COMPLAINT
AND NOW, comes Farmers Trust Company, through its attorney,
William A. Duncan, Esquire, and files this complaint in
Mortgage Foreclosure, of which the following is a statement:
1. plaintiff is Farmers Trust Company, a corporation
organized and exieting under the laws of the commonwealth of
pennsylvania with its main office and principal place of
business located at 1 West High street, Carlisle, cumberland
county, pennsylvania 17013.
2. Defendant, Joseph A, Rilla, an adult individual, and
Defendant, Nicholas A. Rilla, an adult individual, and
Defendant, and Magdalene Rilla, an adult individual, and
Defendant, with property located at 50 pine Street, Carlisle,
pennsylvania 17013.
3. On or about March 16, 1989, Defendants made, executed
and delivered to Plaintiff a note and a real estate mortgage
financing One Hundred Ninety Thousand Dollars and 00/100
($190,000.00), a copy of said note and said real estate
mortgage being attached hereto as Exhibits "A" and "B",
respectively, and are incorporated herein by reference as
though fully set forth,
4. Said note and said real estate mortgage have not been
assigned.
5. Joseph A, Rillo, Nicholas A, Rillo, and Magdalene
Rillo, are the sole record owners in fee simple of said
premises subject to said mortgage, by virtue of a Deed dated
April 27, 1967 and recorded on April 27, 1967, and recorded in
the Cumberland County Recorder's Office in Deed Book "H",
Volume 22, Page 961, more specifically set forth in Exhibit
"C", attached hereto and made a part hereof by reference,
6. Said note and said real estate mortgage are in default
because Defendants herein have failed to pay the payments that
were due and owing for May 16, 1995, June 16, 1995, July 16,
1995 and August 16, 1995,
7. The Plaintiff has given to the Defendants written
notice of intention to foreclose on said mortgage as required
by law under Act 6, dated July 1B, 1995, a copy of which is
marked Exhibits "0" and "E", and attached hereto and made a
part hereof by reference.
B, The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 19B3,
dated July 1B, 1995, a copy of which is marked Exhibits "F" and
"G", and attached hereto and made a part hereof by reference.
9. By reason of the aforesaid default, the entire
principal balance of Seventy-one Thousand Six Hundred
Ninety-eight Dollars and 27/100, ($71,698.27) with interest
thereon at the rate of Ten and one-half (10.50%) percent per
annum computed from June 9, 1995, accruing insurance premiums,
attorney's fees in the amount of Three Thousand Four Hundred
Eleven Dollars and 47/100 ($3,411.47) are now due and payable.
10. The Defendants are liable to the Plaintiff for the
following on said mortgage loan:
A. Principal and Interest
due through August 21, 1995 $ 68,046,63
B. Interest at 10.50% from
8-21-95 to 8-23-951 $ 57,42
C, Late Charges: $ 182.75
D. Attorney's Collection fee: $ 3,411.47
TOTAL: $ 71,698.27
WHEREFORE, Plaintiff prays the Court to enter judgment in
favor of Plaintiff and to order the foreclosure and sale of the
mortgaged property and for the amount of Seventy-one Thousand
six Hundred Ninety-eight Dollars and 27/100 ($71,698.27)
together with interest thereon, costs and all other amounts
advanced by Plaintiff.
