NEIBERT, ) Defendants ) Court Administrator Cumberland county Courthouse Fourth Floor One Courthouse Square carlisle, Pennsylvania 17013 (717) 240-6200 COMPLAINT IN MORTGAGE FORECLOSURE AND NOW, comes the Plaintiff, PNC Bank, National Association, a national banking association, by their counsel, Joel B. Gold, Esquire, and files this Complaint In Mortgage Foreclosure, alleging as follows: 1. Plaintiff, PNC Bank, National Association formerly the First Bank and Trust Company ( "PNC"), is a national banking association organized under the laws of the United States and a citizen of the Commonwealth of Pennsylvania, with its main office located at Fifth Avenue and Wood Street, Pittsburgh, Pennsylvania 15222. 2. Defendants Smith E. Neibert and Sharon K. Neibert, are individuals with a residence address of 9 Pine Hill avenue, Mechanicsburg, PA 17055. 3. On or about July 24, 1991, as security for payment of a Note and Security Agreement ("Note") dated July 24, 1991, Defendants executed and delivered to Plaintiff a Mortgage in the principal amount of $48,202.84 for the premises known as 9 Pine Hill Avenue, Silver Spring Township, Cumberland County, Pennsylvania. True and correct copies of the Note and Mortgage are attached hereto, incorporated herein and labeled Exhibit "A" and Exhibit "B", respectively. 4. The Mortgage, Exhibit "B" hereto, was recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania on August 7, 1991, in Mortgage Book Volume 1924, page 273. 5. The real property which is subject to the Mortgage, Exhibit "B" hereto, is: :"if ALL that certain lot or piece of ground situate in Silver Spring Township, Cumberland County, Commonwealth of Pennsylvania, described in greater detail in that instrument of record in the Office of Recorder of Deeds of Cumberland County, Pennsylvania, at Deed Book Volume X27, Page 173 wherein defendants herein are "Grantees". 6. Defendants are record owners of the described mortgaged premises. 7. Defendants have defaulted under the terms and conditions of the Note and Mortgage, Exhibits "A" and "B" hereto, by failing to make periodic payments of principal and interest as required by the Note and Mortgage, said failure to make payments has rendered the obligation due for February 2, 1995. 8. As of August 11, 1995, due to aforesaid default, the amount due and owing to Plaintiff is computed as follows: principal and interest attorney fees costs total amount due $47,418.40 $ 150.00 $ 250.00 $47,818,40 Plus interest from August 12, 1995 at $14,31 per diem, plus additional attorneys' fees as allowed by law, costs and court costs. 9, The Notices of Homeowner's Emergency Mortgage Assistance Act ("Act 91") required by 35 P.S. !i!i1680.401c, et seq., were mailed to Defendants on May 25, 1995. True and correct copies of the Notices with certificates of mailing, U.S. Postal Service Form 3817, are attached hereto, incorporated herein and marked Exhibits lIe" and "D". 10. The Notices of Intention to Foreclose Mortgage required by Section 403 of Act No. 6 of 1974, 41 P.S.!i403, were mailed certified mail, return receipt requested, to Defendants on May 23, 1995. True and correct copies of the Notices with proof of certified mailing are attached hereto, incorporated herein and marKed on Exhibits "E" and "F". 11. The Mortgage described above and attached hereto and marked as Exhibit "B" has not been satisfied, released or assigned. 12. Under the terms of the Mortgage and the Note, Defendants are liable to PNC for attorneys fees for collection; to date of the filing of this Complaint attorney's fees in the sum of $150.00 have been incurred by PNC, Plaintiff does not waive its rights to collect additional attorney's fees for services rendered after the filing of this Complaint not to exceed the amount agreed upon in the Mortgage and Note or as allowed by law. WHEREFORE, Plaintiff demands judgment of foreclosure and sale of the mortgaged property in the amount of $47,818.40, together with interest thereon at the rate of $14.31, per day plus attorneys' fees, costs, and costs of suit.
