between Ann E. Hay and Elwood T. Hay, Plaintiffs above, and Jacqueline Hetrick and Bethlee I.
Whitmire, Defendants,
WHEREAS, Defendant Jacqueline Hetrick is the nature mother of Eric James Hetrick, born
December 19, 1978; and
WHEREAS, Bethlee I. Whitmire and Joel L, Whitmire were granted custody of said child by
Defendant Jacqueline Hetrick by a Stipulation which was entered as a Court Order on October 7,
1993, a copy of said Stipulation attached hereto as Exhibit "A"; and
WHEREAS, Joel L. Whitmire is deceased; and
WHEREAS, Jacqueline Hetrick and Bethlee I. Whitmire can no longer provide for the
custody of said child; and
WHEREAS, Cumberland County Children and Youth Services declined to exercise care and
custody of said child if the Court Order contemplated by this Stipulation is entered; and
WHEREAS, Plaintiffs Ann E, Hay and Elwood T. Hay are willing and able to exercise
custody of said child; and
WHEREAS, Eric James Hetrick Is in agreement with the custodial arrangement anticipated
by this Stipulation,

NOW, THEREFORE, the parties stipulate as follows:
1. Ann E. Hay and Elwood T, Hay shall have legal and physical custody of Eric James
Hetrick, born December 19, 1978.
2. To give legal effect to the custody arrangement set out In this Stipulation, Plaintiffs
have filed a Complaint for Custody and the Defendants herein hereby acknowledge acceptance
of service of said Complaint.
3, As custodians, Ann E, Hay and Elwood T, Hay may seek, obtain and authorize any
medical treatment required by Eric James Hetrick,
4. The terms of this Stipulation shall become an Order of Court and shall supersede that
Order entered on October 7, 1993 providing primary physical and legal custody of Eric James
Hetrick to Joel L. Whitmire and Bethlee I, Whitmire.

THIS STIPULATION is made this 5th day of October, 1993, by and between JOEL 1..
WHITMIRE and BETIlLEE I. WHITMIRE, Plaintiffs in the captioned case, and JACQUELINE
HElRICK, Defendant.
WHEREAS, Defendant is the natural mother of Eric James Hetrick, born December 19, 1978
and
WHEREAS, the identity of said child's natural father is unknown to the parties; and
WHEREAS, Joel 1.. Whitmire and Bethlee I. Whitmire have been close family friends of
Defendant and the child for many years; and
WHEREAS, Jacqueline Hetrick desires that Joel L. Whitmire and Bethlee I. Whitmire shall
have custody of said child.
NOW THEREFORE, the parties stipulate as follows:
1. Joel 1.. Whitmire and Bethlee I. Whitmire shall have legal and physical custody of
Erie James Hetrick, born December 19, 1978.
2. To give legal effect to the custody arrangements set out in this stipulation, Joel 1..
Whitmire and Bethlee I. Whitmire have filed a Complaint for Custody, and Jacqueline Hetrick
hereby acknowledges acceptance of service of said Custody Complaint.
3. Joel 1.. Whitmire and Bethlee I, Whitmire may seek, obtain and authorize any and
all medical treatment required by Eric James Hetrick.
