Husk, h/w, 2902 Glenwood Road camp Hill, pennsylvania Defendants CIVIL ACTION - COMPL~INT IN MORTG~GE FORECLOSURE And now, comes Banc One Conslmer Discount COllJl8ny, by and through its attorneys, Margolis, Edelstein' Scherlis, and files this Complaint in Mortgage Foreclosure as follows: 1. The Plaintiff is Banc One Consuaer Discount COllpllny, which has its principal place of business at Ridge and Butler Pikes, Conshohocken, Pennsylvania. 2. The Defendants are Paul ~. Husk, Sr. and Betty T. Husk, H/W, individuals whose last known address is 2902 Glenwood Roed, Caap Hill, Pennsylvania. 3. On or about october 13, 1992, Def endants executed a Mortgage Note ("Note") in favor of Plaintiff in the original principal amount of $27,010.63. A true and correct copy of said Note is marked Exhibit "A", attached hereto and made a part hereof. 4. On or about october 13, 1.99;1, as security for pay..ent of the aforesaid Note, Defendants made, executed and del i vered to Plaintiff a Mortgage in the original principal amount of $27,010.63 on the premises hereinafter described, said Mortgage being recorded in the Office of the Recorder of Deeds of CUJlberland County on October 19, 1992, J.n Mortgage Book Volume 1094, Page 1052. A true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "B", attached hereto and made a part hereof. 5. Defendants are the record and real owners of the aforesaid mortgaged premises. 6. Defendants are in default under the terms of the aforesaid Mortgage and Note for, inter alia, failure to pay the monthly installmen~s of principal and interest when due. 7. Demand for payment has been made upon the Defendants by plaintiff, but Defendants have failed or refused to pay. 8. On or about May 26, 1995, Defendant was mailed Notices of Homeowner's Emergency Mortgage Assistance Act of 1983, in compli- ance with the Homeowner's Emergency Mortgage Assistance Act, Act 91 of 1983. True and correct copies of said Notices are marked Exhibit "C", attached hereto and made a part hereof. 9. On or about May 26, 1995, Defendant was mailed Notice of Intention of Foreclose Mortgage in compliance with Act 6 of 1974, 41 P.S. S101, et seq. True and correct copies of said Notices are lIarked Exhibit "0", attached hereto and made a part thereof. 10. The amount due and owing Plaintiff by Defendant is as follows: principal Interest through June 28, 1995 Attorneys' fees TOTAL $25,308.98 $1496.04 $800.00 $27,605.02 -2- WHEREFORE, Plaintiff demands jUdgment in mortgage foreclosure for the amount due of $27,605.02, with interest thereon at the rate of $11.25 per diem from June 29, 1995, plus costs (including increases in escrow deficiency) and additional late charges, and for foreclosure and sale of the mortgaged premises.
