WAIVER OF RIGHT TO FILE MECHANICS' LIENS
WHEREAS, ROBERT J, HOFMANN and MARGO L, HOFMANN, Owner(s),
of 621 Wildwood Road, Carlisle, PA 17013, entered into a
contract with MARHOFF DESIGNER HOMES, Contractor, of 621 Wildwood
Road, Carlisle, PA 17013, to provide materials and perform labor
necessary for the construction of a dwelling house upon a tract
of land situate in Lower Frankford Township, Cumberland County,
Pennsylvania, more particularly bounded and described as follows:
SEE ATTACHED EXHIBIT "A"
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties, as part of the said contract and for
the consideration therein set forth, that neither the undersigned
Contractor, any subcontractor or material man, nor any other
person furnishing labor or materials to the said Contractor under
his contract, shall file a lien, commonly called a mechanics'
lien, for work done or materials furnished to the said building,
improvements or any part thereof.
THIS STIPULATION is made and intended to be filed with the
Cumberland County Prothonotary within ten (10) days after date,
in accordance with the requirements of Act of Assembly of
Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties hereto, intending to be
legally bound hereby, have hereunto set their hands and seals
this 7th day of September, 1995.

thence along land now or formerly of Edward Ray Walters South 280

(Wildwood Road); thence along the centerline of said Road North

a curve to the left with a radius of 282.21 feet an arc distance
of 213;24 feet to a point; thence along the same North 480 17'
09" West 70.09 feet to a pin in the centerline of Township Road
T-449 (Wildwood Road), the point and place of BEGINNING.

CONSIS~ING of 13.0765 acres and being Lot No.4 on the Final
subdivision Plan for Robert J. and Margo L. Hofmann recorded in
the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Plan Book 70, Page 79.
BEING the same premises which Robert John Hofmann by his deed
dated September 7, 1995, and recorded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania, in
Deed Book , Page , granted and conveyed to Robert J.
Hofmann and Margo L. Hofmann, his wife, Mortgagors herein.
