COMPLAINT
AND NOW, comes Plaintiff, Kaye A. Ream, by and through her
attorney, Andrew C. Sheely, Esquire, and files this Complaint against
the named Defendant, an in support of thereof, avers as follows:
1. Plaintiff is Kaye A. Ream, an adult individual who presently
resides at 5234 Windsor Blvd, Mechanicsburg, Cumberland county, Pen-
nsylvania.

2. Defendant is Jack B. Cooper, Jr., an adult individual with a
principal place of business at 1 Cooper Circle, Carlisle, pennsylvania,
17013.
3. Defendant Jack B. Cooper, Jr. operates a paving-asphalt
business trading and doing business as Jack Cooper, Jr., Paving, at the
above-stated address.
4. On or about September 16, 1994, plaintiff and Defendant
signed a written contract entitled "contract, Proposal and Invoice"
(hereinafter referred to as "contract"), a copy of which is attached to
this complaint as Exhibit "A" and incorporated herein, the purpose of
which was that Defendant Jack B. Cooper, Jr., t/a and d/b/a Jack
Cooper, Jr. paving, would repair, clean, build and construct a new
driveway for Plaintiff at her home in Mechanicsburg, Pennsylvania.

5. In exchange for Plaintiff's agreement to pay Defendant Jack
B. Cooper, Jr., t/a and d/b/a Jack Cooper, Jr., paving, Nine Hundred
Dollars ($900.00), Defendant agreed to repair and clean an existing
driveway by constructing and building a new blacktop driveway at her
residence in a quality and workmanlike manner.
6. Defendant assumed full and sole responsibility for the execu-
tion and the completion of the contract work.
7. Defendant assumed sole responsibility for the substantial
construction and completion of the contract work in accordance with the
contract.
COUNT 1
BRBACH OF CONTRACT
8. Paragraphs 1 - 7 are hereby incorporated by reference as if
fully restated herein.
9. During all phases of construction and completion of the con-
tract, Defendant failed to complete the contract in a quality and
workmanlike manner consisting of numerous and obvious defects in the
construction and completion of the blacktop driveway, including:
a. failure to substantially complete and properly
install and construct the driveway to prevent water from
entering the Plaintiff's garagel and
b. failure to properly construct the driveway using
small stones which caused ridges and buckles to manifest in
the surface of the blacktop driveway I and
c. failure to properly grade the blacktop driveway

adjacent to Plaintiffs property and lawn creating a dangerous
and defective condition; and
d. failure to properly grade the blacktop driveway adjacent
to the public street causing a substantial rise in the street
causing a dangerous and defective condition; and
f. failure to properly remove the existing driveway to
allow for the construction of a new blacktop driveway which
would be constructed in level manner with plaintiff's exist-
ing garage and lawn; and
g. failure to properly construct and substantially
complete the blacktop driveway in a quality and workmanlike
manner, without unsite1y and undesirable appearance.
10. As a result of the aforesaid errors, omissions and defic-
iencies, Defendant Jack B. Cooper, Jr., t/a Jack Cooper, Jr., Paving,
breached the Contract.
11. Plaintiff sUbstantially fulfilled all her obligations pur-
suant to the provisions of the Contract attached as Exhibit "A".
12. As a result of Defendant's breach of the Contract, Plaintiff
will expend an amount of $1,565.00 in order to substantially complete
and repair the driveway in a quality and workmanlike manner, and
Defendant is liable to Plaintiff for the amount of $1,565.00
WHEREFORE, plaintiff, Kaye A. Ream, demands judgment against
Defendant, Jack B. Cooper, Jr., t/d/b/a Jack Cooper, Jr., Paving, in a
sum of $1.565.00, plus interest and court costs, and that an Order be
entered directing that the above-captioned matter be referred to
arbitration under the local rules of Court.
