COMPLAINT
AND NOW, comes Rothman, Schubert and Reed Realtors, a
Pennsylvania Partnership, by and through its attorneys, the Law
Offices of Darrell C. Dethlefs, and in support of their complaint
avers as follows:
1.
The Plaintiff, Rothman,
Schubert and Reed, is a
Pennsylvania Partnership, fully licensed to conduct business as a
real estate broker in the Commonwealth of Pennsylvania, with
business offices located at Suite 102, 355 North 21st Street,
CUmberland County, Camp Hill, Pennsylvania.
2. The Defendant, Virginia Halbert, is an adult individual
residing at 74 Hill Manor Drive, Hershey, Dauphin County,
Pennsylvania.
3. The Defendant, Classic Communities Corporation, is a
Pennsylvania Corporation dully registered to do business in the
Commonwealth of Pennsylvania, with a business addresu of 103 Parm-
Stead Circle, Lebanon, Lebanon County, Pennsylvania.
4. The Defendants, Virginia Halbert and Classic Communities
Corporation at all times relative to this matter were the fee-
simple owners of the premises known and described as Lot 98,
Peninsula, Silver Springs Township, CUmberland County,
Mechanicsburg, Pennsylvania also known as 19 Gunpowder Road, herein
after referred to as "The property".
5. On or about January 18, 1995, Defendants employed
Plainti.ff pursuant to a written exclusive listing contract, to
procure a purchaser for the above described property, A copy of
said exclusive listing contract is attached hereto and made apart
hereof and is marked as Exhibit "A".
6. The terms the contract gave Plaintiff an exclusive
listing agency with respect to the property commencing on January
20, 1995 and terminating on July 20, 1995.
7. By the terms of the contract Defendants gave Plaintiff an
exclusive agency commencing on January 20, 1995 and terminating on
July 20, 1995. and agreed to pay Plaintiff 5' of the sale price if
the property wae sold, or a purchaser secured by Plaintiff or by
any other person during the term of the exclusive agency.
8. Prior to the expiration of the exclusive listing
contract, Defendant's entered into an agreement to sell the
Property to Roy and Peggy Hilliard who subsequently purchased the
property for $320,000.00.
9. Defendant believes and therefore avers that the
negotiations, dealings and actual consummation of the sale of the
property took place during the time when the exclusive listing
contract was still in full force and effect.
10. The 5\ commission agreed upon by the Plaintiff and
Defendant was usual and customary real estate broker commission for
the sale of residential property in the Mechanicsburg area at all
times mentioned herein.
11. The Defendants despite several demands have failed to pay
Plaintiff in accordance with the aforementioned exclusive listing
agreement.
12. The actions of Defendants as aforesaid are willful and
constitute a material breach of the agreement entered into between
Plaintiff and Defendant,
13. As a direct and proximate result of the actions of the
Defendant as aforesaid, Plaintiff has suffered and continues to
suffer serious damage, including but not limited to loss of the
monies owed to it by the Defendant, loss of use of said monies,
lost interest on the monies and other such damages as may be
discovered.
14. by reason of the foregoing Defendant owes Plaintiff the
sum of $16,000.00 which Plaintiff has demanded from Defendant and
which Defendant has refused and still refuses to pay.
