Plaintiff, Howard Lehman. by his attorney, John D. Briggs, Esquire. files this Complaint. and
states the following:
PARTIES
I. Plaintiff. Howard Lehman. is an adult individual residing at 826 Fireside Road, York.
York County, Pennsylvania.
2. Defendant. Cardinal Freight Carriers, Inc. tldlbla Cardinal Freight Carriers, (hereafter,
collectively, Cardinal Freight Carriers) is a corporation with principal places of business located at -
975 Aurora Avenue, Aurora,l1Iinois 60506 and 5333 Davidson Highway. Concord, North Carolina
28027.
3. Defendant, Franklin Phillip Warda is an adult individual residing at 161 Campbell Mill
Road, Travelers Rest, South Carolina 29690 and/or 1417 Clearview Circle. Lenoir, North Carolina
28645,

OPERATIVE FACTS
4. At all times relevant hereto, Cardinal Freight Carriers acted by and through its
respective agents, servants and employees, all of whom were acting within the course and scope of
their employment.
5. At all times relevant hereto. the Defendant Franklin Phillip Warda was employed by
Cardinal Freight Carriers as a truck driver.
6. At all times relevant hereto, Defendant Warda was opemting and responsible for the
opemtion of a 1991 International Tmctor owned by Cardinal Freight Carriers, Inc..
7. At all times relevant hereto, Defendant Warda was in the course and scope of his
employment with Cardinal Freight Carriers, Inc.
8. On or about September 2. 1993. at approximately 6:25 p.m., Plaintiff Howard
Lehman was the opemtor of a 1992 Honda Gold Wing Motorcycle.
9. Plaintiffs vehicle was stopped at the stop sign in the eastbound lane of Route 114
in Upper Allen Township, Cumberland County. Pennsylvania.
10. At the aforesaid time and place, Defendant was traveling westbound on Route 114.
I I. At the aforesaid time and place, while tmveling westbound on Route I 14. Defendant
Warda attempted to make a left hand turn when his vehicle crossed over into Plaintiffs lane.
12. At the aforesaid time and place, the Defendant's tractor-trailer proceeded to collide
with Plaintiff when the Defendant's left rear tire struck the Plaintiffs wheel guard.

13. At the aforesaid time and place, the Plaintiff and his motorcycle were violently
thrown into the bank adjacent to the roadway.
14. As a result of the collision, Plaintiff sustained serious personal injuries including but
not limited to nondisplaced right rib fracture (#7), tibial tendinitis, acute cervical strain subluxation
of the LS, ataxia on the basis of cervical spondylosis myelopathy, ventral compression to the cervical
cord at CS-6, bloody nose, left shin abrasion, bruised left big toe, dizziness and various other ills and
injuries.
I S. As a result of the Defendants' negligence, Plaintiff sustained or may sustain the
following damages:
a. Past and future pain and suffering;
b. Past and future embarrassment, humiliation and mental anxiety;
c. Past and future incidental costs;
d. Past and future loss of life's enjoyment;
e. Past and future medical expenses, as may be recovered under the Motor Vehicle
Financial Responsibility Law,
COUNT I - NEGLIGENCE

16. Paragraphs I through IS of the Complaint are incorporated herein by reference as
though set forth in full.
17. At all times relevant hereto. Defendant Warda owed Plaintiff, Howard Lehman. a

b) failing to maintain reasonable and proper control of the vehicle he was operating;
duty of due care in the operation of the Cardinal Freight Carriers' tractor.
18. At all times relevant hereto. Defendant Cardinal Freight Carriers, owed a duty of due
care to others. including Plaintiff. Howard Lehman. to ensure the safety of its fleet. drivers and
vehicles.
19, Defendant Cardinal Freight Carriers is and was responsible for the actions of
Defendant Warda.
20. The accident and the injuries and damages sustained by the Plaintiff are the direct and
proximate result of the negligent. careless and reckless manner in which Defendant Warda acted or
failed to act in the following particulars:
a) failing to make reasonable and prudent observations of the conditions then
existing;
c) failing to keep his vehicle within his designated lane of travel;
d) failing to keep reasonable and proper attention to the roadway while operating the
vehicle;
e) making an unsafe turn within the intersection and/or roadway;
l) operating Defendants' tractor in violation of the Pennsylvania Motor Vehicle Code.
including Sections 3301. 3302. 3309 and 3334. Title 75 Pa.C.S.A.
21. The carelessness. recklessness and negligence of the Defendants. as described. was
the proximate cause of the collision and resulting injuries and damages sustained by Plaintiff.
WHEREFORE. Plaintiff Howard Lehman demandsjudgrnent against Defendant Franklin
Phillip Warda for compensatory damages in an amount in excess of the applicable arbitration limits

granted against Defendants, Franklin Phi1lip Warda and Cardinal Freight Carriers, Inc,
t/b/dla Cardinal Freight Carriers,
23, Plaintiffs own negligence was a substantial factor In the happening of the
accident if, In fact, the alleged accident occurred,
24, It is believed, and therefore averred, that discovery will show Plaintiff was
negligent and that his negligence exceeded the negligence. If any, of the Answering
Defendants, thereby barring Plaintiffs recovery by operation of the Pennsylvania
Comparative Negligence Act,
25, It Is believed, and therefore averred, that discovery will show Plaintiff was
negligent and that by virtue of his negligence, his claims may be limited by the operation of
the Pennsylvania Comparative Negligence Act,
26, It Is believed, and therefore averred, that discovery will show that Plaintiff
voluntarily assumed a known risk thereby barring recovery by the operation of the
Doctrine of Assumption of Risk,
27, Plaintiffs injuries, if any, and his alleged medical condition result from
natural or unknown causes and are not the result of any action or Inaction on behalf of the
Answering Defendants,
28, Defendant Franklin Philllp Warda had his vehicle under proper control at
all times material to this cause of action,
29, At all times material to this cause of action, Defendant Franklin Phll1ip
Warda operated his vehicle In a careful and prudent manner,
30, If the subject accident occurred as alleged by the Plaintiff, which is denied,
the subject accident was caused to occur by the negligence, recklessness or carelessness
of parties other than the Answering Defendants,
