AMENDED COMPLAINT
1. The plaintiff, DOROTHY M. ELDER, is an individual reeiding
at 12 Circle Drive, Mechanicsburg,Cumberland County, Penna.
2. The defendant, Christopher Holland, is an individual
reeiding at 908 Second St., New Cumberland, Cumberland County, Pat
17070.
3. On November 18, 1994, the plaintiff was the owner of a
1994 Buick Gran Sport.
4. At or about 3130 P.M. on the aforeeaid date, the plaintiff
wae operating the eaid Buick in a northern direction on South Third
Street in Lemoyne, Pa. Shippeneburg, Pa.
S. At the same time and place, the defendant, Chrietopher
Holland, wae operating a 1983 Buick Century, when he attempted to
make a left hand turn onto South Third Street in Lemoyne, and he
collided with the plaintiff's vehicle.
6. The collie ion wae caueed by the negligence of the
defendant in the following reepectsl
a. In failing to wait for traffic to clear before turning
left onto South Third Street.
b. In failing to keep a proper lookout.
c. In failing to operate,hie vehicle in a safe and prudent
manner.
7. A8 a reeult of the negligence of the defendant, the
plaintiff euetained $3,138.70 in damagee to her eaid Buick, ae ie
~re fully eet forth in the attached Bxhibit A.
8. A8 a reeult of the negligence of the defendant, the
plaintiff euetained $368.00 in car rental, as ie more fully eet
forth in the attached Bxhibit B.
9. In addition, the insured had $242. S9 in out-of-pocket
rental and $200.00 in deductible.
WHBREFORE, the plaintiff claime of the defendante a eum of
$3,949.29, an amount requiring compulsory referral to arbitration
under the local rulee of court.
