The Plaintiff, Samuel M. Aiello, is an adult indi- vidual now residing at 998 Old Rt. 15, York Springs, Pennsylvania 17372. 2. The Defendant, William A. Aiello, ia an adult individual whose last known residential addreas was Apt. 106, 700 Nailor Drive, Camp Hill, Cumberland County, Pennsylvania 17043. 3. The Defendant, Sara L. Aiello, is an adult indi- vidual now residing at 204 S. Front Street, Wormleysburg, Cumber- land County, Pennaylvania 17043. 4. On or about January 21, 1992, the Defendants, William A. Aiello and Sara L. Aiello, verbally requested of the Plaintiff, Samuel M. Aiello, that the Plaintiff loan to them the sum of Nine- teen Thousand Five Hundred ($19,500) Dollars to enable the Defendants to improve, renovate, furnish and equip the real estate and improvements owned by the Defendants located at 204 S. Front Street, Wormlcysburg, Cumberland County, Pennsylvania and promised to repay to the I'lainliff said sum, together with interest at the rate of five (5%) percent per annum, upon completion and installation of the improvements, renovations, furnishings and equipment. 5. 'l'he Plaintiff verbally agreed to loan to the Defendants the sum of Nineteen Thousand Five Hundred ($19,500) Dollars upon the Defendants' promise to repay the same on the terms aforesaid and on January 21, 1992, delivered to the Defen- dants Nineteen Thousand Five lIundred ($19,500) Dollars, partially by check and partially in cash, which sunl was accepted by the Defendants upon such repayment terms and appropriated by them on January 21, 1992. 6. The Ninetflen 'l'housand Five Hundred ($19,500) Dollars loaned to the Defendants by the Plaintiff was utilized by the Defendants to purchase and pay t.he costs and expenses of improvements and renovations to the real estate and improvements owned joint ly by the Defendants at 204 S. Front Street, Wormleysburg, Cumberland county, Pennsylvania and to furniflh and equip a portion of the same as a beauty salon and beauty spa business, which business was owned and operated solely by the Defendant, Sara L. Aiello. 7. On or about November 10, 1993, the Defendants verbally of the plaintiff that plaintiff loan to them the sum of Twenty Thousand ($20,000) Dollars to further requested addi tional - 2 - enable thu Defendants to improve, renovate, furnish and equip the real estate and improvements owned by Defendants located at 204 S. Front Street, Wormleysburg, Cumberland County, Pennsylvania and promised to repay to the Plaintiff said additional Bum, together with interest thereon computed at the rate of five (5%) percent per annum upon completion and installation of the improvements, renovations, furnishings and equipment. B. Plaintiff verbally agreed to loan to the Defendants the additional sum of 'rwenty 'l'h':Jusand ($20,000) Dollars upon the Defendants' pr':Jmise to repay the same on the terms aforesaid and on November 10, 1993, delivered to the Defendants the sum of Twenty Thousand ($20,000) Dollars in cash, which sum was accepted by the Defendants upon such repayment terms and appropriated by them on November 10, 1993. 9. The additional sum of Twenty Thousand ($20,000) Dollars was utilized by the Defendants to pay the costs and expenses of improvements and renovations to the real estate and improvements owned jointly by the Defendants at 204 S. Front Street, Wormleys- burg, Cumberland County, Pennsylvania and to furnish and equip a portion of the same as a beauty salon and beauty spa bus iness, which business was owned and operated solely by the Defendant, Sara L. Aiello. 10. On or about February 15, 1994, the improvements and renovations to the real estate and improvements at 204 S. Front Street, wormleysburg, Cumberland Count.y, Pennsylvania were - 3 - completed and the equipping and furnishing of a portion of the same as a beauty salon and beauty spa business, owned and operated solely by the Defendant, Sara L. Aiello, was completed. 11. Since the date of completion, as stated in the pre- ceding paragraph, the Plaintiff has requested that the Defendants, and each of them, repay to him the total sums loaned to the Defendants in the amount of Thirty-Nine Thousand Five Hundred ($39,500) Dollars, together with interest thereon at the rate aforesaid, and the Defendants, and each of them, have refused and continue to refuse to repay the same to the Plaintiff. 12. The Defendant, William A. Aiello, remains the owner, together with Sara L. Aiello, of the real estate and improvement.s located at 204 S. Front Street, Wormleysburg, CumlJerland County, Pennsylvania, improved and renovated with the proceeds of the loans from the Plaintiff. 13. The Defendant, Sara L. Aiello, is the sole owner of the beauty salon and beauty spa business owned and operated by her and located at 204 S. Front Street, Wormleysburg, Cumberland County, Pennsylvania and the furnishings and equipment of said business, which furnishings and equipment were purchased with the proceeds of the loans from the Plaintiff. 14. The Defendants, William A. Aiello and Sara L. Aiello, that the property acquired or improved with the f.unds loaned from the Plaintiff to the Defendants is "marital property" has no rI'levance to the cause of action stated in Plaintiff's Complaint. Whether or not the property is "marital property" is only relevant to a determination of the relative rights of the Defendants, William A. Aiello and Sara L. Aiello, in and to the property. The Plaintiff claims no intere$t in the property and, therefore, a determination of the status of the property as "marital property" has no relevance to a determination of the monetary obligations of the Defendants to the Plaintiff. 5. Plaintiff bf'lieves that thpre has been a divorce action filp.d betwep.n the Defendants in the Court of Common Plp.as of Cumberland County but has no specific knowledge or information sufficient to determine whether such divorce action is presently pending in this Court. 6.
