and at the outoome of my investigation when I arrived on the
.oene, the vehicles were not in the interseotion. They were
both moved from the aotua1 accident Beene. Upon my arrival
unit number one vehicle was down in here parked off the side
of the roadway. And unit number two's vehio1e was parked
over here in the lot of C. R. Friendly's.
At the end of my investigation it appeared
that the vehiole accident soene was in this location. And
that upon my arrival on the scene at the intersection I
observed debris in the roadway. And also after questioning
the witnesses I walked over to the intersection and observed
the debris again. That debris would have favored the middle

of the interseotion and towards the west side of the
interaection, if you will, on the north side of the
inter.aotion.
Q And what did that debris indioate to you that
happened right where you are pointing on the diagram?
A That ino1ined to tell me that the aooident
co11i.ion would have happened in that area, due to the fact
that a large portion, ba.ica11y all the debris that I did
ob.erve, wa. in that area. So I wa. inclined to feel that
the acoident took p1aoe in that area, and the vehicle. made
contact at that point.
Q You in fact inlpeoted unit number two, hadn't
you, to .ee the phy.ica1 damage?
A Ye..

A Ye.. There was damage done to the right side
of her vehicle. And she was missing vehicle parts. And Hr.
Moll also had damage to his vehiole. And that debris was
found in this area.

coident at the inter..ation of 3rd . Lowther streBt,Lemoyn. Borough.
Upon arrival, I found that both vehio1es had been .oved frON the
ntersection of lrd . Lowther street and that Unit '2 was being looked at
ulanoe personnel. Unit 12 stated that she was SUffering neck and shoul
ain and also pain n her left hand. Unit 12 stated that she would go to
ospita1 on her own and that she refused ambulanoe transport.
This offioer prior to interviewing Unit '1 and 12 observed the inter
ection at 3rd and Lowther streets and observed Beveral pieces of debris f
he vehioles laying in the oenter port on of the ntersection. Sa d debr
located in the westbound lane of travel.
I then questioned Unit 11 and Unit 12 and a witnesses as to how th

prior testimony would be admissible. If there is an objection,
however, a majority of the board would rule.
I think you should plan to read the relevant parts of Mr. Weber's

In response to your May 5, 1998 correspondence I offer the
following I
(11 the nature of the previous court proceedings
was a criminal hearing held before Judge Hess in
Cumberland County on December 20, 1994, Docket No. 94-
1698 Criminal Term. The criminal charges were brought
by the district attorney against the plaintiff in this
case, Sterling K. Molll
(2) the prosecution called Mr. Weberl and
(31 the plaintiff, Mr. Moll, had the opportunity
to, and in fact did, cross-examine Mr. Weber.
There is ample authority for the proposition that
Mr. Weber's testimony in the above-referenced hearing is
admissible. In Commonwealth v. Rodjers, 472 Pa. 435, 452-453
(n.71, 372 A.2d 771, the supreme Court held that testimony from a
defendant's preliminary hearing of a witness who later refused to
testify on the grounds of privilege against self-incrimination
was admissible. In commonwealth v. Oraves, 44 Pa. 29, 33-38, 398
A.2d 644 (1979), the Supreme Court held tha~t:estimony of a
witness given at a previous trial was admissible when the witness
was currently unavailable due to partial loss of memory
concerning pertinent events. Oiven that Mr. Weber is deceased,
there is no issue about his availability. Under the above-cited

July 21, 199B.
One of the witnesses, Ron Weber, was subpoenaed by our
office to provide testimony at the arbitration. His wife called
to advise me on May 4, 1998 that Mr. Weber died on February 11,
1998.
Mr. Weber provided testimony at a previous court proceeding
involving this accident and the parties to this lawsuit. We
request permission to have that testimony read into the record,
or provided to you in transcript form, at the arbitration.

PLEASE TAKE NOTICE that, pursuant to Rule 4009 of the Pa.
Rules of Civil Procedure, Defendant requests that Plaintiff
produce the documents hereinafter described and permit Defendant,

Defendant Vicki J. Erdman ("Erdman"), by her attorneys,
McNees, Wallace & Nurick, hereby files the following Preliminary
Objections to Plaintiff's Complaint:
1. Plaintiff Sterling K. Moll ("Moll") commenced this
action by filing a "petition to Recover Vehicle Damages" on or
about August 23, 1995.
2, The "Petition" seeks to recover property damages only
as a result of the alleged negligence of Erdman. There are no
allegations that Moll sustained any personal injuries as a result
of the vehicle accident (Petition, Paragraphs 5-6) ,
3. The "Petition" also seeks damages for "hardship and
mental abuse" as a result of Erdman's alleged providing of
"inconsistent" facts to a vehicle insurance carrier (Petition,
Paragraphs 4, 7).
4. The ss;l damnum clause of the "Pstition" seeks recovery
of "legal fees" and "less than $10,000.00 in punitive damages."
COUNT I
Demurrer to The Claim of "Hardship and Mental Abuse"
5. Paragraphs 1 through 4 above are incorporated herein by
reference as if set forth in full.
6, The attempt by Moll, who is acting ~~, to recover
for "hardship and mental abuse" is an unartful attempt to state a
claim for either intentional or negligent infliction of emotional
distress,
7, Under Pennsylvania law, neither claim can be maintained
absent physical injury,
8. Moll does not allege that he sustained any physical
injuries as a result of the accident.
WHEREFORE, Erdman respectfully requests that Moll's claim
for infliction of emotional distress be dismissed.
COUNT II
Motion to Strike Claim for Leqal Fees
9, Paragraphs 1 through 4 above are incorporated herein by
reference as is set forth in full.
10. In the ~ damnum clause of the Petition, Moll seeks the
recovery of "legal fees."
11. Under Pennsylvania law, the recovery of attorneys'
fees, under the facts alleged in the complaint, is not permitted
as a matter of law.

WHEREFORE, Erdman respectfully requests that Moll's claim
for the recovery of attorneys' fees be stricken.
COUNT III
Motion to Strike Punitive Damaaes Claim
12. Paragraphs 1 through 4 above are incorporated herein by
reference as is set forth in full.
13. The Petition also contains a claim for recovery of
punitive damages.
14, Punitive damages are recoverable under Pennsylvania law
only where the complaint contains facts which show extreme or
outrageous conduct performed in reckless disregard of the rights
and safety of others,
15, The "Petition" describes nothing more than a typical
accident scenario in which Moll claims that Erdman was negligent
in causing property damage.
16, The "Petition" contains no facts which give rise to a
claim for punitive damages.

strike Moll's claim for punitive damages.

DEFENDANT'S ANSWER TO
PLAINTIFF'S MOTION FOR PROTECTIVE ORDER
Defendant Vicki J. Erdman ("Erdman") files the following
Answer to Plaintiff's Motion for Protective Order filed on or
about August 18, 19971
1. Admitted.
2. Denied. Under Pennsylvania Rule of Civil Procedure
4003.1, Erdman may "obtain di.scovery regarding any matter, not
privileged, which is relevant to the subject matter involved in
the pending action, whether it relates to the claim or defense of
the party seeking discovery or to the claim or defense of any
other party, including the existence, description, nature,
content, custody, condition and location of any books, documents,
or other tangible things and the identity and location of persons
having knowledge of any discoverable matter," The Requests for
Production of Documents served upon Plaintiff were well within
the scope of discovery permitted by Rule 4003.1,
3, Denied. Erdman has served upon Plaintiff a total of
seven (7), clearly phrased requests for production of documents,
not a "endless list" of documents as Plaintiff contends.
4, Denied. Erdman has never been advised, in formal
answers to written discovery. of the exhibits that Plaintiff
intends to use at trial. Plaintiff has an obligation, under the
Rules of Civil Procedure, to provide Erdman with any and all
documents requested, including copies of those exhibits which he
intends to use at the trial of this matter, The fact that
Plaintiff is acting pro se does not relieve him of his responsi-
bility under the Rules of Civil Procedure,
5. Denied. Under the Rules of Civil procedure, it is not
sufficient to simply mention exhibits that may have been used in
a separate, criminal case and indicate that the parties serving
discovery may simply obtain those materials used in that prior
proceeding. Plaintiff has an obligation, under the Rules of
Civil Procedure, to provide the information requested from
Erdman. It is admitted that Erdman has a copy of the transcript
from the previous trial.
6. Denied, After reasonable investigation. Defendant
Erdman is without knowledge or information sufficient to form a
belief as to the truth of the averments contained in this
paragraph. Nonetheless, Plaintiff does not need to make physical
delivery of the documents requested, Plaintiff may copy them and
send them in the mail to counsel for Erdman, Counsel for Erdman
will then be happy to reimburue Moll for the reasonable copying
costs incurred.

WHEREFORE, Defendant Vicki J. Erdman requests that
Plaintiff's Motion for Protective Order be denied, and that
Plaintiff be ordered to file full and complete answers to the
Requests for Production of Documents within ten (10) days of the
date of the Court's Order.
