DIAMOND Defendant CIVIL ACTION. LAW COMPLAINT ANn NOW, comes the Plaintiff, York Federal Savings and Loan Association, by and through Its Attorney, Benjamin F. Riggs. Jr., and Complains of Defendant GEORGE S. DIAMOND as follows: Parties 1. The Plaintiff is York Federal Savings and Loan Association, a corporation organized and existing under the laws of the United States of America, with offices for the purpose of doing business at 101 South George Street, York, Pennsylvania 17401. 2. The Defendant George S, Diamond, is an adult Individual residing at 1442 Trlndle Road, Carlisle, Cumberland County, Pennsylvania 17043. ~ 3. On April 8, 1988, Defendant made, executed and delivered a Note to York Federal Savings and Loan Association, a copy of which is attached as Exhibit "A". The loan was also secured by a Mortgage of the same date, granting Plaintiff a security interest in property known as 124 South Second Street. Wormleysburg, Cumberland County, Pennsylvania 17043. Assignments 4. Said Note has not been assigned. Default 5. Said Note is In default because Defendant has failed to make the monthly payments of principal and Interest due and owing on his loan from February 1, 1995 through the date of filing this Complaint as required by the terms of the Note. Any payments that may have been made during this period were applied to the delinquency balance due and owing prior to February 1, 1995. 6. The Defendant, after demand, has not exercised the right to cure said default and Plaintiff therefore exercises Its option to declare the entire amount owing upon said Note Immediately due and payable in accordance with its terms and provisions. 7. Notice of Intention to Foreclose and Rights Under Pennsylvania's Loan Interest and Protection Law, Act of January 30, 1974, P.L. 13, No.6 (41 P.S. ~ 101 m eg.), as amended, was sent in accordance with said Act to Defendant George S. Diamond on April 7, 1995. A true and correct copy of said Notice is attached hereto, made a part hereof, incorporated herein by reference, and marked "EXHIBIT B". Inapplicability of Homeowners' Emergency Assistance Act 9. This Action is not subject to the provisions of Pennsylvania's Homeowners' Emergency Asistance Act, Act of December 23,1983, P.L. 385, No. 91 (35 P.S. S 1680.401c m &mi.), as amended, nor is notice required to be sent to Defendant pursuant to said Act, because, said Mortgaged Premises Is not the principal residence of Defendant. WHEREFORE, Plaintiff York Federal Savings and Loan Association prays for Judgment In Its favor and against the Defendant Georgo S. Diamond In the amount of Forty-Nine Thousand Four Hundred Seventy-Four and 52/100 ($49.474.52) Dollars, with Interest thereon until paid at such rate or rates as established by Plaintiff pursuant to the terms of the Adjustable Rate Note, currently $10.4928 per diem, from August 8, 1995, late charges at 5% of the monthly payment amount, currently $16.99 per month, from August 8, 1995, escrow charges, currently $94.14 per month, from August 8. 1995, attorney's fees, costlS of suit, and other charges collectible under the Note; and for any and all other rallef as the Court deems appropriate.
