AND NOW, comes the Plaintiff, Julia A. Beam, by and through
her attorneys, Hepford, Swartz , Morgan, represents and avers the
followingl
1, Plaintiff, Julia A. Beam, is an individual who resides
.~ 415 S. Broad Street, Mechanicsburg, cumberland county,
Pennsylvania 17055.
2, Defendant, Winding Hill Veterinary Clinic, is a
Pennsylvania corporation with a principal place of business at 1424
S. Market street, Mechanicsburg, cumberland county, Pennsylvania
17055.
3. The plaintiff in this action was an employee of the
Defendant.
4. The Plaintiff was terminated without cause on April 10,
1995.

5. Under the terms of the personnel Polioy Manual the
Plaintiff was entitled to two weeks severance pay.
6. The hourly wage at the time of termination was $8.58.
The weekly hours at 26 1/2 equals the loss of $454.74.
7. In addition, the plaintiff is entitled to a bonus by the
terms of the Personnel Policy in the amount of $300.00.
8. The plaintiff is entitled to reimbursement of costs in
this matter in the amount of $47.00,
WHEREFORE, plaintiff requests judgment in the amount of
$801.74 together with interest at the legal rate. The date of the
judgment from the District Justice is August 15, 1995,

AND NOW, comes the Plaintiff, Julia A. Beam, by and through
her attorneys, Hepford, Swartz & Morgan, represents and avers the
fOllowing I
1. Plaintiff, Julia A. Beam, is an individual who resides
at 415 S. Broad Street, Mechanicsburg, Cumberland County,
Pennaylvania 17055.
2. Defendant, Winding Hill Veterinary Clinic, is a
Pennsylvania Corporation with a principal place of business at 1424
S. Market Street, Mechanicsburg, cumberland County, Pennsylvania
17055.
3. The Plaintiff in this action was an employee of the
Defendant.
4. The Plaintiff was terminated without cause on April 10,
1995.

5. Under the terms of the Personnel Policy Manual the
Plaintiff was entitled to two weeks severance pay. A copy of said
Manual is attached hereto and made a part hereof as Exhibit "A".
6. The hourly wage at the time of termination was $8.58,
The weekly hours at 26 1/2 equals the loss of $454.74.
7. In addition, the Plaintiff is entitled to a bonus by the
terms of the Personnel Policy Manual in the amount of $300,00 as
set forth in the Service Bonus Program by document dated April 6,
1965 and attached as Exhibit "B".
8, The Plaintiff is entitled to reimbursement of costs in
the action filed before the District Justice awarded judgment.
WHEREFORE, Plaintiff requests judgment in the amount of
$801.74 together with interest at the legal rate. The date of the
judgment from the District Justice is August 15, 1995,

10. Denied. A vaccination clinic was sponsored by Crossfire,
a nonprofit christian singles ministry, which Plaintiff is a
member. The space was given by Robin Lauver, owner of Golden Lake
Dog Recreation Camp.
In further answer, Golden Lake Veterinary
Hospital was not even built at the time.
11 . Denied.
It is specifically denied that there was any
involvement with a competing business entity. It is further denied
there was any act in assisting Dr. Benner.
To the contrary,
Plaintiff's volunteered timed with Crossfire was not on behalf of
or in assistance of Dr. Benner. In further answer, the only advice
was at an April 6, 1995 staff meeting in which Plaintiff was
advised to no longer refer any business to Golden Lake, because Mr.
Lauver had plans to build a hospital which would be a competing
entity.
12. Denied as stated. On or about March 24, 1995, Plaintiff
was approached by the Practice Manager because Plaintiff had heard
the Practice Manager telling her co-workers she was leaving.
Plaintiff specifically stated to the Practice Manager that she had
made no plans to work at Golden Lake. They had no contacts or
commitments to do so and had no plans. As long as the Plaintiff
was an employee of Winding Hill Veterinary Clinic, the Plaintiff
was loyal to them. Plaintiff never even talked to the owner of the
future veterinary practice until she WflS discharged.
13. Denied as stated. It is denied that Plaintiff was in any
way assisting Dr. Benner of the veterinary activities. Plaintiff
was present, as well as Dr. Benner, at the Vaccination Clinic
sponsored by and under the auspicious of Crossfire.
14. Denied as stated. By way of further answer, the incident
involving a confusion over a work schedule involved one Friday
night in September of 1994 for which there was a letter written and
a reply to that letter was written back explaining the situation.
In regard to the removal of surgical equipment, Plaintiff never
personally removed any surgical equipment for herself nor any that
belonged to the Association. Plaintiff was asked by Dr. Benner,
who at that time was an employee, a partner of the corporation and
Plaintiff's employer, to put together all the instruments with Dr.
Benner's initials on them. Plaintiff did so and was asked to take
them to Dr. Benner, which Plaintiff did. It was Plaintiff's
understanding then and it is Plaintiff's understanding now that the
surgical equipment belonged to Plaintiff's employer and at the time
the medicine belonging to a client was requested by the client and
was returned. This medication was not Plaintiff's employers nor
her own and Plaintiff returned it to the person who had left it at
the premises for ease of administration.

In fact, hearings have been held for unemployment compensation
which determined, as a fact, it was not for a good cause.
16. Denied. It is specifically denied that the plaintiff
ever committed any misconduct while employed by the Defendant.

severance and benefits as stated in her Complaint which have been
unjustly withheld.
