COMPLAINT
AND NOW comes the Plaintiff, by its attorney, Michaal L. Bangs, Esquire,
and files the following Complaint:
1. Plaintiff Hompt Bros., Inc., is a Pennsylvania corporation with its principal
place of business at 205 Creek Road, Camp Hill, Cumberland County, Pennsylvania.
2. Defendant Du Brook Concrete, Inc., is a Pennsylvania corporation with its
principal place of business at 30 Hoover Avenue, Du Bois, Clearfield County,
Pennsylvania.
3. Plaintiff is in the business of, among other things, providing material for
the construction of highways. said material including crushed stone, sand, slag,
transit mix concrete, and other asphalt material.
4. Defendant contacted Plaintiff and requested that Plaintiff set up a credit
account for Defendant to supply Defendant with certain material for various jobs
Defendant was working on in the Central Pennsylvania area.

5. Plaintiff agreed to set up a credit account with Defendant provided that
all invoices were paid within thirty (30) day of receipt.
6. Defendant agreed to pay Plaintiff for the materials provided to Defendant
in accordance with its normal credit account. that being payment of the
outstanding Invoices within thirty (30) days of receipt.
7. Defendant began ordering material from Plaintiff in March of 1995. and
continued to order material through August of 1995. Attached hereto and marked
as Exhibit A Is a true and correct copy of 0 statement identifying the separate
invoices for material provided to Defendant by Plaintiff.
8. Defendant received all material ordered from Plaintiff and referenced on
the invoices sent by Plaintiff to Defendant. said invoices being identified in Exhibit
A which is attached hereto and made a part hereof.
9. Defendant has failed or refused to pay Plaintiff for any of the material
received and identified in the outstanding invoices in accordance with the terms and
conditions of the credit account opened with Plaintiff.
10. Defendant has breached the agreement with Plaintiff by its failure to pay
for the material received pursuant to the terms and conditions of the credit account.
11. Plaintiff is entitled to receive interest at ths rate of one and one-quarter
(1 1/4%1 percent per month for any outstanding invoices due over thirty (30) days.
