L .z I.D, #35956 4503 N, Front Street Harrisburg, PA 17110 (717) 238-6791 Counsel for Plaintiffs 10211 q/MTG POINT FOR CHARGE NO, 1 In this case, the defense has stipulated that Ms. Lugaro negligently operated her motor vehicle and is therefore liable to Mr. and Mrs. Nuschke for the damages you believe they sustained in the subject motor vehicle accident. POINT FOR CHARGE NO, 2 Given the stipulation that Ms. Lugaro was negligent, you must find an amount of money damages which you believe will fairly and adequately compensate Mrs. Nuschke for the amount of damages she sustained as a result of the accident. The amount you award her today must compensate her completely for damages sustained in the past, as well as damages she may sustain in the future. Pa. SSJI (Civ,) ~6.00 - Damages. POINT FOR CHARGE NO, 4 Mrs, Nuschke is entitled to be fairly and adequately compensated for such physical pain, mental anguish, discomfort, inconvenience, and distress as you find she has endured from the time of the accident until today. POINT FOR CHARGE NO. 5 Mrs. Nuschke is entitled to be fairly and adequately compensated for such physical pain, mental anguish, discomfort, inconvenience and distress as you believe she will endure in the future as a result of her injuries, Pa. SSJI (Civ.) ~6.01F - Future Pain and Suffering. POINT FOR CHARGE NO, 6 In evaluating the amount to be awarded for pain and suffering, you should consider that the infliction of pain means taking from a person what is her own to possess and retain -- namely, health and well-being -- and that the law allows for compensation of this loss to the extent that that loss may be calculated in monetary damages. In arriving at any award for pain and suffering which Mrs, Nuschke has undergone, you must also consider the extent to which her injuries have resulted in a loss or lessening of her ability to enjoy life and life's pleasures and the ability to engage in various other activities which she enjoyed prior to the accident. DiChiacchio v. Rockcraft Stone Products Co., 424 Pa. 77, 85, 225 A,2d 913 (1967); Corcoran v, McNeal, 400 Pa. 14, 26, 161 A.2d 367 (196); and Carminati v, philadelohia Transo. Co" 405 Pa, 500, 176 A.2d 440 (1962). POINT FOR CHARGE NO, 7 Fear for one's future emotional and physical well-being is another element of pain and suffering. This is true of the emotional reaction in the past. as well as worry, apprehension or concern oyer future possibilities. Walsh y. Brody, 220 Pa. Super. 293, 286 A.2d 666 (1971). POINT FOR CHARGE NO.8 Mrs, Nuschke is entitled to be fairly and adequately compensated for such embarrassment and humiliation as you believe she has endured and will continue to endure in the future as a result of her injuries. POINT FOR CHARGE NO, 9 Mrs. Nuschke is entitled to be fairly and adequately compensated for the past, present, and future loss of her ability to enjoy any of the pleasures of life as a result of her injuries, Pa, SSJI (Civ,) ~6.01I - Enjoyment of Life. POINT FOR CHARGE NO. 10 If you find that Mrs. Nuschke's injuries will continue beyond today, you must determine her li fe expectancy, According to statistics compiled by the United States Department of Health, Education, and Welfare, the average life expectancy of all persons of Mrs. Nuschke's age at the time of the accident, sex, and race was 45.4 years. This figure is offered to you only as a guide, and you are not bound to accept it if you believe that Mrs. Nuschke would have lived longer or less than the average individuals in her category. In reaching this decision, you are to consider Mrs, Nuschke's health prior to the accident, her manner of living, her personal habits and other facts that may have affected the duration of her life. Plaintiffs Melissa and David Nuschke, citizens of the Commonwealth of Pennsylvania, are husband and wife, adult individuals who reside in Boiling springs, Cumberland County, Pennsylvania. 2. Defendant Luz Maria Lugaro is an adult individual and citizen of the Commonwealth of Pennsylvania who resides at 38 Central Blvd., Camp Hill, cumberland County, Pennsylvania 17011. 3. The facts and occurrences hereinafter related took place on or about November 15, 1993, at approximately 3:52 p,m, on State Route 11 (Carlisle Pike), cumberland County, Pennsylvania. 4. At that time and place, Mrs. Nuschke was operating her motor vehicle, a 1988 Mazda 626, in an easterly direction on the Carlisle Pike. 5. At that time and place, Defendant Lugaro was operating a 1987 Oldsmobile, also traveling East on the Carlisle Pike. I: II " II I' II ,I II " " 6. Defendant Luqaro did not see Mrs. Nuschke'. vehicle come to a complete stop in the line of traffic and Defendant Luqaro i, ii li 1 permitted her vehicle to collide into the rear of Mrs. Huschke's stationary vehicle, 7. The foregoing accident and all of the injuries and damages set forth hereinafter sustained by Plaintiffs Melissa and David Huschke are the direct and proximate result of the negligent, careless, wanton and reckless manner in which Defendant Lugaro operated her motor vehicle as follows: a. failure to have his vehicle under such control as to be able to stop within the assured clear distance ahead; b. failure to keep alert and maintain a proper watch for the presence of other motor vehicles on the highway; c. failure to apply his brakes in sufficient time to avoid striking the rear of Plaintiff's vehicle; d. failure to travel at a safe speed; e. the highway; f. failure to drive her vehicle with due regard for the highway and traffic conditions which were existing and of which he was or should have been aware; failure to keep a proper watch for traffic on g. failure to keep proper and adequate control over his vehicle; and h. driving her vehicle upon the highway in a manner endangering persons and property and in a reckless manner with careless disregard to the rights and safety of others and in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania, CLAIM I Meli8sa Huschke v. Luz Maria Luaaro 8. Paragraphs 1 through 7 of the Complaint are incorporated herein by reference. 2 9. Plaintiff Melissa Nuschke sustained painful and severe injuries which include ~ut are not limited to cervical pain, shoulder pain, constant and frequent headaches. 10. By reason of the aforesaid injuries sustained ~y Mrs, Nuschke, she was forced to incur lia~ility for medical treatment, medications, physical therapy, and similar miscellaneouS expenses in an effort to restore herself to health, and claim is made therefor, 11, Because of the na~ure of her injuries, Mrs, Nuschke has ~een advised and, therefore, averS that she may ~e forced to incur similar expenses in the future, and claim is made therefor, 12. As a result of the aforementioned injuries, MrS, Nuschke has undergone and in the future may undergo physical and mental suffering, inconvenience in carrying out her daily activities, losS of life's pleasures and enjoyment, and claim is made therefor. \ \ " II \i 1\ II II \1 I' :\ 1:\ 13. As a result of the aforesaid injuries, Mrs, Nuschke has ~een and in the future may ~e su~ject to humiliation and em~arrassment, and claim is made therefor. 14, As a result of the aforementioned injuries, Mrs, Nuschke has sustained uncompensated work losS, loSS of opportunity and she may sustain a permanent diminution of her earning power and capacity, and claim is made therefor. 15, Mrs. Nuschke continues to be plagued ~y persistent pain and limitation and, therefore, avers that her injuries may ~e 3 i \ I \ \ \ I I I I I I i I I I \ of a permanent nature, causing residual problems for the remainder of her lifetime, and claim is made therefor. As a result of the aforementioned injuries sustained by his wife, Plaintiff Melissa Huschke, Plaintiff David Huschke has been and may in the future be deprived of the care, companionship, consortium, and society of his wife, all of which will be to his great detriment, and claim is made therefor. WHEREFORE, Plaintiffs Melissa and David Huschke demand judgment against Defendant Luz Maria Lugaro in an amount in excess of Twenty-five Thousand Dollars ($25,000,00), exclusive ot interest and costs and in excess of any jurisdictional amount requiring compulsory arbitration.
