an adult indi-
vidual now residing at 998 Old Rt. 15, York Springs, Pennsylvania
17372.
2. The Defendant, William A. Aiello, ia an adult
individual whose last known residential addreas was Apt. 106,
700 Nailor Drive, Camp Hill, Cumberland County, Pennsylvania 17043.
3. The Defendant, Sara L. Aiello, is an adult indi-
vidual now residing at 204 S. Front Street, Wormleysburg, Cumber-
land County, Pennaylvania 17043.
4. On or about January 21, 1992, the Defendants, William
A. Aiello and Sara L. Aiello, verbally requested of the Plaintiff,
Samuel M. Aiello, that the Plaintiff loan to them the sum of Nine-
teen Thousand Five Hundred ($19,500) Dollars to enable the
Defendants to improve, renovate, furnish and equip the real estate
and improvements owned by the Defendants located at 204 S. Front
Street, Wormlcysburg, Cumberland County, Pennsylvania and promised
to repay to the I'lainliff said sum, together with interest at
the rate of five (5%) percent per annum, upon completion and
installation of the improvements, renovations, furnishings and
equipment.
5. 'l'he Plaintiff verbally agreed to loan to the
Defendants the sum of Nineteen Thousand Five Hundred ($19,500)
Dollars upon the Defendants' promise to repay the same on the
terms aforesaid and on January 21, 1992, delivered to the Defen-
dants Nineteen Thousand Five lIundred ($19,500) Dollars, partially
by check and partially in cash, which sunl was accepted by the
Defendants upon such repayment terms and appropriated by them
on January 21, 1992.
6. The Ninetflen 'l'housand Five Hundred ($19,500) Dollars
loaned to the Defendants by the Plaintiff was utilized by the
Defendants to purchase and pay t.he costs and expenses of
improvements and renovations to the real estate and improvements
owned joint ly by the Defendants at 204 S. Front Street,
Wormleysburg, Cumberland county, Pennsylvania and to furniflh and
equip a portion of the same as a beauty salon and beauty spa
business, which business was owned and operated solely by the
Defendant, Sara L. Aiello.
7. On or about November 10, 1993, the Defendants verbally
of the plaintiff that plaintiff loan to them the
sum of Twenty Thousand ($20,000) Dollars to further

enable thu Defendants to improve, renovate, furnish and equip
the real estate and improvements owned by Defendants located at
204 S. Front Street, Wormleysburg, Cumberland County, Pennsylvania
and promised to repay to the Plaintiff said additional Bum, together
with interest thereon computed at the rate of five (5%) percent
per annum upon completion and installation of the improvements,
renovations, furnishings and equipment.
B. Plaintiff verbally agreed to loan to the Defendants
the additional sum of 'rwenty 'l'h':Jusand ($20,000) Dollars upon the
Defendants' pr':Jmise to repay the same on the terms aforesaid and
on November 10, 1993, delivered to the Defendants the sum of Twenty
Thousand ($20,000) Dollars in cash, which sum was accepted by
the Defendants upon such repayment terms and appropriated by them
on November 10, 1993.
9. The additional sum of Twenty Thousand ($20,000)
Dollars was utilized by the Defendants to pay the costs and expenses
of improvements and renovations to the real estate and improvements
owned jointly by the Defendants at 204 S. Front Street, Wormleys-
burg, Cumberland County, Pennsylvania and to furnish and equip
a portion of the same as a beauty salon and beauty spa bus iness,
which business was owned and operated solely by the Defendant,
Sara L. Aiello.
10. On or about February 15, 1994, the improvements
and renovations to the real estate and improvements at 204 S.
Front Street, wormleysburg, Cumberland Count.y, Pennsylvania were

completed and the equipping and furnishing of a portion of the
same as a beauty salon and beauty spa business, owned and operated
solely by the Defendant, Sara L. Aiello, was completed.
11. Since the date of completion, as stated in the pre-
ceding paragraph, the Plaintiff has requested that the Defendants,
and each of them, repay to him the total sums loaned to the
Defendants in the amount of Thirty-Nine Thousand Five Hundred
($39,500) Dollars, together with interest thereon at the rate
aforesaid, and the Defendants, and each of them, have refused
and continue to refuse to repay the same to the Plaintiff.
12. The Defendant, William A. Aiello, remains the owner,
together with Sara L. Aiello, of the real estate and improvement.s
located at 204 S. Front Street, Wormleysburg, CumlJerland County,
Pennsylvania, improved and renovated with the proceeds of the
loans from the Plaintiff.
13. The Defendant, Sara L. Aiello, is the sole owner
of the beauty salon and beauty spa business owned and operated
by her and located at 204 S. Front Street, Wormleysburg, Cumberland
County, Pennsylvania and the furnishings and equipment of said
business, which furnishings and equipment were purchased with
the proceeds of the loans from the Plaintiff.
14. The Defendants, William A. Aiello and Sara L. Aiello,
are justly indebted unto the Plaintiff, jointly and individually,
in the amount of Thirty-Nine Thousand Five Hundred ($39,500)
Dollars, together with interest thereon, computed at the rate

4. This allegation states a conclusion of law to
whioh no response is required. Moreover, the allegation made
by the Defendant, Sara L. Aiello, that the property acquired
or improved with the f.unds loaned from the Plaintiff to the
Defendants is "marital property" has no rI'levance to the cause
of action stated in Plaintiff's Complaint. Whether or not the
property is "marital property" is only relevant to a determination
of the relative rights of the Defendants, William A. Aiello
and Sara L. Aiello, in and to the property. The Plaintiff claims
no intere$t in the property and, therefore, a determination
of the status of the property as "marital property" has no
relevance to a determination of the monetary obligations of
the Defendants to the Plaintiff.
5. Plaintiff bf'lieves that thpre has been a divorce
action filp.d betwep.n the Defendants in the Court of Common Plp.as
of Cumberland County but has no specific knowledge or information
sufficient to determine whether such divorce action is presently
pending in this Court.
6. If there is a divorce action filed bp.tween the
Defendants j,n this Court, this Court has no jurisdiction under
the Divorce Code of the Commonwpalth of Pennsylvania (23 Pa.
C.S.A. 53101 et sP.q.) nor undp.r the Rules of Court governing
actions of divorce or annulment of marriage (pa. R.C.P. 1920.1
et seq.) to p.ntertain or adjudicate the claim of thp. Plal,ntiff

Aiello who has retained our services with respect to the loans of
money made by Samuel Aiello to the both of you to facilitate the
purchase and improvement of 204 S. Front Street, Wormleysburg,
PA.
On January 21, 1992, Mr. Aiello loaned to the both of
you the sum of $20,000 evidenced by his negotiated and cancelled
check dated January 21, 1992. In addition, on November 10, 1993,
Mr. Aiello, loaned the sum of $19,500, in cash, to the both of

accomplished as soon as possible and that he be repaid the full
sum of the loans, together with accumulated interest. This problem
can be resolved very simply by completion of the refinancing process
which will enable you to repay the loans to Mr. Aiello.

l. Rule of civil Praceelure
New Rule of Civil Procedure 230,2 IUls been promulgaled to govem the temllnalion of inactive euses
within the scope of the Pennsylvania Rules ofClvill'rocedure, The terminatiou of these cascs for
InaClivity WIU previously govemed by Rule of Judicial Adminislration 190 I and local rules promulgated
pursuant to it. New Rule 230,2 Is tailored 10 the needs of civil actions, It provides a complete procldure
and a unifonn statewide plactice, preempting local rules,
This rule WIU promulgated in response to the decision of the Supreme Court in Shop v, Ea~le, 551 Pa,
360,710 A,2d 1104 (1998) in which the court held that "prejudice to the defendant as a result of delay in
prosecution is required before a case may be dismissed pursuant to local rules implementing Rnle of
Judicial Administration 1901."
Rule of Judicial Administration 190 \(b) has been amended to accommodate thc new rule of civil
procedure, The general policy of the prompt disposition of mailers set forth In subdivision (a) of tllat rule
conthlues to be applicable,
II [naetive Cases
The purpose of Rule 230,2 is to eliminate inactive cases from tile Judicial system, The process is
initiated by the court, After giving notice of intent to terminate an action for inactivity, the course of the
procedure is with the parties, If tile parties do not wish to pursue the case, they will take no action and "the
Prothonotary shall enter an order as of course terminating tile mailer with prejudice for failure to
prosecute," lfa party wishes to pursue the matter, he or she will file a notice of inlention to procecd and
the action shall continue,
a, Where the action ha,r been terminareel
If the action is terminated when a party believes Ihat it should not have been tenninated, that parly may
proceed under Rule230(d) for relief from tile order of tcmunation, An example of such lIII occurrence
might be the termination of a viable action when the aggrieved party did not receive the notice of intent to
terminate and thus did not timely me the notice of intention to proceed,
The timing of the filing of the petition to reinstate the action is important. If the petition is med within
thirty days of the entry of the order oftermhlation oJ'llhe docket, subdivision (d)(2) provides that the court
must grant the petition and reinstate the aClion, If the petition is med laler than the thirty-day period,
subdivision (d)(3) requires that the plainliffmust make a show in to the court that the petition was promptly
med and that there is a reasonable explanation or legitimate excuse both for the failure to file the notice of
intention to proceed prior to the entry of the order of temlination on the docket and for the failure to me the
petilion within the thirty-day period under subdivision (d)(2),
8, Where the act'on has not beell/ermina/cd
An action which has not been terminated but which continues upon the filing ofa notice of intention to
proceed may have been the subject of inordinate delay, In such an instance, Ihe aggrieved party may
pursue the remedy of a common law non pros which exits independently of termination under Rule 230,2,
