PROPERTY SETTLEMENT AND SEPARATION AGREEMENT THIS AGREEMENT made this 3tH) day of I\M\l2CtA , 1995" between MARK E. McCLELLAN, of Camp Hill, Cumberland County, Pennsylvania, hereinafter referred to as Husband, A N o CYNTHIA M. McCLELLAN, of Camp Hill, Cumberland County, Pennsylvania, hereinafter referred to as Wife. WITNESSETH: WHEREAS, in consequence of disputes and unhappy differences, the parties have been living separate and apart from each other; and WHEREAS, the parties desire to confirm their separation and make arrangements therewith, including custody of their minor children, IAN E. McCLELLAN (D.O.B. 8-26-90) and AMY E. McCLELLAN (D.O.B. 2-12-93), the division of their marital property and other rights and obligations growing out of their marriage. NOW THEREFORE, in consideration of the covenants and promises hereinafter to be mutually kept and performed by each party, as well as for other good and valuable consideration and intending to be legally bound it is agreed as follows: (1) It shall be lawful for each party at all times hereafter to live separale and apart from the other party at such place or places as he or she from time to time may choose or deem fit. (2) Except as herein otherwise provided, each party hereby . '... . releases the other from any and all claims, or demands up to the date of execution hereof. (3) The parties are the owners of certain real estate with improvements thereon erected known as 5 Clemson Drive, Camp Hill, cumberland County, Pennsylvania. Husband and Wife agree that Husband shall immediately attempt to sell the real estate without the assistance of a realtor at a mutually agreeable price. The costs of any advertising, repairs or necessary maintenance related to this sale shall be reimbursed to Husband prior to the division of the proceeds. In the event the parties are unable to enter into an agreement for the sale of the real estate within sixty (60) days from the date of this Agreement, Husband and Wife agree to list the real estate for sale with a mutually agreeable, reputable realtor at the list price suggested by the realtor. In the event a bona fide offer is received within five (5%) percent of the then-current list price without unreasonable conditions and either Husband or Wife desires to accept said offer, the other party agrees to accept the same. After the signing of this Agreement, Husband shall have exclusive possession of the marital residence. Upon the sale and settlement of the real estate the proceeds, after the reimbursement to Husband of the expenses hereinbefore provided, and other customary closing costs including but not limited to transfer tax, realtors commission and attorneys fees shall be distributed fifty-five (55%) percent to Husband and forty-five (45%) percent to Wife. (4) In the event that either party contracted or incurred any debts since the date of separation, the party who incurred said debt shall be responsible for the payment thereof regardless of the name in which the debt may have been charged. (5) Husband is the owner of a 1990 Toyota Camry titled in his name alone and free and clear of any encumbrance. Wife is the owner of a 1990 Toyota Camry titled in her name alone and free and clear of any encumbrance. Each party relinquishes any right, title or interest he or she may have to the motor vehicle of the other. (6) The parties hereto mutually agree that they have effected a satisfactory division of the furniture, household furnishings, appliances, tools and other household personal property between them, and they mutually agree that each party shall from and after the date hereof be the sole and separate owner of all such property presently in his or her possession whether said property wau heretofo~e owned jointly or individually by the parties hereto. Nothing herein to the contrary, each party will retain personal property they had before the marriage and gifts from their side of the family to Husband and Wife. (7) Each party hereby relinquishes any right, title or interest he or she may have in or to any intangible personal property currently titled in the name of or in the possession of the other party, including, but not limited to, stocks, bonds, insurance, bank accounts and retirement accounts. This provision , specifically includes a release of any pension Wife has by reason of her employment at Pennsylvania Blue Shield and a release of any pension Husband has by reason of his employment by IBM or Morrison Knudsen. The parties agree that their Certificate of Deposit with Farmers Trust Company and their joint savings account with the IBM Pennsylvania Employees Federal Credit Union shall be divided equally between them at the time of the signing of this Agreement. (8) The parties agree that legal custody of their minor children, IAN E. McCLELLAN and AMY E. McCLELLAN, shall be shared, with both parties having the right to make major pa1.'ellting decisions affecting the childrenls health, education and welfare. Husband and Wife further shall have shared physical custody of the children with each party having the children approximately one-half (~) of the time. The current agreement for the shared - 4 - SAIDlS, GUIDO, snUFF & MASLAND 26 W, //ISh Sired Carlllle.P^ physical custody is as follows: (A) Husband shall have the children five (5) days a week from 7:00 A.M. until 12:30 P.M. at which time Husband shall deliver the children to their day-care provider. Wife shall thereafter, at or about 4:30 P.M. pick up the children from the day-care and the children will remain with Wife during the evening hours. This shared custody arrangement is based on Husband working 10:00 P.M. to 6:30 A.M. sunday through Thursday. Transportation of the children to Husband shall alternate with Husband picking the children up at 7:00 A.M. at Wife's residence one week and Wife dropping the children off at Husband's residence the next week. (B) The parties shall alternate weekends with Husband having the children every other weekend from Friday after school until sunday prior to his return to work. (C) Alternating holidays with the holidays being New Year's Day, president's Day, Easter, Memorial Day, Fourth of July, Labor Day and Thanksgiving Day. (D) Father shall have the children on Father's Day and Mother on Mother's Day. (E) Christmas shall be dlvided equally between the parties with each party having an equal amount of time on christmas with the children. (F) Other times as agreed upon including two (2) consecutive weeks during the summer. (9) Husband agrees to pay to Wife for the use, benefit, support and maintenance of their minor children, the sum of Two -nfn1 (lSD,l") Hundred^~ Dollars per month which payment shall be made in two equal installments due the first (1st) and fifteenth (15th) of each month. Husband and Wife agree that payments of child support shall not commence until the sale and settlement of the marital residence as hereinbefore provided. Husband shall provide health insurance, major medical and similar coverage for the benefit of the minor children as provided by his employer. The parties shall divide equally the costs of day-care for the children. Payments for day-care,shall be made by the parties directly to the day-care provider and shall alternate by week between Husband and Wife. The parties agree that in the event of a material change in circumstances, the amount of support shall be subject to an appropriate adjustment by agreement or, if the parties are unable to agree, by order of a court of competent jurisdiction, and the amount ordered by any such court shall be deemed to be the amount due hereunder. The parties acknowledge and agree that this paragraph may be entered as a Court Order through the Domestic Relations Office and each party agrees to execute any documents necessary or desirable to effectuate the same. Each party shall pay his or her own attorney for all legal services rendered or to be rendered on his or her behalf. (12) Neither party shall contract or incur any debt or liability for which the other party or his or her property or estate may be responsible and shall indemnify and save the other party harmless from any and all claims or demands made against him or her by reason of debts or obligations incurred by the other party. (13) The parties do hereby warrant, represent, acknowledge and agree that each is fully and completely informed of, and is familiar with, the wealth, real and personal property, estate and assets, earnings and income of the other and that each has made a full and complete disclosure to the other of his and her entire assets and liabilities and any further enumeration or statement thereof in this Agreement is specifically waived. (14) Husband and wife acknowledge that each of them has read and understand his and her rights and responsibilities under this Agreement and that they have executed this Agreement under no compulsion to do so but as a voluntary act. (16) Each of the parties shall from time to time, at the request of the other, execute, acknowledge and deliver to the other party any and all further instruments that may be reasonably required to give full force and effect to the provision of this Agreement. (17) Husband and Wife agree to execute a joint 1994 federal and state income tax return. Each party agrees to contribute one-half (~) of any tax due and any refund shall be divided equally between the parties. The parties further agree that they shall each be entitled to one exemption for the children commencing in 1995. Husband shall receive the exemption for Ian and Wife for Amy. Each party agrees to execute any documents necessary or desirable to have the exemption awarded to the other party. (lB) Except as may be otherwise specifically provided in this Agreement, Husband and Wife, for themselves, their heirs, representatives and assigns, each hereby forever releases, remises, discharges and quitclaims the other, and such other's heirs, representatives, assigns and estate, from and with respect to the following: A. All liability, claims, causes of action, damages, - B - : costs, contributions, expenses or demands whatsoever in law or in equity; B. All rights, title, interest or claims in or to any property of the other, whether real, personal or mixed and whether now owned or hereafter acquired; c. All rights of curtesy and dower and all claims or rights in the nature of curtesy and dower; D. All widow or widower's rights; E. All rights, title and interest or claims in or to the other's eatate, whether now owned or hereafter acquired, including but not limited to all rights or claims: (1) to take against the other's will; (2) under the laws of intestacy; (3) to a family exemption or similar allowance; and (4) all other rights or authority to participate or intervene in a deceased spouse's estate in any way, whether ariaing under the laws of Pennsylvania or any other country, territory, state or political subdivioion. (19) This Agreement shall be construed under the law of the Commonwealth of Pennsylvania. If any provision of this Agreemsnt is determined to be invalid or unenforceable, all other provisions shall continue in full force and effect. (20) In the event that either of the parties shall recover a final judgment or decree of absolute divorce against the other in a court of competent juriSdiction, the provisions of this Agreement may be incorporated by reference or in substance but shall not be merged into such judgment or decree and this Agreement shall survive any such final judgment or decree of absolute divorce and shall be entirely independent thereof. (21) In the event that either party breaches any provision of this Agreement, and the other party retains counsel to assist in enforcing the terms thereof, the parties hereby agree that the breaching party will pay all attorney's fees, court costs and expenses incurred by the other party in enforcing the Agreement. Upon the sale and settlement of the real estate the proceeds, after the reimbursement to Husband of the expenses hereinbefure provided, and other customary closing costs including but not limited to transfer tax, realtors commission and attorneys fees shall be distributed fifty-five (55%) percent to Husband and forty-five (45%) percent to Wife. (4) In the event that either party contracted or incurred any debts since the date of separation, the party who incurred said debt shall be responsible for the payment thereof regardless of the name in which the debt may have been charged. (5) Hu~band is the owner of a 1990 Toyota Camry titled in his name alone and free and clear of any encumbrance. Wife is the owner of a 1990 Toyota camry titled in her name alone and free and clear of any encumbrance. Each party relinquishes any right, title or interest he or she may have to the motor vehicle of the other. (6) The parties hereto mutually agree that they have effected a satisfactory divicion of the furniture, household furnishings, appliances, tools and other household personal property between them, and they mutually agree that each party shall from and after the date hereof be the sole and separate owner of all such property presently in his or her possession whether said property was heretofore owned jointly or individually by the parties hereto. (7) Each party hereby relinquishes any right, title or interest he or she may have in or to any intangible personal property currently titled in the name of or in the possession of the other party, inClUding, but not limited to, stocks, bonds, insurance, bank accounts and retirement accounts. This provision specifically includes a release of any pension Wife has by reason of her employment at Pennsylvania Blue Shield and a release of any pension Husband has by reason of his employment by IBM or Morrison Knudsen. The parties agree that their Certificate of Deposit with Farmers Trust Company and their joint savings account with the IBM Pennsylvania Employees Federal Credit Union shall be divided equally between them at the time of the signing of this Agreement. (B) The parties agree that legal custody of their minor Children, IAN E. McCLELLAN and AMY E. McCLELLAN, shall be shared, with both parties having the right to make major parenting decisions affecting the children'S health, education and welfare. Husband and Wife further shall have shared physical custody of the children with each party having the children approximately one-half (~) of the tlme. Wife shall thereafter, at or about 4:30 P.M. pick up the children from the day-care and the children will remain with Wife during the evening hours. This shared custody arrangement is based on Husband working 10:00 P.M. to 6:30 A.M. Sunday through Thursday. Transportation of the children to Husband shall alternate with Husband picking the children up at 7:00 A.M. at Wife'S residence one week and Wife dropping the children off at Husband's residence the next week. (B) The parties shall alternate weekends with Husband having the children every other weekend from Friday after school until Sunday prior to his return to work. (C) Alternating holidays with the holidays being New Year's Day, President's Day, Easter, Memorial Day, Fourth of July, Labor Day and Thanksgiving Day. (D) Father shall have the children on Father's Day and Mother on Mother's Day. (E) Christmas shall be divided equally between the parties with each party having an equal amount of time on Christmas with the children. Husband shall provide health insurance, major medical and similar coverage for the benefit of the minor children as provided by his employer. The parties agree that in the event of a material change in circumstances, .the amount of support shall be subject to an appropriate adjustment by agreement or, if the parties are unable to agree, by order of a court of competent jurisdiction, and the amount ordered by any such court shall be deemed to be the amount due hereunder. The parties acknowledge and agree that this paragraph may be entered as a Court Order through the Domestic Relations Office and each party agrees to execute any documents necessary or desirable to effectuate the same. (12) Neither party shall contract or incur any debt or liability for which the other party or his or her property or estate may be responsible and shall indemnify and save the other party harmless from any and all claims or demands made against him or her by reason of debts or obligations incurred by the other party. (13) The parties do hereby warrant, represent, acknowledge and agree that each is fully and completely informed of, and is familiar with, the wealth, real and personal property, estate and assets, earnings and income of the other and that each has made a full and complete disclosure to the other of his and her entire assets and liabilities and any further enumeration or statement thereof in this Agreement is specifically waived. (14) Husband and wife acknowledge that each of them has read and understand his and her rights and responsibilities under this Agreement and that they have executed this Agreement under no compulsion to do DO but as a voluntary act. (17) Husband and Wife agree to execute a joint 1994 federal and state income tax return. Each party agrees to contribute one-half (~) of any tax due and any refund shall be divided equally between the parties. The parties further agree that they shall each be entitled to one exemption for the children commencing in 1995. Husband shall receive the exemption for Ian and Wife for Amy. Each party agrees to execute any documents necessary or desirable to have the exemption awarded to the other party. (18) Except as may be otherwise specifically provided in this Agreement, Husband and Wife, for themselves, their heirs, representatives and assigns, each hereby forever releases, remises, discharges and quitclaims the other, and such other's heirs, representatives, assigns and estate, from and with respect to the following: A. All liability, claims, causes of action, damages, - 8 - . . costs, contributions, expenses or demands whatsoever in law or i!J equity; B. All rights, title, interest or claims in or to any property of the other, whether real, personal or mixed and whether now owned or hereafter acquired; c. All rights of curtesy and dower and all claims or rights in the nature of curtesy and dower; D. All widow or widower's rights; E. All rights, title and interest or claims in or to the other's estate, whether now owned or hereafter acquired, including but not limited to all rights or claims: (1) to take against the other's will; (2) under the laws of intestacy; (3) to a family exemption or similar allowance; and (4) all other rights or authority to participate or intervene in a deceased spouse's estate in any way, whether arising under the laws of Pennsylvania or any other country, territory, state or political subdiviGion. If any provision of this Agreement is determined to be invalid or unenforceable, all other provisions shall continue in full force and effect. (20) In the event that either of the parties shall recover a final judgment or decree of absolute divorce against the other in a court of competent jurisdiction, the provisions of this Agreement may be incorporated by reference or in substance but shall not be merged into such judgment or decree and this Agreement shall survive any such final judgment or decree of absolute divorce and shall be entirely independent thereof. (21) In the event that either party breaches any provision of this Agreement, and the other party retains counsel to assist in enforcing the terms thereof, the parties hereby agree that the breaching party will pay all attorney's fees, court costs and expenses incurred by the other party in enforcing the Agreement. Each PARENT shall be entitled to access to any and all information, persons, entities and documentation regarding the same so that informed decisions can be made. 2. Non-major decisions involving the CHILDREN'S day to day living shall be made by the PARENT then having custody, but to the extent possible, the PARENTS shall attempt to make such rules and follow such schedules as would provide the CHILDREN with continuity in their lives regardless of the PARENT with whom they are then residing. 3. Emergency decisions regarding the CHILDREN shall be made by the PARENT then having physical custody, but that PARENT shall communicate to the other PARENT the nature and extent of the emergency and shall provide that other PARENT with all information pertaining to the treatment so that the other PARENT may be involved in the decision making process at the earliest possible time. 4. Upon receipt by a PARENT, copies of the CHILDREN'S school schedules, special events notifications, report cards and the like shall be provided to the other PARENT. Each PARENT shall share with the other PARENT any other information and documentation, or copies thereof, that each PARENT possesses regarding the CHILDREN within such reasonable time as to make the records and information of reasonable use to the other PARENT. 5. Each PARENT shall provide the other PARENT with at least 48 hours advance notice of school or other activities whenever possible. 6. Neither PARENT shall make any derogatory comments about the other PARENT in the presence of the CHILDREN and to the extent possible shall prevent third PARENTS - from making any such comments in the presence of the CHILDREN. Further, neither PARENT shall discuss any aspect of the custodial situation with the CHILDREN and shall not utilize the CHILDREN for purposes of conveying information or inquiries pertaining to the CHILDREN to the other PARENT. 7. Each PARENT shall notify the other PARENT of any medical, dental, optical and psychological appointments and/or treatment for the CHILDREN sufficiently in advance thereof so that the other PARENT can attend. 8. Each parent must provide the CHILDREN with all necessary medical treatment, including. but not limited to, on- going use of medication prescribed by physicians. 9. Each parent shall provide the other PARENT with the name, address and phone number of any babysitter or other daycare providers that regularly watch the CHILDREN for that PARENT. 10. Both PARENTS shall be afforded reasonable telephone contact with the CHILDREN while in the other PARENT'S custody. 11. If either PARENT intends on removing the CHILDREN from the Commonwealth of Pennsylvania for a period in excess of forty-eight (48) hours that PARENT shall provide the other PARENT with the address and phone number where the CHILDREN can be reached during the period of absence. 12. Neither PARENT shall remove the CHILDREN from the jurisdiction of the Court of Common Pleas of Cumberland County, Pennsylvania on a permanent basis without providing the other PARENT with at least ninety (90) days advance notice thereof. Said ninety (90) day time period is designed to allow the PARENTS to negotiate a modification of this Stipulated Agreement and in absence thereof to be able to petition the Court for a modification if the same is appropriate under the circumstances. B. PHY1=lICAI. CUSTODY: The PARENTS shall share physical custody of the CHILDREN in accordance with the following schedule: 1. MOTHER shall have primary physical custody of the CHILDREN subject to FATHER'S rights of partial custody hereafter set forth. 2. FATHER shall have rights of partial custody of the CHILDREN in accordance with the following schedule: a. Alternating weekends from Friday after school (or from 5:00 p.m. during the summer) until Sunday at 7:00 p.m. This schedule shall coincide with the alternating weekend schedule that has been in existence immediately prior hereto so that the PARENT, who would otherwise have custody of the CHILDREN for the first (1ST) alternating weekend after the date hereof, shall have custody for the first (1ST) weekend as hereinldefined. b. On the other alternating weeks from Friday after school (or from 5:00 p.m. during the summer) until Saturday at 12:00 p.m. c. Each parent shall be afforded a reasonable amount of time on holidays, either by way of sharing or alternating, as the parents shall mutually agree. Those holidays shall include the following major holidays: 1. Easter Day; 2. Memorial Day; 3. Independence Day; 4 . Labor Day; 5. Thanksgiving Day d. The Christmas holiday shall be divided into two (2) segments. The first segment shall be from December 24th at 9:00 a.m. until December 25th at 11:00 a.m. The second segment shall be from December 25th at 11:00 a.m. until December 26th at 7:00 p.m. MOTHER shall always have custody for the first (1ST) segment and FATHER shall always have custody for the second (2nd) segment. e. MOTHER shall have custody of the CHILDREN each Mother~s Day from 9:00 a.m. until 6:00 p.m. and FATHER shall custody of the CHILDREN each Father's Day from 9:00 a.m. until 6:00 p.m. f, Each PARENT shall be entitled to - one (1) uninterrupted week of custodial time with the CHILDREN. To the extent possible this week shall be scheduled to encompass the selecting PARENT'S regular alternating weekend. If said scheduling is not possible or practical then the PARENT selecting the custodial time period that encompasses the other PARENT'S regular alternating weekend shall switch weekends with the other PARENT so that neither PARENT has custody of the CHILDREN for more 5. In violation of the Court Order and contrary to the best interests and wclfare of the Children, Respondent is planning to move out orthe jurisdiction in August 2001 to Tower City, Pennsylvania. and intends to take the Children with her on a permanent basis. b. Respondent's reasous for the move to Tower City arc unrelated to the interests orthe Children, and the move will disrupt the current lifestyles and custody arrangements made for the Children. e.
