Your correspondence dated June 26, 1995
near Mr. Dugan:
Please be advised that I have been retained by Mr. park
regarding a potential dispute between the two of you. Your
correspondence of June 26, 1995 indicates that you are dissatisfied
with the cost of services provided by Mr. Park.
There are many reasons Mr. Park's services may cost an amount
greater than the average for contractors in his area. There is no
need to be well-versed in the law: common sense should tell you
that past services and payments are in the past and cannot be
changed. However, if you remain' concerned regarding the cost of
present invoices or future services, Mr. park is more than willing
to speak with you. You remain a valued customer.
,_ The invoice dated April 29, 1995 demanded an amount of
$1,728.00. If we subtract the $416.00 credit which you have
~uggested, Mr. Park would settle for a payment in the amount of
-$1,312.00. Failure to remit this amount to Mr. Park or my office
in a timely fashion will result in my recommending to Mr. Park that
he file a claim with a District Justice or before an Arbitration
Panel for the full $1,728.00 invoice plus costs. '
In the meantime, if you have any questions or concerns, please
do not hesitate to contact me.

WHEREFORE, Defendant demands that the within action be
dismissed together with cost of suit.
COUNTERCLAIM
8 . Paragraph 1 through B are incorporated herein by
reference thereto.
9. The Plaintiff has grossly overcharged Defendant for
previous jobs for which Defendant is entitled to the following
credits, whereof the following is a statement:
(a) June 30, 1994 - Mountainview Lot 28 - 52 sq. at
$B.OO/sq. ($45/sq.) = $416.00 Credit.
(b) December 31, 1994 - Mountainview Lot 09 - 52
sq. at $13.00/sq. ($45/sq.) - $676.00 Credit.
(c) March 4, 1995 - Greenlane Lot 158 - 34 sq. at
$17. OO/sq. ($40/sq.) - $578.00 Credit.
(d) March 14, 1995 - Mountainview Lot 21 - 32 sq.
at $20.00 sq. ($37/sq.) - $640.00 credit.
(e) April 4, 1995 - Deer Run Lot 09 - 29 sq. at
$15.00/sq. ($40/sq.) - $435.00 Credit.
(e) April 29, 1995 - Greenlane Lot 137 - 32 sq. at
$13.00/sq. ($37/sq.) - $416.00 Credit.
10. As a result of the foregoing, Defendant is entitled
to the net sum of $1,433.00, or in the alternative, a total set-off
for the amount claimed in the Complaint due to the foregoing.
