POWER OF ATTORNEY
AND
CONTINGENT FEE AGREEMENT
KNOW ALL MEN BY THESE PRESENTS, That we, Robert and
Connie Limric, do hereby retain Friedman & Friedman, P.c., of
Harrisburg, Pennsylvania, as our attorneys to negotiate for an
adjustment, or to institute for us and in our names any legal
actions or proceedings that in their judgment are necessary, in
connection with our claim for damages as a result of a contractor
agreement with David Floyd.
NOW THEREFORE, in consideration of the services so to
be rendered by our said attorneys, Friedman & Friedman, P.C., we
hereby covenant, promise and agree to pay to our said attorneys
for their professional services rendered, thirty-three and one-
third percent (33 1/3%) of whatever sum is recovered, whether
from the party responsible for our damages, his or her insurance
carrier, or any other third party carrier, if the case settles or
forty percent (40%) if it is necessary to institute legal
proceedings.
We further agree to be responsible for all costs
advanced by Friedman and Friedman, P.C. on our behalf. These
fees will be payable by us at the time of settlement of our case
or at such time as it becomes necessary to institute legal
proceedings. We will also be responsible for costs of proceeding
in court if applicable, such costs to include filing fees and
costs of service by Sheriff or private process server. In the
event no recovery is made, or in the event we substitute
attorneys prior to completion of the accident case, we agree to
pay for all costs upon presentment of a bill.
This Contingent Fee Agreement and Power of Attorney
has been read, approved and understood by us and the receipt of a
copy thereof acknowledged. The terms set forth are agreeable.

COMPLAINT
AND NOW comes the Plaintiffs, Robert and Connie Limric,
by and through their attorneys, Friedman & Friedman, P.C" and
bring this cause of action against the Defendant, and aver as
follows:
1, The Plaintiffs, Robert and Connie Limric, are
adult individuals, and husband and wife, residing at 23 E. Beale
Ave" Enola, Cumberland County, Pennsylvania 17025.
2. The Defendant, David Floyd, is an adult
individual, doing business as Ultimate Outcome, with a place of
business located at 211-C Enola st., Enola, Cumberland County,
Pennsylvania 17025.
3, On March 24, 1995, the Plaintiffs and Defendant
entered into a certain written agreement for the construction of
a garage at the Plaintiffs' residence, in exchange for payment in
the amount of $11,300.00. A true and correct copy of the
Agreement is attached hereto, marked Exhibit "A", and
incorporated herein by reference.
4, The above-referenced written agreement between the
parties required an initial payment by the Plaintiffs to the
Defendant in the amount of $3,100.00, which was made on or about
March 24, 1995.
5. On or about March 27, 1995, the Defendant
commenced laying cinderblock walls of the above-referenced
garage.
6, On or about March 31, 1995, the Defendant had
completed the laying of cinderblock approximately four (4) feet
high on three walls.
7. Defendant has performed in a poor, improper, and
unworkmanlike manner certain things which were expressly, or by
necessary implication, required by the agreement to be done and
performed in a proper and workmanlike manner, as follows:
a, The cinderblock walls were laid with an
obvious and considerable bow, which rendered
said walls unable to support the structure
which had been contracted for.
b. The Defendant failed to properly fill in the
mortar joints of the cinderblock
construction, thereby rendering the walls
unable to support the structure which had
been contracted for.
8. The Defendant purchased windows which were to be
utilized in the construction of the agreed-to structure for the
amount of $1,190.50, and said windows were delivered to the
Plaintiffs.
9. As a result of the poor and unworkmanlike manner
of the Defendant's work, the Plaintiffs were required to enter
into a new written contract for the erection of the garage in
question with W, E, Brougher Construction Company, said contract
being in the amount of $12,250.00. A true and correct copy of
the contract is attached hereto, marked Exhibit "B", and
incorporated herein by reference.
10, As a result of the poor and unworkmanlike manner
of the Defendant's work, the Plaintiffs were required to tear
down the entire cinderblock construction which had been laid by
the Defendant,
11, The Plaintiffs have fulfilled all the provisions
of the agreement on their part to be performed,
12. The Defendant has not fulfilled the provisions of
the agreement on his part to be performed.
13. The Defendant has violated the Unfair Trade
Practices and Consumer Protection Law, 73 P.S. S 201-1 et seq.,
by making repairs, improvements or replacements on tangible, real
or personal property, of a nature or quality inferior to or below
the standard of that agreed to in writing.
14, The reasonable cost of remedying the aforesaid
breaches on the part of the Defendant is $2,859.50, which costs
consist of $950.00 required to be paid by the Plaintiffs (under
the construction agreement with W, E. Brougher Construction
Company) in excess of the construction agreement with the
Defendant, and $1,909.50, being payment made to the Defendant in
excess of the cost of the windows which have been received by the
plaintiffs,

We, Robert Limric and Connie Limric, hereby acknowledge
that we are the Plaintiffs in the foregoing action; that we have
read the foregoing Complaint; and the facts stated therein are
true and correct to the best of our knowledge, information and
belief,

POWER OF ATTORNEY

CONTINGENT FEE AGREEMENT
KNOW ALL MEN BY THESE PRESENTS, That we, Robert and
Connie Limric, do hereby retain Friedman & Friedman, P.C., of
Harrisburg, Pennsylvania, as our attorneys to negotiate for an
adjustment, or to institute for us and in our names any legal
actions or proceedings that in their judgment are necessary, in
connection with our claim for damages as a result of a contractor
agreement with David Floyd.
NOW THEREFORE, in consideration of the services so to
be rendered by our said attorneys, Friedman & Friedman, P.C., we
hereby covenant, promise and agree to pay to our said attorneys
for their professional services rendered, thirty-three and one-
third percent (33 1/3') of whatever sum is recovered, whether
from the party responsible for our damages, his or her insurance
carrier, or any other third party carrier, if the case settles or
forty percent (40') if it is necessary to institute legal
proceedings.
We further agree to be responsible for all costs
advanced by Friedman and Friedman, P.C. on our behalf. These
fees will be payable by us at the time of settlement of our case
or at such time as it becomes necessary to institute legal
proceedings. We will also be responsible for costs of proceeding
in court if applicable, such costs to include filing fees and
costs of service by Sheriff or private process server. In the
event no recovery is made, or in the event we substitute
attorneys prior to completion of the accident case, we agree to
pay for all costs upon presentment of a bill.
This Contingent Fee Agreement and Power of Attorney
has been read, approved and understood by us and the receipt of a
copy thereof acknowledged. The terms set forth are agreeable.
