COMPLAINT
I. New Cumberland Federal Credit Union Is a federally chartcred non-profit credit
union with its principal place of business being 619 Bridge Street. New Cumberland,
Cumberland County. Pennsylvania 17070.
2. Defendant Is Scott A. Snyder, an adult Individual presently r<1sldlng at 242
Montebello Fann Road, Duncannon, 11erry County, Pennsylvania 17020,
3, On or about March 10, 1992 Defendant executed a Promissory Note and
Disclosure Statement as "borrower" In favor of the PlalntllT In the amount of Four Thousand and
00/100 Dollars ($4,000.00) at 13% Interest, A true and COITCCt copy of the foregoing document
Is attached hereto as Exhibit "A",
4, As security for the extension of the credit. the Defendant olTered a 1984
Volkswagen Cabriolet,
5, The Defcndant obtained the $4.000,00 rrom the 11lalnllll'in order to purchase the
1984 Volkswagen Cabriolet from Arrow Auto Sales & Service. located at 1208 Route 22-322.
Dauphin. Dauphin County.11ennsylvnnla 17018. A true and correct copy orthe sales contruct is
attached hereto as Exhibit "n".
6. The Defendant and Arrow Aulo Sales & Service represenled to the I'lalntll1' that
the tenus of the sale were as tollows:
a. The purchase price oflhe vchlcle was $6,495.00; and
b, The Defendant was provided a trade In discount worth $1.000.00 leaving
a the outstanding balance to purchase the car of $5.495.00.
7. The Defendant and Arrow Auto Sales & Service represented to the l'laintill'thal
the Defendant was going to make a cash down payment of$I,495,OO with the remaining
$4,000.00 of the purchase price coming from the Plaintill's extension of credit.
8, The Defendant and Arrow Auto Sales & Service represented to the Plaintiff that
the Plaintiff would be "recorded as the lirstllen on the title" issued to the Defendant. By
implication, the Defendant and Arrow Auto Sales & Service knew that the Plaintiff was to be the
one and only lienholder listed on the motor vehicle title as Is the long established business
practice between auto dealers and linanclallnstltutions,
9, The Defendant, however. did not pay $1,495.00 as II down pllyment to Arrow
Auto SlIles & Service,
10 Instelld. Arrow Auto Sales & Service extended lit least $899.00 in crcdit lit 10%
Interest to the Defendant towards his down pllyment of $1 ,495.00,
II. Arrow Auto Sales & Service. without the knowledge, approvlll or consent of thc
