Cumberland County, Pennsylvania 17011, (the "Owner") the Owner of
the hereinafter described tract of land, has executed or is about
to execute contemporaneously herewith a contract with THE NORWOOD
COMPANY, of 119 Aster Drive, Harrisburg, Dauphin County,
Pennsylvania 17112, (the "Contractor") for improvements to the
premises located at Lot #7A Westport Drive, 10.0 +/- acres, Lower
Allen Township, Cumberland County, Pennsylvania, more
particularly described on "Exhibit A" attached hereto and made a
part hereof (the "Premises").
NOW, August 30, 1995, before any authority has been given by
said Owner to the said Contractor to commence work on said
Premises or to otherwise construct any improvements thereto, or
to purchase materials for the same, or to enter into any
contracts with any subcontractors, or materialmen, or to
authorize any purchases by or through any subcontractors or
materialmen, in consideration of the making of said contract with
the Owner and the further consideration of One Dollar ($1.00), to
Contractor paid by said Owner, and with the intent of all parties
to be legally bound hereby, it is agreed that no lien shall be
filed against the building or Premises or any part thereof, by
the Contractor or any subcontractor, or by any of the materialmen
ALL THAT CERTAIN tract or parcel of land situate in Lower Allen
Township, Cumberland County, Pennsylvania, bounded and described as
follows, to wit:
BEGINNING at a point; said point being located on the northern right-
of-way line of Westport Drive; thence continuing along lands now or
formerly of Ritter by bearing of North 34' 53' 00" West a distance of
98,94' feet to a point; thence continuing along lands now or formerly
of Carl Berker by bearing of North 55' 06' 00" East, a distance of
125.00' feet to a point; thence continuing along the southern right-
of-way line of Kensington Drive, by bearing of North 26' 31' 00" East,
a distance of 56.94' feet to a point; thence continuing along lands
now or formerly of Nicholas G. and Peggy A, Haynes, lands now or
formerly of Flaser and Ginger L, Forney to the Southern right-of-way
line of Woodmere Drive and lands now or formerly of Howard J, Lindsay
et. ux, by bearing of North 55' 06' 00" East, a distance of 425.00'
feet to a point; thence continuing along lands now or formerly of
Howard J. Lindsay, et, ux, bearing of North 34' 54' 00" West, a
distance of 67,82' feet to a point; thence continuing along lands now
or formerly of James A. Boone and lands now or formerly of Gregory J,
and Shari K, Waldman, lands now or formerly of Robert L, Gould, lands
now or formerly of Michael P. and J, Kay Shaffer, and lands now or
formerly of Dwayne G. and Janet Wabrick, by bearing of North 87' 47'
00" East, a distance of 337,48' feet to a point; thence continuing
along lands now or formerly of Ronald J. Sprow, and lands now or
formerly of Albert J. McCullough, by bearing of North 57' OS' 00"
East, a distance of 197.96' feet to a point; thence continuing along
lands now or formerly of Richard Hogendobler, by bearing of North 42'
50' 20" East, a distance of 23.51' feet to a point; thence continuing
along lands of the Westport Business Center, Lot 7-D by bearing of
South 26' 06' 57" East, a distance of 506.70' feet to a point, said
point being located on the northern right-of-way line of Westport
Drive; thence continuing along the northern right-Of-way line of
Westport Drive, by bearing of Souch 63' 53' 03" West, a distance of
393.20' feet to a point of curvature; thence continuing along the
Northern right-of-way of Westport Drive by a curve to the right, said
curve having a radius of 385,00 feet and an arc length of 263.62 feet
to a point; thence continuing along the same by bearing of North 76'
53' 01" West, a distance of 221.32' feet to a point of curvature;
thence continuing along the northern right-of-way line of Westport
Drive by a curve to the left, said curve having a radius of 435,00'
feet and an arc length of 250,54' feet to a point; thence continuing
along the same by bearing of South 70' 06' 59" West, a distance of
54.68' feet to a point, said point being the place of BEGINNING,
UNDER AND SUBJECT to restrictive covenants as recorded in
Miscellaneous Book 470, Page 169, and as amended by document recorded
in Miscellaneous Book 495, Page 706, Cumberland County Records.
BEING known as Lot No. 7-A on Preliminary/Final Subdivision Plan,
Phase 3 Westport recorded in Plan Book 70, Page 106, and the Land
Development Plan recorded in Plan Book 70, Page 107, Cumberland County
Records.
