Shank struck the rear of Plaintiff'S vehicle as it remained stopped for the red traff 1c light. 7. The foregoing accident and all of the injuries and damage. set forth hereinafter sustained by Plaintiff David R. Mohr are the direct and proximate result of the negligent, careleu, wanton and reckless manner in which Defendant Gwenda L. Shank operated her motor vehicle as follows: (a) failure to have her vehicle under such control as to be able to etop within the assured clear distance ahead; (b) failure to keep alert and maintain a proper watch for the presence of other motor vehicles on the highway; (c) failure to apply her brakes in sufficient time to avoid striking the rear of Plaintiff's vehicle; (d) failure to travel at a safe speed; (e) failure to yield the right-of-way to Plaintiff's vehicle; (f) failure to keep a proper watch for traffic on the highway; (9) failure to drive her vehicle with due regard tor the highway and traffic conditions which were existing and of which she was or should have been aware; (h) failure to keep proper and adequate control over her vehicle; and :3 (i) driving her vehicle upon the highway in a manner endanq~ring persons and property and in a rack less manner with careless disregard to the rights and safety of others and in violation ot the Motor Vehicle Code of the Commonwealth of Pennsylvania. 8. Plaintiff David R. Mohr sustained painful and severe injurie. which include, but are not limited to, cervical and thoracic sprain. 9. Because of the nature of his injuries, Plaintiff David R. Mohr has been advieed and, therefore, avers that he may be forced to incur similar expenses for medical treatment, medication., ho.pitalizations, and similar expenses in the future in an effort to restore him.elf to health, and claim is made therefor. 10. As a result of the aforcamentioned injuries, Plaintiff David R. Mohr has undergone and in the future will undergo great physical and mental suffering, great inconvenience in carrying out hi. daily activitie., lose of life'. pleaBures and enjoyment, and claim is made therefor. 11. As a result of tho aforementioned injurie., Plaintiff David R. Mohr has sustained work lo.s, loss of opportunity and a diminution of his earning power and capacity, and claim is made therefor. 12. This case involves a rear-end motor vehicle collision wherein the front of Dafendant Gwenda L. Shank's vehicle struck the rear of Plain~iff David Mohr's vehicle. 2. Defendant Shank has admitted liability, that is she negligently collided with Plaintiff's vehicle. 3. Plaintiff David Mohr will testify, either on direct examination or cross examination, as to the force of the impact of the collision, 4. It is anticipated that Defendant Gwenda Shank will testify as to the force of the impact of the collision. 5. Plaintiff does not dispute that there was little damage to the vehicles in this collision. 6, It is anticipated that photographs of the Shank vehicle will be used at trial by Defendant to show the nature of the impact. 7. In her Pre-Trial MerT'orandum, Defendant has listed Craig Depken. Ph.D. as a witness, 138738/lRJ 16. To the extent that this Court excludes the Depken report, It should also strike those portions of the Cunningham report that rely on the Depken report. 1 7, Plaintiff has file a Memorandum which further supports his position. WHEREFORE, Plaintiff respectfully requests that this Honorable Court preclUde Dafendant from presenting the testimony of Craig Depken, Ph.D., P.E. and/or making any references to the "Impact Analysis," as well as those portions of Dr. Cunningham's testimony that relies on the Oepken report. A "Sland Up" movement such as this will produce measurable head aceelerations, Tests have been performed to document the "Stand Up" task by having a volunteer test subjecl suddenly stand upright from a rigid kitchen-type chair and recording the accelerations crealed at the subject's head, in a fronHo-rcar direction. The driver of this vehicle is making a claim of injury as a result of this accident. Enqineerinq Impact Analysis: For purposes of carrying out an engineering impact analysis, it is necessary to make use of several specific, vehicle related, characteristics. In the analysis of this collision the primary vehicle information necessary is the weight of the vehicles. a.) The Vehicle * 1 has a weight of 2145 pounds. b.) The Vehicle * 2 has a weight of 2735 pounds. The most direct method of analyzing this collision is to carry out a Impact-Momentum calculation. In order to do this, one (1) additional assumption is necessary. c.) The Vehicle * 2 is assumed to be at r.est at the time of the collision. A collision such as this will occur in a short period of time. This collision will be completed in about 150 milliseconds ( 0.150 sec. ). The result of the collision will be a Change in Momentum of both vehicles. The Vehicle * 1 will be decelerated, as a result of the colliSion, from its speed just prior to the collision. As a result of the collision, the Vehicle * 2 will be accelerated from its speed just prior to the collision. Although each vehicles' Change in Momentum, (d)mV, will be the same, their individual changes in velocity and consequently the accelerations experienced by each vehicle will not be identical. The acceleration (or deceleration) is represented by Accel and has units of measure of feet per second per second (ft/sec/sec). Acceleration can alsQ be represented by the unit of measure of g which refers to the normal acceleration of gravity. One g represents an acceleration of 32.2 ft/sec/sec. The damage to Vehicle * 2 is representative of a force not greater than 1377 pounds. This force is a collision force which may cause notable damage to the body of either vehicle. Therefore, the Change in Momentum for the Vehicle * 2 is the result of a 1377 pound impulse having a duration of 0.150 seconds. This yields a (dlmv for each vehicle of 206 Ib-sec. Using this information it is poss ble to quantify the collision by the calculations: Vehicle * 1: (d)mV (d)V Accel = 206 lb-sec = 3.1 ft/sec = = 36.9 ft/sec/sec 2 . 1 mph = 1.2g Vehicle * 2: (d)mV = 206 lb-sec (d)V = 2.4 ft/sec = 1.7 mph Accel = 16.2 ft/sec/sec = 0.5 9 This analysis indicates that Vehicle * 1 was traveling at 3,8 mph at the time of the collision. Collision Analysis: The impact analyais indicates that, as a result of the collision, the Vehicle * 2 experienced an acceleration of 0.5 g. This is categorically truetf the occupants are securely ".ttached to the vehicle. For this reason, seats are designed with seat backs, headrests and seat belts. For example, the driver of Vehicle 2, sitting firmly in the drivers seat, will have a lower body acceleration no greater than that experienced by the vehicle itself. Therefore, in this collision the seat (and the driver) will experience 0.5 g acceleration in the forward direction. That is, the seat will move the occupant forward with respect to the position of the vehicle just prior to the instant of collision. The extent to which the vehicle occupant is able to move with the vehicle, while the vehicle itself is changing speed, determines the amount of time the occupant's body has to adjust or accelerate to the new speed of the vehicle. As this time is reduced the induced acceleration of the occupant is magnified. If the change in speed of the vehicle is a result of a colliaion, the time for speed change by the vehic le is very short and that of the occupant may even be shorter. It has been found, that in a collision, the upper portion (i.e. head) of a seated vehicle occu~ant may experience a magnified acceleration over that of the vehicle ~tself. Empirical testing indicates that at low collision speeds, typical magnif~cation factors for the head of a seated occupant is about 3.5 I 1. There is no such magnification factor for the supported body of a seated occupant. Therefore, in the current case, when the vehicle is being accelerated by 0.5 g, it may be possible for the occupant to experience 0.5 g to 1.8 g acceleration, in terms of head motion. This level of head acceleration is commonly experienced by individuals in normal life as well as by occupants/passengers of vehicles. Empirical tests have been performed wherein volunteer test subjects have been asked to perform specific common tasks. While the tasks were being performed, acceleration measurements were being made at each te~t subjects head. Specifically, the acceleration was measured in the front to rear direction. Minimal damage was done to either vehicle. The police report was submitted at about 10 p.m., the initial treatment was at 8:30 p.m" 4/10/95, at the Carliste Hospital's ER, The complaints were neck pain and headache. The examination of the neck is described as "supple", and the cervical/thoracic spine was nontender. The neurological examination was negative. X-ray of the cervical spine showed no bony abnormalities. The diagnosis waa acute cervical strain for which ibuprofen was prescribed. He was given a neck injury sheet and instructed to apply heat 15 minutes, q.i,d. He was to return to ER p.r.n. and discharge was at 9:50 p.m. On the following day, 4/11/95, he began treating with his family physician, George Branscum, Jr., M.D. His chief complaint at this time was neck stiffness with tenderness radiating down to the lumbar spine. Mr. Mohr went to work for two hours following the MVA and left early. The physical examination revealed the claimant to be 5 feet 10 inches and 220 pounds. The diagnosis was cervical sprain for which Naprosyn and Norflex were prescribed. He was seen in follow-up on 4/19/95 and was referred at this time to the Alexander Spring Rehab Center in Carlisle for physical therapy beginning 4/21 and continuing to 7/12/95. He had no treatment from 6/12/95 to 7/5/95 because "claimant was on vacation." He was advised at this time to take a temporary leave of absence at his job with the Cumberland County Office of Aging and a part-time job at Outreach, Inc. in Shippensburg. He continued to be seen at weekly intervals with no significant improvement. On 5/17/95, he was referred to Richard Boal, M.D., orthopedic surgeon, of Camp Hill, PA, The exam by Dr. Boal, on 5/19/95, notes tenderness in the cervical and lumbar spine and that Mr. Mohr h~lds his neck in a rigid position. The neurological examination was negative. X-rays of the lumbar spine were normal. In the office notes of Dr. Boal, on this visit, we see three days work time lost (two jobs), following the MVA. The impression was 80ft tissue strain and that it would take a month or two until his symptoms abated. He was seen in follow-up on 5/26 by Dr. Boal, who noted "slow progress." Holly Springs, PA, going three times a week until 1/2/96. The diagnosis was acute, 11'.0derate/severe cervical hyperextension/ flexion injury, acute moderate/severe cervical sprain/strain and paravertebral myofascitis. Treatrr.ent continued until 1/2/96. At the end of this time, her notes indicate "various slow progress and minimal change with corticoid injections and muscle relaxants." He continued care before being released. He was seen again by Dr. Branscum, on 7/12/95, and was released at this time to RTW to his part-time job three nights a week. His care at Alexander Spring was discontinued on this date, also again noting minimal response. He continued to be seen every two weeks by Dr. Branscum. On 9/5195 he in Carlisle, 10/30/95, he the Carliste tumor, which to the MVA. began treating with Theodore Berk, M.D., an enterologist for persistent diarrhea beginning in April 1995. On underwent an esoghagogastroduodenoscopy by Dr. Berk at Hospital. Biopsies revealed a submucosal carcinoid is considered a low grade malignancy, and is not related In the meantime, he also continued treating with Dr. Branscum. On 9/21/95, he was referred to the Carlisle Hospital Pain Control Clinic under Ted Kosenske, M.D. The evaluation by Dr. Kosenske was on 10/4/95. described slight tenderness in the cervicothoracic no trigger points. The neurologic examination cervical spine was normal. The impression was, "his pain is secondary to muscle spasm." He started him on a trial of a TENS unit, and if there was no response, would consider doing posterior division nerve blocks. The patient was working full time at the Department of Aging. He was seen in follow-up on 10/19/95, by Dr. Rosenske, following bilater:al C4 and C6 posterior division nerve blocks and a right-.ide L1 block. He was seen on 10/23 by Dr. Branscum noting temporary benefit from the nerve blocks. He was diagnosed at this time a. having chronic pain syndrome. Another series of nerve block. I 01-0048749 Dr, Branscum on 11/17/95, again diagnosing chronic pain syndrome, slow~resolvinq. In his last office note, 12/8/95, Dr. Branscum indicates the patient has a hard time sleeping "from working both jobs, has more paln, taking Darvocet p.r,n." He was rescheduled for anotner serles of nerve blocks at the pain clinic on 12/22. A "'On 2/17/97, an engineering Impact Analysis was submitted by J. Ronald Sall1ng whlch concluded that the ranqe of possible acceleration experienced by Mr. Mohr in the VW Jetta was less than the range of acceleration experienced by an individual who received an unexaggerated "slap on the back" and would be comparable to someone who sUddenlr stands up from a chair. This level of acceleration is within leve s normally experienced by individuals in daily life. This wouid not result in any physical injury. Addressing the causal relationship, I would point out that this was an extremelr low impact collision resulting in extremely low g forces, as descr bed in the impact analysis, and would not result in any significant physical injury. In the phone interview conducted by Pat Hickey, on 4/18/95, page 2, Mr. Mohr states, "the back bumper had a cre8le and scuff marks and the front grill of the car did pop out. " There was no damage to the front end of the impacting vehicle which may have been rear-ended itself. It is interesting to note that the impacting vehicle sustains a greater colllsion force, in this case 1.2 g, than the car which as been rear-ended (0.5 g). The bottom line in this entire scenario is that the occupant of the impacted vehicle would not, in my opinion, sustain significant force allowing any physical injury. \\ Likewile, during subsequent exams, beginning 4/10/95, the neck, for example, is described as supple and nontendar to palpation. X-rays were negative. This is at most acute cervical strain, a soft tissue condition amenable to spontaneous recovery in the time frame of a few weeks at the very most. '- Commenting on preexisting proble . is oted in tho records that Mr, Mohr has been involved in ~ prior MVAs none of which were his fault. A review of the note of ay J. C , M.D., Rehab Medicine ASloci~tes, Mechanicsbur.g, PA, of h ment of tho claimant from 4/25/85 to 5/29/~0, describes a scenario of treating subjective symptoms wlth minimal objective findings. It is worthwhile noting, that while going to PT at Alexander Spring Rehab four times a week, he was able to miss from 6/12 to 7/5/95 for a vacation trip to Germany. 4 Inlern.tlun.llIealth~are Cunsultants, In~. The only x-rays taken, however, were of the skull and cervical spine, both normal. He was essentially diagnosed on 6/2/84 as having TMJ syndrome on the right. On 7/12/84, he underwent arthroscopic surgery on the right knee. Which was performed by Frank S. Bryan, M.D., orthopedic surgeon of Carlisle, making a diagnosis of post-traumatic injury, right knee, with continued discomfort with non-localizing findings. Review of the OR note reveals the anatomical structure withIn the knee was completely normal. Subsequent to this finding of a normal knee, this claiment underwent extensive physical therapy and multiple operative procedure culminating in a right paralectomy. Despite this, the claimant eventually underwent surgical procedures including a Marquet procedure (osteotomy proximal tibia with elevation of the patella) and finally a paralectomy. Ten years later, on 8/25/94, David M. Joyner, M.D., orthopedic surgeon associated with Dr. Boal at Camp Hill, saw Mr. Mohr. Despite the right paralectomy, Mr. Mohr was still, "having anterior pain in the right knee over the past several months." Are duration, frequency and mOdalities appropriate? Again, not to be repetitious, I would more than likely say that Mr. Mohr did not sustain significant physical injuries in the MVA of 4/10/95. In this context, in my opinion, the initial ER visit of 4/10, the first two or three office visits to Dr. Branscum and the consultation by Dr. Boal, were perhaps reasonable. It would be my o~inion there was no indication for physical therapy at Alexander Spr~ng Rehab. Likewise, there was absolutely no indication for the chiropractic treatment rendered by Dr. Henninger from 6/5/95 to 1/2/96. There would be no indication for the treatments from the Pain Clinic of Carlisle Hospital from 10/4 to 12/4/95. There is certainly no relationship between the MVA and the treatment for diarrhea. The fluoroscopic findings of polyp which was diagnosed as a submucosal carcinoid tumor, which is a low-grade malignancy, was a serendipitous finding. Addressing the question, returned to his pre-MVA not sooner. at what point in time would Mr. Mohr have status, that would have been on 4/13/95, if 5 IMPACT ANALVSIS ror Mllllhew Gover. Esa. Whenever a vehicle is subjected to a level of aeeeleration (or deceleration), the occupants are, likewise, similarly accelerated. This is categorically true if the occupants are securely "attached" to the vehicle, For this reason, seats are designed with seat backs, head rests, and seat belts, For example, the driver of the 1984 Buick Regal, silting finnly in her seat, will have a lower body acceleration no grcater than that experienced by the vehicle itself. Therefore, in this collision, the seat will experience a 0.6 g acceleration forward, That is, the driver will move forward with respect to the position of the vehicle just prior to the instant of collision. The extent to which a vehicle occupant is able to move with the vehicle. while the vehicle itself is ehaJlging speed, detennines the amount of time the occupant's body has to adjust to or accelerate to the new speed of the vehicle, As this time is reduced, the induced acceleration of the oecupant may be magnified, If the change in speed of the vehicle is the result of a collision, the time for speed change by the vehicle is very short and that of the passenger(s) may be even shorter. It has been found that, in a collision, the upper portion (i.e.. head) of a seated vehicle occupant may experience a magnified acceleration greater than that of the vehicle itself, Empirical testing indicates thaI, at low collision speeds, typical magnifieation factors for the head of a seatcd occupant are less than 3.5 : I. As a result, it was possible for the driver of the 1984 Buick Regal, Ms. Kathy Hunter, to have ellperienced an upper body, forward inenial effect within the range of 0.6 g to 2.0 g. This inertial effect would have been resisted by the individual's body structure as well as the seat of the vehicle. FACTS & LIABILITY On April 10, 1995, David Mohr was travelling North on Walnut Bottom Road In Shlppensburg. It was approximately 5:00 p,m., and Mr. Mohr had just left his job at the Cumberlend County Office of Aging on his way to his part-time job at Outreach, Inc. It was daylight and the weatht>r and roadways were dry. Mr. Mohr was stopped at the red light at the K.Mart entrance. At that time, the Defendant, Gwenda Shank, was also travelling on Walnut Bottom Road approaching the red light at the K-Mart. At that time and place,the front of Ms. Shank's vehicle struck Mr. Mohr's vehicle In the rearend. liability Is clear. The police report is attached as Exhibit "A." II. DAMAQE~ A. Medical 1. Carlisle Hosoital Emeroencv Room At the scene of the accident, Mr. Mohr felt pain in his neck and felt dizzy. Later In the evening of the accident, Mr. Mohr's pain increased and he felt stiffness throughout his neck and mid-back. Mr. Mohr presented to the Carlisle Hospital Emergency Room. 128801/LRJ There an x-ray was taken as well as e physical examination. Mr. Mohr was diagnosed with acute cervical strain as a result of the motor vehicle accldant. He was prescribed pain medication and told to see his family physician, The Carlisle Hospital Emergency Room records ere ettached as Exhibit "B." 2. Georae p, Branscum. Jr.. M,O, On April 11, 1995, the day after the accident, Mr. Mohr presented to his family physician, Dr. Branscum. Allached as Exhibit "C" are the May 26, 1997 and February 22, 1996 reports of Dr. Branscum. Dr. Branscum diagnosed Mr. Mohr as having a cervical sprain and chronic pain syndrome as a result of the April 10, 1995 accident, Dr. Branscum notes that Mr. Mohr's present condition is directly related to the accident. Dr. Branscum treated Mr. Mohr for this aceldent from April 11, 1995 to April 29, 1997, and those records are attached as Exhibit "D." 3. Alexander Sorlna Rehabilitation Between April 21, 1995 and July 12, 1995, Mr. Mohr participated In physical therapy at Alexander Spring Rehab, Inc. Mr. Mohr's physical therapy records are attached as Exhibit "E." Physieal Therapist, Marsha Diller reports that while Mr. Mohr's flexibility and mobility Improved, his pain continued In his neck and back. 4. Orthooedlc Institute of PA Mr. Mohr treated with Dr. Boal of the Orthopedic Institute of Pennsyll/ania In May and June of 1995. (~, records atteched as Exhibit "F.") Pt. reports he Itopped at a red light" waa rear ended. He said his head flew forward" then backwards, Since then he haa been extremely dizzy, He was wearing a aeat belt during the accident. Two hra. after the incident he started to get a headache " tension in the back" was unable to drive" had to have a family member do so, lie thon went to the hospital, had x-rays taken ~hich revealed only mild cervical scoliosis right near the lordotic curvature of the spine that may have caused the mu~cl. spasms. Pt. is having constant pain that varies in intensity in the cervical neck, the suboccipital muscles, increased pain around the C4-'Tl area, pain radiating down to the TS-Ll area. He is reporting pain is extremely painful with sitting. He is unable to ait for any length or period of time. He can not drive because he can not turn his head without significant pain. Walking for greater than 5 min, increases pain. He is unable to put ~il shoes on. Heat temporarily relieves his pain, He reports he can sleep for maybe 15-20 min. " then he is up for the rest of the night. He gets up 4-5 times a night" tosses" turns. Pt. reporta that riaing in the morning he is worse, Pt, reports he feels worse in the A.H. than later in tha day. He is voicing a 5-6/10 pain scale. Mr. Mohr is a 30-year-old gentleman generally in good health who was invelved in an automobile accident en April 10, 1995. He was riding in his Volkswagen Jetta when he was hit from the rear while he was stopped, He states the back bumper of his car was dented and the grill, which was a pop in-pop eut- type grill, was popped and had te be reset. He had his seatbelt en. He states he had ne pain initially but within a c01Jple of hours developed a headache. He was seen at Carlisle Hospital. A few days later he developed some low back pain and he has had this since the time ef the injury. He underwent physical therapy at Carlisle. He was going te physical therapy fer abeut one menth and it has been helping him, He takes Vel taren, Serna and Elavil as his medications, . . J have examined this gentleman teday and he does have seme tenderness te beth the right and left of the midline in the cervical spine area. He also has seme tenderness in his lumbar area. He helds his neck in somewhat of a rigid pesition and deesn't like te turn it well te the left and right. . He has ne increased pain with vertex compression. He is entirely intact neurologically in both the upper and lower extremities. New x-rays were taken of his lumbar spine and they are essentially within nermal limits. J think this gentleman did just suffer a soft tissue strain. J have teld him that it ceuld take another month lOr two unti 1 his symptoms abate. He is to continue with the therapy, MOHR. He is geing to therapy four times a week at Alexander Spring Rehab and this is helping, He does not take any medicine at the present time. He is geing te Germany in about two and half weeks and I want te see him just before he goes to see how he is getting aleng. He may need medicine when he gees and we certainly can give him this.
