AND NOW, ~tORDBR OF C this ~( day of ~( , 19_, upon ordered and decreed that agreement of the parties, the within Custody Stipulation and Agreement is made an Order of Court. 1. The parties shall have shared legal custody of the child, meaning that they shall share the legal right to make major decisions affecting the best interest of the child and all of the major matters related to the child, including, but not limited to, medical, religious, and educational decisions. 2. Mother shall have primary physical custody of the child. 3. Father shall have partial physical custody and visitation with the child as follows: A. From Friday at 5:15 PM through Sunday at 6:00 PM i , II Ii every other weekend; and B. Two weeks during the summer vacation at times agreeable to both parties; and C. From 12:00 PM on each Christmas Day through 6:00 PM on each 26th day of December; and . D. From Wednesday at 5:15 PM through Thursday at 8;00 AM every week until child enters school; and E. From Friday at 5:15 PM until Sunday at 6: 00 PM annually to attend Weaver Family reunion; and F. At such other times as mutually agreed between the parties. 4. The parties shall alternate physical custody and visitation with the child during the holidays of Easter and Thanksgiving; whereby the child shall spend 1995 Easter and Thanksgiving with Father, Easter 1996 with Mother, Memorial Day 1996 with Father, 1996 Easter and Thanksgiving with Mother and alternating accordingly thereafter. Monday holidays (i.e. Memorial Day and Independence Day) will correspond with parent weekend; whereby if Monday holiday falls on Father's weekend visitation, he will keep child until that Monday at 6:00 PM, and I , I I I I I Mother's residence', with the exception of the weekly Wednesday II 'I I. For each period of partial custody, be it weekend, vacation, or holiday, Father will pick up and drop off child at visitation, whereby Father will drop off child at sitter's residence no later than 8:00 AM on Thursday mornings. 6. Neither parent shall do anything which may estrange the child from the other parent or injure the opinion of the child as to the other parent, or which may hamper the free and natural ~ '." '. Weaver, Jr. (Father hereinafter) and Jacqueline A. Weaver (Mother hereinafter); WHEREAS the parties have born to them a child, namely Jonathan S. Weaver, born February 23, 1992 (the child hereinafter); and WHEREAS, the parties wish to enter into an agreement relative to custody, partial custody, and visitation of the child; and WHEREAS, the child has resided in Cumberland. County I Pennsylvania for the past six months, thus giving this Court jurisdiction; NOW THEREFORE, in consideration of the mutual covenants, promises, and agreements as hereinafter set forth, and intending to be legally bound, the parties agree as follows: 1. For each period of partial custody, be it weekend, vacation or holiday, father will pick up and drop off child at mother's residence; with the exception of the weekly . . , " wednesday visitation, whereby father will drop off child at sitter's residence no later than B:OOam on Thursday mornings. 6. Neither parent shall do anything which may estrange the child from the other parent or injure the opinion of the child as to the other parent, or which may hamper the free and natural development of the child's love and affection for the other parent. 7. The failure to either party to insist on strict performance of the provisions of this stipulation and agreement shall not be construed as a waiver of any subsequent default of the same or similar provision. B. The parties agree and desire that this stipulation and Agreement be made an Order of the Court of Common Pleas of Cumberland County, pennsylvania. 9. This stipulation and Agreement shall become an Order of Court with the Court of Common Pleas of cumberland County, entering said Order and retaining jurisdiction should either party desire or require modification of said order. IN WITNESS WHEREOF, the parties hereto intending to be legally bound by the terms hereof, set forth their hands and seals the day and year herein set forth.
