4. Said note and security agreement and said real estate
mortgage have not been aSRigned.
5, Betty A. Kuykendall is the sole record owner in fee
simple of said premises subject to said mortgage, by virtue of
a Deed dated and recorded on October 5, 1967, and recorded in
the Cumberland County Recorder's Office in Deed Book "N",
Volume 22, Page 474, more specifically set forth in Exhibit
"C", attached hereto and made a part hereof by reference.
6. Said note and said real estate mortgage are in default
because Defendants herein have failed to pay the payments that
were due and owing for the months of May 10, 1995, June 10,
1995, July 10, 1995 and August 10, 1995.
7, The Plaintiff has given to the Defendants written
notice of intention to foreclose on said mortgage as required
by law under Act 6, dated July 18, 1995, a copy of which is
marked Exhibits "0", and attached hereto and made a part hereof
by reference.
8. The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 1983,
dated July 18, 1995, a copy of which is marked Exhibits "E",
and attached hereto and made a part hereof by reference.
9. By reason of the aforesaid default, the entire
principal balance of Twelve Thousand Three Hundred Eighty-nine
Dollars and 49/100 ($12,389.49), with interest thereon at the
rate of twelve (12.00%) percent per annum computed from August
21, 1995, accruing insurance premiums, attorney's fees in the
amount of Five Hundred Eighty-Nine and 43/100 Dollars ($589.43)
are now due and payable.
10. The Defendant is liable to the Plaintiff for the
following on said mortgage loan:
A. Principal amount and interest
due through August 21, 1995 $ 11,788.63
B. Interest at 3.81 per day
8/21/95 to 8/23/95 $ 11.43
C. Late Charges: $ 0.00
D. Attorney's Collection fee: $ 589.43
TOTAL: $ 12,389.49
WHEREFORE, Plaintiff prays the Court to enter judgment in
favor of plaintiff and to order the foreclosure and sale of the
mortgaged property and for the amount of Twelve Thousand Three
Hundred Eighty-nine and 49/100 Dollars ($12,389.49) together
with interest thereon, costs and all other amounts advanced by
Plaintiff.
