AND NOW, this day of December, 1995, this Court
certifies that the attached complaint has been properly completed
and verified, and there is probable cause for the issuance of
process. In consideration of the attached Commonwealth's
Petition, a WARRANT IS ISSUED FOR THE ARREST of the Defendant,
JERRY A. BIRT, JR..
If the defendant is found during normal Courthouse hours,
the defendant is to be brought immediately before the Court. If
not found during Courthouse hours, the defendant is to be taken
to the on-call District Justice and bail set pursuant to the
Rules of Criminal Procedure. Furthermore, after appearing before
the District Justice the defendant is advised to appear before
the Court Administrator at the open of the next business day.
Defendant has a right to be represented by an attorney. If
the defendant cannot afford an attorney, upon request one will be
assigned to represent the defendant. The assessment of costs to

COMMONWEALTH'S PETITION FOR A HEARING ON CHARGES
OF INDIRECT CRIMINAL CONTEMPT
Thomas A. Placey, Senior Assistant District Attorney of
Cumberland County, Pennsylvania brings the following Petition for
a hearing on charges of Indirect Criminal Contempt:
1. A Protection from Abuse Order was issued by the Court.
A true and correct copy of the Order is attached.
2. The defendant's violation of this Order is averred in
the attached private criminal complaint.
3. The victim requests the filing of an Indirect Criminal
Contempt charge upon information received.
4. The District Attorney's Office approves the filing of
this private criminal complaint.
5. The Commonwealth is requesting a trial on the charges
of Indirect Criminal Contempt pursuant to 23 Pa.C.S.A. 56113.
6. The plaintiff and the defendant may seek modification
of the Order based on the filing of this petition as the Court
deems appropriate following the trial in addition to any other
sentence. 23 Pa.C.S.A. 56117.
WHEREFORE, the Commonwealth requests the defendant be
commanded to appear before the Court on the charge of Indirect
Criminal Contempt.

On the above date and time the defendant did enter onto the victim's
property. The defendant was observed by this officer in his vehicle, a
1963 Ford mustang. The defendant was asleep. There was an opened beer bottle
on the hood of the defendant's vehicle. There were additional beer bottles
in the vehicle (Budwiser). The defendant appeared to be intoxicated.
The defendant was ordered to stay away from the victim's residence by
Judge George E. HOFFER, on 09/22/95. NO 95-4695.

enjoined from physically abusing the plaintiff, Lisa M, Birt, or placing her in
fear of abuse,

located at 602 Baltimore Road, Shippensburg, Cumberland County, Pennsylvania, a
residence to which the plaintiff Ilnd the minor children moved to avoid abuse,

I. The plaintiff, Lisa M, Rirt, is an adult individual residing at 602
Baltimore Road, Shippensburg, Cumberland County. Pennsylvania 17257,

an adult individual residing at 16 Enola Road, Newburg, Cumberland County,

3, The defendant is the husband of the plllintiff and the father of the
parties' three children,
4. Since Ilpproximlltely 1992, the defendant has attempted to cause and
has intentionally, knowingly, or recklessly caused hodi ly injury to the
plaintiff, has placed the plllintiff in reasonable fear of imminent serious bodily
injury, and has knowingly engaged in II course of conduct or repeatedly cOlllllitted
acts toward the plllintiff. under circumstances which have placed the plllint iff
in reasonahle fear of bodily injury. This has im:luded, but is not limited to,

and wires from the distrihutor of her vehicle, then left the house

at the house unti I her vehicle could he towed, The plaintiff feared
for her slIfety and had an emergency Protection Order issued through
Oistrict Justice Oaihl on Septemher I, 1995, which WIlS in place
through September 5, 1995,
