THE MASTER: Today is Wednesday, February 26,
1997. This is the date set for a Master's hearing in the above
captioned divorce proceedings. Present in the hearing room are
the Plaintiff, Theodore A. Rusenko, and his counsel Lori K.
Serratelli, and the Defendant, Kelley L. Rusenko, and her
counsel John J. Connelly, Jr.
A divorce complaint was filed on August 16, 1995,
raising grounds for divorce of irretrievable breakdown of the
marriage. Counsel have indicated that they are going to
conclude the divorce under section 3301(c) of the Domestic
Relations Code with the filing of mutual affidavits of consent.
The Plaintiff has presented an affidavit and a waiver of notice
.
of intention to request entry of divorce decree which will be
filed with the Prothonotary this date. Mr. Connelly has
indicated that he will have an affidavit and waiver filed within
a week of today's date.
The divorce complaint also raised the economic
claim of equitable distribution. No claims have been raised for
alimony or counsel fees and expenses by either party.
The parties were married on November 5, 1988, and

separated on March 14, 1995. They are the natural parents of
one child, James Joseph T. Rusenko, born October 27, 1992.
Physical and legal custody of the child is shared between the
parties.
After negotiations this morning the Master has been
advised that the parties have reached an agreement with respect
to the claim of equitable distribution. The agreement is going
to be placed on the record in the presence of the parties by
counsel. The agreement as placed on the record will be
considered the substantive agreement of the parties and will not
be subject to any changes or modifications except for correction
of typographical errors which may be made during the
transcription. The Master is going to have a draft of the
agreement prepared and sent to counsel for review for
typographical errors, after which the parties and counsel will
affix their signatures. I specifically note, however, that the
signatures are not required to make the agreement binding on the

parties as it is entered on the record today. The "only
modification or changes that can be made to the agreement would
be to correct typographical errors; no substantive changes will
be permitted.
After the agreement has been affirmed by the
signatures of the parties and counsel and returned to the
Master, the Master will prepare an order vacating his
appointment and counsel will then be in a position to prepare a

praecipe transmitting the record to the Court requesting that
the Court enter a final decree in divorce. Mr. Connelly.
MR. CONNELLY: The parties have reached the
following agreement regarding the distribution of property:
1. The marital residence located at 405 Alison Avenue,
Mechanicsburg, Pennsylvania, shall become the sole and
separate property of the Plaintiff subject to the
following terms and conditions:
Upon presentation of the deed to the marital residence
the Defendant Kelley L. Rusenko will sign the deed which
shall be held in escrow by Lori K. Serratelli, attorney
for the Plaintiff, until such time as husband has
released wife's name from the existing mortgage. In the
meantime, husband shall indemnify and hold wife harmless
on that mortgage obligation.
Husband shall within 90 days of today's date complete the
removal of wife's name from the mortgage thereby
relieving her from any further obligation thereunder.
In the event husband intends to sell the marital
residence in the future, he will offer the property first
to wife at a price to be determined by husband. In the
event she fails to exercise the option at that time, he
shall offer to her a right of first refusal to purchase
the house thereby matching any offer husband receives on
the residence. Wife's right to match that offer must be
exercised within 5 days of the presentation of the-offer
by husband. -
2. In the form of equitable distribution, husband shall pay
to wife the sum of $16,000.00. This payment shall be
made to wife within 60 days of husband's completion of
the removal of wife's name from the aforementioned
mortgage as referred to in Paragraph 1 hereof.
3. The 1991 Honda EX shall become the sole and separate
property of wife and husband agrees to execute the title
to said vehicle transferring it into wife's name
individually.
4. Husband shall retain as hin sole and separate property
the 1978 Chevrolet Blazer which is presently titled

in his name individually.
5. Wife shall retain as her sole and separate property
her interest in the Dauphin County Retirement System.
6. Husband shall retain as his sole and separate property
his pension through Harsco Corporation as well as his
Harsco savings plan.
7. Husband shall retain as his sole and separate property
the 1986 Honda motorcycle titled in husband's name
individually.
8. Within 10 days of husband's tender of payment of the
$16,000.00 toward completion of the equitable
distribution, wife shall pay to husband's parents the sum
of $2,500.00 representing wife's portion of a repayment
of a loan to husband's parents. After wife's payment of
the $2,500.00 amount to husband's parents, husband shall
be responsible for the balance due on said debt.
9. Each party shall retain as their sole and separate
property all assets in the possession of that party with
the exception of the following items which shall be
removed by wife from the marital residence within 30 days
of today's date:
a) Silver set to include candelabra, ice bucket,
serving platter, trays and casserole
b) Corner cupboard
c) Antique toaster, wok, crock set and cast iron
figurines .
d) The parties' son's rocker and toy box
e) Electrolux vacuum cleaner
f) Christmas ornaments
g) Bedroom rugs
h) Hall mirror
i) Crib
Any items of personal property not specifically
identified in either parties' inventory or on the list

set forth herein shall be divided by the parties to
their mutual satisfaction. In the event of a dispute as
to the division of these personal items, either party
reserves the right to petition the court to have these
items distributed after hearing on the issue.
10. The parties are joint owners of a savings account for
their son James presently invested at Belco Federal
Credit Union. Husband shall remove the amount invested
for James in that account and place it in another
investment vehicle of his choice under the condition
that the account be placed in the joint names of the
parties (husband and wife) requiring both signatures to
have any funds removed from that account. Husband shall
provide wife with a quarterly statement of the status of
said account. At the parties' election, the account can
be transferred in either parties' name individually
and/or liquidated. Any interest on said account is
being reported under James' social security number for
income tax purposes.
11. The only joint debt of the parties is the first mortgage
referred to previously. Any other debts existing at the
present are the individual responsibility of the party
who holds the debt and who incurred the debt.
12. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each
party hereby waives and relinquishes any.and all rights
he or she may now have or hereafter acquire under the
present or future laws of any jurisdiction to share in
the property or the estate of the other as a result of
the marital relationship including without limitation,
statutory allowance, widow's allowance, right of .
intestacy, right to take against the will o~ the other,
and right to act as administrator or executor in the
other's estate. Each will at the request of the other
execute, acknowledge, and deliver any and all instruments
which may be necessary or advisable to carry into effect
this mutual waiver and relinquishment of all such
interests, rights, and claims.
13. The parties further agree to execute any and all
documents necessary to implement the terms of this
agreement in a timely fashion.
14. Based on the existing custodial arrangements (shared
legal and physical custody) the parties shall alternate
the federal income tax exemption for their minor child

James and shall execute the documents necessary to
implement this alternating schedule from year to year no
later than February 1st in each year in which a
return is due. Husband shall have a right to claim
James for the 1996 tax year.
HR. CONNELLY: Kelley, you've heard me dictate on
the record the terms and conditions of this agreement, have you
not?
MS. RUSENKO: Yes, I have.
HR. CONNELLY: Do you fully understand them as
dictated?
MS. RUSENKO: Yes, I do.
HR. CONNELLY: Is there any issue that we have not
addressed in dictating the terms and conditions that you are
aware of?
MS. RUSENKO: No.
HR. CONNELLY: Do you understand that you are bound
by this agreement regardless of anything that occurs subsequent

to today?
MS. RUSENKO: Yes, I do.
MR. CONNELLY: This is an agreement which is
binding as of now and the only changes that can be made are
typographical errors in the final document?
MS. RUSENKO: I understand.
MS. SERRATELLI: Ted, you have heard Mr. Connelly
dictate all of the terms that we have arrived at this morning?

MS. SERRATELLI: Do you fully understand those
terms and agree to those terms?
MR. RUSENKO: Yes.
MS. SERRATELLI: Is there anything else you wish to
add?
MR. RUSENKO: No.
MS. SERRATELLI: Do you agree and understand that
you are, from this time forward, bound by these terms?
MR. RUSENKO: Yes.
MS. SERRATELLI: And there will be no modification
with the exception of a written agreement by the two of you
modifying -- that would be the only ability to modify the terms?
MR. RUSENKO: Yes.

THE MASTER: Counsel, after discussion with the
parties, are going to add an addendum to the aforementioned

agreement with respect to the refinancing of the mortgage.
MR. CONNELLY: The Master's jurisdiction of this
matter shall be preserved until the completion of husband's
removal of wife's name from the aforementioned mortgage. In the
event husband fails to remove wife's name after a bona fide
effort to do so, either party reserves the right to return this
matter to the Master for adjudication on the equitable
distribution issues.

COMPLAINT IN DIVORCE
UNDER SECTIONS 3301(c) AND 3301(d) OF THE DIVORCE CODE
AND NOW COMES the above-named plaintiff, by Lori K.
Serratelli, Esquire and the law firm of SERRATELLI, SCHIFFMAN,
BROWN' CALHOON, P.C., and seeks to obtain a Decree in Divorce
from the above-named Defendant, upon the grounds hereinafter more
fully set forth:
COUNT I
1. Plaintiff is Theodore A. Rusenko, who currently r6sides
at 405 Alison Avenue, Mechanicsburg, Cumberland county,
Pennsylvania since 1993.
2. Defendant is Kelley L. Rusenko, who currently resides at
122 East Coover street, Apt. B, Mechanicsburg, Cumberland County,
Pennsylvania since March 1995.
3. Plaintiff has been a bona fide resident in the
Commonwealth for at least six months immediately previous to the
filing of this complaint.
4. The Plaintiff and Defendant were married on November 5,
1988, in Dauphin County, Pennsylvania.
5. The Plaintiff has been advised of the availability of
counseling and that he may have the right to request that the
Court require the parties to participate in counseling.
6. There have been no prior actions of divorce or for
annulment between the parties.
7. The marriage is irretrievably broken.
8. The Defendant is not a member of the Armed Services of
the United states or any of its allies.
9. The Plaintiff and Defendant are both citizens of the
United states.
10. Plaintiff avers that there is one child of the parties
under the age of 18, namely James J. T. R~senko.
WHEREFORE, the Plaintiff prays your Honorable Court to enter
a Decree in Divorce from the bonds of matrimony.
COUNT II
11. Paragraphs one through ten are hereby incorporated by
reference herein.
12. Plaintiff believes that the best interest of the
parties' child, James J.T. Rusenko, will best be served by
confirming shared legal and shared physical custody of the child
with the parties.
13. The child presently resides with the Defendant at 122
East Coover street, Mechanicsburg, Pennsylvania.
WHEREFORE, Plaintiff respectfully requests that shared
physical and shared legal custody of the child be confirmed with
the parties.
COUNT III
14. Paragraphs one through ten are hereby incorporated by
reference herein.
15. plaintiff states that Plaintiff and Defendant possess
various items of both real and personal marital property which is
subject to equitable distribution by the court.
16. Plaintiff requests that this court grant equitable
distribution.
WHEREFORE, Plaintiff prays that Your Honorable Court:
(a) Equitably distribute all property, personal and
real owned by the parties;
(b) Grant such further relief as the Court may deem
equitable and just.

(1) A Complaint in Divorce under Section 3301(c)
of the Divorce Code was filed on August 16, 1995.

broken and ninety (90) days have elapsed from the date of
filing the Complaint.
(3) I consent to the entry of a final decree of divorce, without
formal notice of the intention to request entry of a divorce
decree.
(4) I understand that I may lose rights concerning alimony,
division of property, lawyer's fees or expenses, if I do not
claim them before a divorce is granted.
(5) I understand that I will not be divorced until a divorce

By order of Court of President Judge Harold E. Sheely
dated July 23, 1996, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on August 16, 1995, raising
grounds for divorce of irretrievable breakdown of the marriage
and the economic claim of equitable distribution.
The motion for appointment of Master indicates that Mr.
Connelly has appeared on behalf of the Defendant; however, I
have nothing in my file to indicate Mr. Connelly's appearance or
representation on behalf of Kelley L. Rusenko. Therefore, I
request that Mr. Connelly enter his appearance in the action if
he is in fact representing the Defendant.
I am unable to determine from the pleadings if the
parties are agreeable to a divorce and will file affidavits of
consent or in the alternative have been separated for a period
of at least two years; however, I am going to proceed on the
basis that grounds for divorce are not at issue. Therefore, in
accordance with P.R.C.P. 1920.33(b) I am directing each counsel
to file a pre-trial statement on or before Friday, August 16,

DATE: Wednesday, October 30, 1996
Present for the Plaintiff, Theodore A. Rusenko, was
attorney Lori K. Serratelli, and present for the Defendant,
Kelley L. Rusenko, was attorney John J. Connelly, Jr.
A divorce complaint was filed on August 16, 1995,
raising grounds for divorce of irretrievable breakdown of the
marriage. Counsel have advised that the parties will sign and
file affidavits of consent prior to the hearing to be held so
that the divorce can be concluded under Section 3301(c) of the
Domestic Relations Code.
The divorce complaint also raised the economic
claim of equitable distribution. No other economic claims have
been raised in the action.
The parties were married on November 5, 1988, and
separated on March 14, 1995. They are the natural parents of
one child, James J. T. Rusenko, born October 27, 1992. The
parties share legal and physical custody of the child.
Husband is 33 years of age and resides in the
marital residence at 405 Alison Avenue, Mechanicsburg,
Pennsylvania. Wife alleges that he lives with a female friend
at that address. Husband has a Bachelor's degree and is an
analyst with Harsco Corporation. He has a bimonthly net income
of $1,193.00 plus an annual bonus. Husband has not raised any
health issues.
Wife is 33 years of age and resides at 122 East
Coover Street, Apartment B, Mechanicsburg, Pennsylvania, where
she lives alone. She has a Master's degree from Shippensburg
University in Criminal Justice. She works for Dauphin County as
a court services liaison. Her net biweekly income is $858.52.
Wife has not raised any health issues.
Neither party is receiving or paying child or
spousal support.

The marital real estate at 405 Alison Avenue,
Mechanicsburg, Pennsylvania, has been appraised and the parties
will stipulate that the market value of the property is
$116,000.00. The property is subject to a mortgage in favor of
Capstead, Inc. with an approximate payoff of $101,000.00. The
parties and counsel will provide an updated payoff statement at
the time of the hearing. Counsel have indicated that each of
the parties would like to have the house awarded to him or her.
In the event that the house is awarded to either of the parties,
there is a question as to whether or not the party receiving the
house should be required to refinance the mortgage. Counsel
have indicated that their positions will be that the house
should be refinanced and they will present testimony in support
of that position.
At the time the house was purchased husband's
father provided $7,000.00 toward the down payment although there
is some question about whether or not that money was lent to the
parties or was a gift. The parties have paid back $1,000.00 but
wife claims that the only reason the money was paid back was
because the parties felt obligated to make payment on account of
the contribution by husband's father, not as an acknowledgment
of the status of the money as a debt. Counsel for wife has
requested that the attorney for husband inquire of the mortgagee
as to whether or not there was a "gift letter" indicating that
the money that was provided by husband's father was
characterized to the mortgagee as a gift.
There are two vehicles involved in this case, a
1991 Honda EX which husband says has a value of $9,600.00 and
wife says has a value of $9,100.00. The other vehicle is a
1978 Chevrolet Blazer and husband has placed a value on that
vehicle of $1,000.00 while wife has placed a value on the
vehicle at $1,500.00. Counsel may be able to stipulate as to
the values of the vehicles or in the alternative will have them
appraised.
Wife is vested in a retirement plan with Dauphin
county and counsel have provided a value of $19,884.00 as of the
date of separation. That number will have to be updated with
any accrued interest on the marital portion to the date of the
hearing.
Husband is a participant in a Harsco retirement
plan and the Harsco savings plan. The Harsco retirement plan
will have to be valued. The Harsco savings plan as of December
1994 had a value of $27,466.54. Counsel can provide some
computation showing any contributions from December 1994 to the
date of separation by husband and/or the employer with any
accrued interest to that date to update the value of that plan.
Husband has retained most of the household tangible
personal property with a few items going to wife. If counsel
cannot agree to the value of that property then the property
will have to be appraised.
At the time of separation husband had an account
with Mellon Bank and has reported a value of that account at
$2,901.52. Wife's counsel has pointed out that according to
his calculations the account may have a value of $3,100.00.
Counsel can attempt to reconcile the value of that account.
Husband gave wife an engagement ring prior to the
marriage and removed it from wife's possession around the time
of separation. Wife indicates that she would like to have the
engagement ring returned to her and husband's counsel is going
to inquire of husband as to whether or not he is willing to give
up possession of the ring.
The only debt of the parties that is specifically
acknowledged as a debt is the Capstead, Inc. mortgage. There is
a question, as indicated, about whether or not the money
received from Plaintiff's father is a debt or a gift.
A hearing is scheduled for Thursday, January 23,
1997, at 9:00 a.m. Notices will be sent to counsel and the
parties.

11. ProDosed Resolution:
a. Each party shall retain all personal property in
his/her possession, including any checking/savings
accounts and vehicles.
b. The real estate located at 405 Alison Avenue,
Mechanicsburg, PA shall be transferred to Husband.
c. Husband shall retain his HARSCO savings plan.
d. Wife shall retain her pension/retirement plan.
e. The marital portion of Husband's HARSCO retirement/
pension plan shall be split 50/50 pursuant to a
Qualified Domestic Relations Order.
f. Husband shall pay Wife an amount to effectuate a
50/50 split of the parties' assets, payable
beginning five years from the date of the parties'
divorce decree in monthly installments.
g. Both parties shall bear their own counsel fees and
costs.

Petitioner, by and through his attorney, Lori K. Serratelli

files this petition and respectfully represents the following:
1. Plaintiff/Petitioner is Theodore A. Rusenko, who resides at
405 Alison Avenue, Mechanicsburg, Cumberland County, Pennsylvania
17055.
2. Defendant/Respondent is Kelley L. Rusenko, who resides at
122 East Coover street, Apt. B, Mechanicsburg, Cumberland County,
Pennsylvania 17055.
J. One child was born of the parties, namely: James J. T.
Rusenko, born October 27, 1992.
4. The child is in the shared physical custody of Petitioner
and Respondent.

5. The Petitioner requests a primary physical custody and
shared legal custody of his child based on the best interest of the
child since he has a more stable work schedule, more suitable
lifestyle and living arrangements than Respondent.
WHEREFORE, the Petitioner respectfully prays your Honorable
Court to schedule a Conciliation Conference and issue an Order as
follows:
1. Granting the Petitioner primary physical custody and
shared legal custody of the parties' minor child.
2. Requiring that Plaintiff/Petitioner, Defendant/Respondent,
and the minor child, undergo psychological evaluations if the
matter is contested, with the cost of said evaluations to be shared
by the Plaintiff/Petitloner and Defendant/Respondent.
3. Requiring that a home study of Defendant/Respondent's home
be completed by Children and Youth Services, if the matter is

AND NOW, this / ~1i day of~PJE/~JtJG, 1996, upon receipt of
the Conciliator's Report, it appearing that the parties reached an agreement as to an
interim order, and the provisions of that interim Order ware dictated in their
presence and approved by them and their counsel, it is hereby ordered and directed
as follows:
1. The parties shall share legal custody of their minor child,
James J.T. Rusenko, d.o.b. 27 October 1992.
2. The parties shall share physical custody of the minor child on
a week-on, week-off basis. The week-on, week-off schedule shall be
from Sunday to Sunday with the drop off being at 7:00 p.m. This
schedule will begin with Father on September 15, 1996. The party
ending their custodial period will be responsible for transportation to
the other party's residence.
3. Each party will be entitled to an alternating Wednesday
evening beginning with the pick up at day care and the drop off at the
other party's residence at 8:00 p.m. This alternating Wednesday
schedule will begin with Mother on September 18, 1996.
4. Father will have Thanksgiving in 1996.
5. The Christmas holiday will be split into two segments. The
first segment will be from 12:00 noon on December 24th until 12:00
noon on December 25. Mother shell have this segment in 1996. The
second segment will be from 12:00 noon on December 25th until
12:00 noon on December 26th. Father will have this segment in
1996.
6. For the Wednesday visitation that will occur on New Vear's
Day, Father shall have the child from 2:00 p.m. until 8:00 p.m.
7. The parties agree that they shall cooperate and assist each
other with reasonable telephone access with the child when the child
is in their respective custody.
8. The parties agree that they shall submit themselves and their
minor child and anyone else deemed appropriate to a custody
evaluation to be performed by Riegler Shienvold Associates. The
parties will evenly share the cost of that evaluation. Upon completion
of the evaluation, the report shall be shared with both counsel and in
the event that tha parties cannot raach an agreament at that time,
either party may request the Court for anothar conciliation.

THE MASTER: Today is Wednesday, February 26,
1997. This is the date set for a Master's hearing in the above
captioned divorce proceedings. present in the hearing room are
the plaintiff, Theodore A. Rusenko, and his counsel Lori K.
Serratelli, and the Defendant, Kelley L. Rusenko, and her
counsel John J. Connelly, Jr.
A divorce complaint was filed on August 16, 1995,
raising grounds for divorce of irretrievable breakdown of the
marriage. Counsel have indicated that they are going to
conclude the divorce under section 3301(c) of the Domestic
Relations Code with the filing of mutual affidavits of consent.
The plaintiff has presented an affidavit and a waiver of notice
of intention to request entry of divorce decree which will be
filed with the prothonotary this date. Mr. connelly has
indicated that he will have an affidavit and waiver filed within
a week of today's date.
The divorce complaint also raised the economic
claim of equitable distribution. No claims have been raised for
alimony or counsel fees and expenses by either party.
The parties were married on November 5, 1988, and

separated on March 14, 1995. They are the natural parents of
one child, James Joseph T. Rusenko, born October 27, 1992.
physical and legal custody of the child is shared between the
parties.

After negotiations this morning the Master has been
advised that the parties have reached an agreement with respect
to the claim of equitable distribution. The agreement is going
to be placed on the record in the presence of the parties by
counsel. The agreement as placed on the record will be
considered the substantive agreement of the parties and will not
be subject to any changes or modifications except for correction
of typographical errors which may be made during the
transcription. The Master is going to have a draft of the
agreement prepared and sent to counsel for review for
typographical errors, after which the parties and counsel will
affix their signatures. I specificallY note, however, that the
signatures are not required to make the agreement binding on the
parties as it is entered on the record today. The only
modification or changes that can be made to the agreement would
be to correct typographical errors; no substantive changes will
be permitted.
After the agreement has been affirmed by the
signatures of the parties and counsel and returned to the
Master, the Master will prepare an order vacating his
appointment and counsel will then be in a position to prepare a

praecipe transmitting the record to the Court requesting that
the Court enter a final decree in divorce. Mr. Connelly.
MR. CONNELLY: The parties have reached the
following agreement regarding the distribution of property:
1. The marital residence located at 405 Alison Avenue,
Mechanicsburg, Pennsylvania, shall become the sole and
separate property of the Plaintiff subject to the
following terms and conditions:
Upon presentation of the deed to the marital residence
the Defendant Kelley L. Rusenko will sign the deed which
shall be held in escrow by Lori K. Serratelli, attorney
for the Plaintiff, until such time as husband has
released wife's name from the existing mortgage. In the
meantime, husband shall indemnify and hold wife harmless
on that mortgage obligation.
Husband shall within 90 days of today's date complete the
removal of wife's name from the mortgage thereby
relieving her from any further obligation thereunder.
In the event husband intends to sell the marital
residence in the future, he will offer the property first
to wife at a price to be determined by husband. In the
event she fails to exercise the option at that time, he
shall offer to her a right of first refusal to purchase
the house thereby matching any offer husband receives on
the residence. Wife's right to match that offer must be
exercised within 5 days of the presentation of the offer
by husband.
2. In the form of equitable distribution, husband shall pay
to wife the sum of $16,000.00. This payment shall be
made to wife within 60 days of husband's completion of
the removal of wife's name from the aforementioned
mortgage as referred to in Paragraph 1 hereof.
3. The 1991 Honda EX shall become the sole and separate
property of wife and husband agrees to execute the title
to said vehicle transferring it into wife's name
individually.
4. Husband shall retain as his sole and separate property
the 1978 Chevrolet Blazer which is presently titled

in his name individually.
5. Wife shall retain as her sole and separate property
her interest in the Dauphin County Retirement System.
6. Husband shall retain as his sole and separate property
his pension through Harsco Corporation as well as his
Harsco savings plan.
7. Husband shall retain as his sole and separate property
the 1986 Honda motorcycle titled in husband's name
individually.
8. Within 10 days of husband's tender of payment of the
$16,000.00 toward completion of the equitable
distribution, wife shall pay to husband's parents the sum
of $2,500.00 representing wife's portion of a repayment
of a loan to husband's parents. After wife's payment of
the $2,500.00 amount to husband's parents, husband shall
be responsible for the balance due on said debt.
9. Each party shall retain as their sole and separate
property all assets in the possession of that party with
the exception of the fOllowing items which shall be
removed by wife from the marital residence within 30 days
of today's date:
a) Silver set to include candelabra, ice bucket,
serving platter, trays and casserole
b) Corner cupboard
c) Antique toaster, wok, crock set and cast iron
figurines
d) The parties' son's rocker and toy box
e) Electrolux vacuum cleaner
f) Christmas ornaments
g) Bedroom rugs
h) Hall mirror
i) Crib
Any items of personal property not specifically
identified in either parties' inventory or on the list
set forth herein shall be divided by the parties to
their mutual satisfaction. In the event of a dispute as
to the division of these personal items, oither party
reserves the right to petition the court to have these
items distributed after hearing on the issue.
10. The parties are joint owners of a savings account for
their son James presently invested at Belco Federal
Credit Union. Husband shall remove the amount invested
for James in that account and place it in another
investment vehicle of his choice under the condition
that the account be placed in the joint names of the
parties (husband and wife) requiring both signatures to
have any funds removed from that account. Husband shall
provide wife with a quarterly statement of the status of
said account. At the parties' election, the account can
be transferred in either parties' name individually
and/or liquidated. Any interest on said account is
being reported under James' social security number for
income tax purposes.
11. The only joint debt of the parties is the first mortgage
referred to previously. Any other debts existing at the
present are the individual responsibility of the party
who holds the debt and who incurred the debt.
12. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each
party hereby waives and relinquishes any and all rights
he or she may now have or hereafter acquire under the
present or future laws of any jurisdiction to share in
the property or the estate of the other as a result of
the marital relationship including without limitation,
statutory allowance, widow's allowance, right of
intestacy, right to take against the will of the other,
and right to act as administrator or o.xecutor in the
other's estate. Each will at the request of the other
execute, acknowledge, and deliver any and all instruments
which may be necessary or advisable to carry into effect
this mutual waiver and relinquishment of all such
interests, rights, and claims.
13. The parties further agree to execute any and all
documents necessary to implement the terms of this
agreement in a timely fashion.
14. Based on the existing custodial arrangements (shared
legal and physical custody) the parties shall alternate
the federal income tax exemption for their minor child

James and shall execute the documents necessary to
implement this alternating schedule from year to year no
later than February 1st in each year in which a
return is due. Husband shall have a right to claim
James for the 1996 tax year.
MR. CONNELLY: Kelley, you've heard me dictate on
the record the terms and conditions of this agreement, have you
not?
MS. RUSENKO: Yes, I have.
MR. CONNELLY: Do you fully understand them as
dictated?
MS. RUSENKO: Yes, I do.
MR. CONNELLY: Is there any issue that we have not
addressed in dictating the terms and conditions that you are
aware of?
MS. RUSENKO: No.
MR. CONNELLY: Do you understand that you are bound
by this agreement regardless of anything that occurs subsequent
to today?
MS. RUSENKO: Yes, I do.
MR. CONNELLY: This is an agreement which is
binding as of now and the only changes that can be made are
typographical errors in the final document?
MS. RUSENKO: I understand.
MS. SERRATELLI: Ted, you have heard Mr. connelly
dictate all of the terms that we have arrived at this morning?

MR. RUSENKO: Yes.
MS. SERRATELLI: Do you fully understand those
terms and agree to those terms?
MR. RUSENKO: Yes.
MS. SERRATELLI: Is there anything else you wish to
add?
MR. RUSENKO: No.
MS. SERRATELLI: Do you agree and understand that
you are, from this time forward, bound by these terms?
MR. RUSENKO: Yes.
MS. SERRATELLI: And there will be no modification
with the exception of a written agreement by the two of you
modifying __ that would be the only ability to modify the terms?
MR. RUSENKO: Yes.
(A discussion was held off the record.)
THE MASTER: counsel, after discussion with the
parties, are going to add an addendum to the aforementioned
agreement with respect to the refinancing of the mortgage.
MR. CONNELLY: The Master's jurisdiction of this
matter shall be preserved until the completion of husband's
removal of wife's name from the aforementioned mortgage. In the
event husband fails to remove wife's name after a bona fide
effort to do so, either party reserves the right to return this
matter to the Master for adjudication on the equitable
distribution issues.

counsel for the husband shall promptly advise the
Master that the wife's removal on the mortgage has been
completed and the deed recorded, at which time the Master will
vacate his appointment and the divorce action will conclude.
THE MASTER: Mr. Rusenko and Ms. Rusenko, you've
heard the addendum that has been placed on the record to the
agreement with respect to this office retaining jurisdiction, do
you understand that addendum?
MS. RUSENKO: Yes.
MR. RUSENKO: Yes.
THE MASTER: And do you agree to it?
MS. RUSENKO: Yes.
MR. RUSENKO: Yes.
I acknowledge that I have read the above
stipulation and agreement, that I understand the terms of
settlement as set forth herein, and that by signing below I
ratify and affirm the agreement previously made and intend to
bind myself to the settlement as a contract obligating myself to
the terms of settlement and subjecting myself to the methods and
procedures of enforcement which may be imposed by law and in
particular section 3105 of the Domestic Relations Code.
