or formerly of Annie E. Smith; on the South by Wagners
Gap Road; and on the West by lot formerly of John
Thompson, now of Richard R. Barrick and Frances K.
Barrick. containing 25 Feet in front on "A" Street and
extending in depth 175 Feet, more or less, to the Wagners
Gap Road. It being Lot Number 20, Block 5, according to
a plan of Carlisle Land and Improvement Company recorded
in the Recorder of Deeds Office of cumberland County in
11 Miscellaneous Record Book, Page 572.
Excepting therefrom, premises which Paul E. Hodge
and Elizabeth Hodge Brown and Haven R. Brown her husband
conveyed unto School District of the Borough of Carlisle,
dated october 29, 1949 and recorded october 31, 1949 in
Record Book 0, Volume 14, Page 307.

East by land now or formerly of the Carlisle Land and
Improvement Company I on the South by Wagners G'Ip Road
(now vacated and abandoned); and on the West by land now
or formerly of Robert Thompson.
CONTAINING 50 Feet in front on "A" Street, and
extending at an even width 120 Feet, more or less, in
depth to Wagners Gap Road on the South.
TRACT NUMBER 2: BEGINNING at a point on the Eastern
side of 16 Feet wide public alley, which point is 20 Feet
North of the Northern line of Carlisle School District
lot, at corner of land being retained by Ralph Smith;
THENCE from said point of BEGINNING in an Eastward
direction parallel to "A" Street, a distance of 20 Feet
to a point in line of land of 'l'ract Number 1 above-
mentioned; THENCE in a Southerly direction along line of
land of Tract Number 1 above mentioned, a distance of 20
Feet to a point in line of Stevens school Building of
Carlisle School District; THENCE in a Westwardly

BEING the same premises which Richard R. Barrick and
Frances K. Barrick, husband and wife granted and conveyed
unto Wayne M. Rupp and Linda K. Rupp, husband and wife by
Deed dated May 25, 1990 and recorded in the Office of the
Recorder of Deeds for CUMBERLAND County on May 29, 1990
in Deed Book 34 0, Page 982,
5. The Name and mailing address of each Defendant is: Wayne
M. Rupp and Linda K. RUpp, 348 A Street, Carlisle, PA
17013.
6. The Interest of each individual Defendant is as
Mortgagor, Real Owner, or both.
7. If any Defendant above-named is deceased, this action
shall proceed against the deceased Defendant's heirs,
assigns, successors, administrators, personal
representatives and/or executors through his/her estate.

B. The Mortgage is in default because the monthly
installments of principal and interest and other charges
stated below, all as authorized by the Mortgage, are due
as of MARCH 1, 1995 and have not been paid, and upon
failure to make such payments when due, the whole of the
principal, together with charges specifically itemized
below are immediately due and payable.

10. Interest accrues at a per diem rate of $17.46 for each
day after AUGUST 16, 1995 that the debt remains unpaid,
and Plaintiff may incurr additional attorneys fees, as
well as other expenses, costs and charges collectible
under the Note and Mortgage.
11. The original principal balance of the Mortgage exceeds
Fifty Thousand Dollars ($50,000.00). Accordingly, Notice
of Intention to Foreclose pursuant to 41 P.S. S 403 is
not required.
12. Notice pursuant to the Homeowners' Emergency Mortgage
Assistance Act of 19B3, 35 P.S. S 16BO.402c, ~ ~., was
sent to each individual Mortgagor by first-class mail.
Copies of the Notice are attached hereto as Exhibit "C
WHEREFORE, Plaintiff respectfully requests this Court to enter
judgment in favor of Plaintiff and against Defendants in the amount
set forth in paragraphs 9 and 10, together with interest, attorneys
fees and for other expenses, costs, and charges collectible under
the Note and Mortgage and for the foreclosure and sale of the
mortgaged premises.
