COMPLAINT
COMES NOW the plaintiff, Robert M. spirk, Jr., by and through
his attorney, Gregory R. Reed, Esquire and for his causes of action
all8Qe I
1. plaintiff, Robert M. spirk, Jr., is an adult individual
residing at, 3510'Hawthorne Drive, cumberland county, camp Hill,
Pennsylvania (hereinafter referred to as "Plaintiff").
2. Defendant, Accubanc Mortgage corporation, is a corporation
doing business within cumberland county, Pennsylvania, with offices
at 12377 Merit Drive '600, P.O. Box 809089, Dallas, Texas 75380-
9089 (hereinafter referred to as "Defendant").
3. On or about october 29, 1992 Central Mortgage company took
a Mortgage on property located at 3510 Hawthorn Drive, cumberland
county, camp Hill, Pennsylvania in the amount of $77,250.00 which
mortgage was thereafter assigned to Defendant.
4. said Assignment of Mortgage was recorded November 1, 1994
in Miscellaneous Book 486 at page 296
5. Jeffrey E. Benner and Tracy Benner, his wife, on the
aforesaid date, owned said real estate and sold said real estate on

December 30, 1994 to said plaintiff.
6. On or about December 30, 1994 plaintiff delivered a check
to Defendant in the amount of $76,886.93 as payment in full of
said indebtedness (a copy cancelled check is attached hereto,
marked Exhibit "A" and incorporated herein by reference).
7. On March 17, 1995 the mortgage had not been satisfied of
record so plaintiff's counsel wrote to Defendant, by first class
mail, asking Defendant to immediately satisfy the mortgage (a copy
of said letter is attached hereto, marked Exhibit "8" and
incorporated herein by reference).
8. plaintiff is unable to obtain Title Insurance for said
property because the lien is still of record in favor of Accubank
Mortgage corporation.
9. Defendant has for a period of more than seven (7) months
refused to satisfy said mortgage.
10. Defendant refused to satisfy the mortgage is capricious,
spiteful and vexatious.

WHEREFORE, Plaintiff respectfully requests that judgment be
entered for PlaintiU and against Defendant in the amount of
$76,886.93 plus attorneYB fees and costs.
