Henschel, flied a Writ of Summons against Defendants, Kemper National Insurance Companies, Lumbennan's Mutual Casualty Company. American Motorists Insurance Company, American Manufacturers Mutual Insurance Company, American Proteetlon Insurance Company and Kemper Risk Manaaement Services. 2. On or about September 12, 1995, PlalntllTs served PlalntllTs' First Request for Production and Copying of Documents upon the Defendants. 3. On November 13,1995, counsel for the Defendants, Griffith, Strickler, Lennan, Solymos &. Calkins. entered Its appearance on behalf of the Defendants, 4. On or about January 17, 1996, Defendants' counsel served a copy of Defendants' Answers to PlaintllTs' Request for Production of Documents upon PlalntllTs' counsel. 5. PlalntllTs have never filed a Complaint In this case, 6, Since on or about January 17,1996, no communication has taken place between the parties. 7. Since January 17, 1996, a period exceeding two years has passed with no dlseusslons, negotiations and certainly no docket activity having transpired between the parties, 8. PlalntllTs have showed a lack of due diligence and reasonable promptitude in failing to move forward this litigation for more than two years. 9, PlaintllTs have failed to demonstrate reasonable justlllcatlon or excuse for this delay. 10, An action may be dismissed for lack of docket activity where It Is established that (I) the PlalntllT has demonstrated a lack of due diligence in falUng to proceed with reasonable promptitude; (2) there is no compelling reason for the delay: and, (3) the dclay has caused some prejudice to the adverse party.
