Plaintiff is, therefore, either the original Mortgagee named in the Mortgage, the legal successor in interest to the original Mortgagee, or is the present holder of the mortgage by virtue of the above-described Assignment(s). 3 . Each Mortgagor named in paragraph 1 executed evidence of the debt secured by the Mortgage. the Note is attached as Exhibit "B", a Note as A copy of 4. The real property which is subject to the Mortgage is generally known as 1005 Pheasant Drive North, North Middleton, PA 17013 and is more specifically described aSI ALL that certain piece or parcel of land situated in North Middleton Township, Cumberland County, Pennsylvania, more particularly shown on a certain plan entitled "Final subdivision Plan of phase II & III of Pheasant Run Estates for Metlanco, Inc., North Middleton Township, Cumberland County, Pennsylvania, Scale 1"-100" by Gerrit J. Betz Associates, Inc., Engineers & surveyors, 6 East Main Street, Shiremanstown, Pennsylvania, which plan is filed in plan Book 23 at Page 117 in the Office of the Recorder of Deeds for Cumberland County. Said lot is more particularly bounded and described as followsl BEGINNING at a point on the southern right-of-way line of Pheasant Drive North (50 Foot) right-of-way, at the dividing line between Lot Numbers 13 and 14 on the above mentioned subdivision planl THENCE along said dividing line, south 6 Degrees 49 Minutes 39 Seconds West, 125.0 Feet to a point I THENCE along line of lands now or formerly of Metlanco, Inc" North B3 Degrees 10 Minutes 21 Seconds West, 95.0 Feet to a pointl THENCE along the dividing line between Lot Numbers 14 and 15 on said plan, North 06 Degrees 49 Minutes 39 Seconds East, 125.0 Feet to a point at the southern right-of-way line of said Pheasant Drive North, THENCE along said right- of -way 1 ine, South B3 Degrees 10 Minutes 21 Seconds East, 95,00 Feet to a point, the place of BEGINNING. 5 TOGETHER with the right, in common with others, to pass and repass for ingress and egress over the roads as shown on said map from the lot herein conveyed. BEING SUBJECT to a Declaration of Covenants recorded in Miscellaneous Book 229, Page 531 in the Office of the Recorder of Deeds for Cumberland county. BEING the same premises which granted and conveyed unto James F. Dunn, Jr. and Jack R. Greenwood and Ronald A. Roberge, co-partners trading as DGR associates. Jerry M. Trolinger Jr. and Starlene Trolinger by Deed dated July 10th,1990 and recorded in the (1ffice of the Recorder of Deeds for CUMBERLAND County on July 11th, 1990 in Deed Book 0 34, Page 119B. 5. The Name and mailing address of each Defendant iSI Jerry M, Trolinger Jr., Starlene Trolinger, 1005 pheasant Drive North, North Middleton, PA 17013. 6. The Interest of each individual Defendant is as Mortgagor, Real Owner, or both. 7. If any Defendant above-named is deceased, this action shall proceed against the deceased Defendant's heirs, assigns, successors, administrators, personal representatives and/or executors through his/her estate. B. The Mortgage is in default because the monthly installments of principal and interest and other charges stated below, all as authorized by the Mortgage, are due as of FEBRUARY I, 1995 and have not been paid, and upon failure to make such payments when due, the whole of the principal, together with charges specifically itemized below are immediately due and payable. 9. The following amounts are due as of August 16, 19951 Principal of Mortgage Debt due and unpaid $B3.049.23 Interest currently due and owing at 10.5\ per annum calculated from January I, 1995 at $ 23.89 each day Late Charge of $37.00 per month assessed on the 16th of each month 5.423.03 274.62 Escrow Balance (Credit to Defendant) (562.76) 6 Attorney's Fees 800.00 TOTAL 88.984.12 10. Interest accrues at a per diem rate of $23.89 for each day after August 16, 1995 that the debt remains unpaid, and Plaintiff may incurr additional attorneys fees, as well as other expenses, costs and charges collectible under the Note and Mortgage. 12. The original principal balance of the Mortgage exceeds Fifty Thousand Dollars ($50,000.00). Accordingly, Notice of Intention to Foreclose pursuant to 41 P.S. ~ 403 is not required. 13. The Mortgage is insured by the Federal Housing Administration under Title II of the National Housing Act (12 U.S.C. ~ 1707-1715z-18). Accordingly, the Homeowners' Emergency Assistance Act of 1983, 35 P.S. ~ 1680.402c is not applicable. WHEREFORE, Plaintiff respectfully requests this Court to enter judgment in favor of Plaintiff and against Defendants in the amount set forth in paragraphs 9 and 10, together with interest, attorneys fees and for other expenses, costs, and charges collectible under the Note and Mortgage and for the foreclosure and sale of the mortgaged premises.
