1. I, susan smith, am the defendant in the above-captioned
action, which is an appeal from a judgment rendered by District
Justice susan Day on August 15, 1995, awarding plaintiff
possession of the apartment in which I reside and alleged back
rent.
2. The rent for my apartment, located at 22 East street,
#3, Mt. Holly springs, Cumberland county, pennsylvania, is
$229.00 per month, and becomes due on the 1st day of each month.
3. My next rent payment will be due on or before the 1st
day of october, 1995.
4. I verify that the statements made in this Affidavit are
true and correct. I understand that false statements herein are

COMPLAINT
1. Plaintiff is RICHARD F. BOMBERGER, an adult individual
who currently resides at 21 East street, Mt. Holly springs,
Cumberland County, Pennsylvania, 17065.
2. Defendant is SUSAN D. SMITH, an adult individual who
currently resides at 22 East street, Apt. 3, Mt Holly springs,
Cumberland County, Pennsylvania, 17065.
3. By Lease entered into April 1, 1995, plaintiff and
Defendant executed a Lease for the premises owned by Plaintiff
and known and numbered as 22 East Street, Apt. 3, Mt. Holly
Springs, Cumberland County, Pennsylvania. This Lease was for a
term of one year to commence on April 1, 1995, and a copy of this
Lease is attached hereto and incorporated herein as Plaintiff's
Exhibit "A".
4. By Notice dated July 24, 1995 and served on Defendant by
certified mail, return receipt requested on July 25, 1995
plaintiff gave Defendant notice to vacate the above-described
premises. The reasons given in said Notice, which is attached
hereto and incorporated herein as Plaintiff's Exhibit "B", were
Defendant's failure to pay rent due for the month of July, 1995,
as well as the fact that Defendant was allowing two men to reside
in the apartment with her.
5. During the months of July, August and September of
1995, and even prior thereto, Defendant has allowed Brian Peiffer
to reside in the apartment with her. In addition, during July
and August Defendant allowed her brother, Michael Smith, to
reside in the apartment with her, although it appears that
Michael Smith has moved out of said apartment.
6. Paragraph 11 of the Lease prohibits Defendant from
subleasing the premises or permitting additional individuals to
occupy the premises. Defendant has been in violation of this
provision of the Lease since early July, 1995.
7. Commencing with the month of July, 1995 and continuing
each month thereafter, Defe~dant has refused to pay her rental
payments to Plaintiff. Defendant is assisted in her rental
payments by the United States Department of Housing and Urban
Development, but nevertheless Defendant has refused to tender her
share of said rental payments to Plaintiff.
8. Defendant's share of the rental payment is $229.00 per
month, and she has not paid for the months of July, August and
September, 1995. In addition, the Lease provides for a 10% late
fee if rental payments are not made on or before due date,
namely, the first day of each month. Defendant thereby is
indebted to Plaintiff for $755.70, as well as for any and all
rental payments and late charges not made for months after
september of 1995 if Defendant continues to occupy the premises.
9. Despite demands by Plaintiff, Defendant has refused to
pay Plaintiff the rent due and owing to him.
10. Plaintiff's notice to vacate the premises was
consistent with Paragraphs 21 and 27 of the Lease. Moreover,
Plaintiff apprised the appropriate HUD representative of the
contents of the notice to vacate as well as the commencement of
these legal proceedings.
11. Defendant has refused to remove herself from the
apartment in accordance with the notice to vacate. Defendant has
violated the terms of her Lease with Plaintiff and provided
Plaintiff with good cause to evict her.
WHERBFORE, Plaintiff respectfully requests that this
Honorable Court:
(al Enter a judgment in his favor and against Defendant
for possession of the premises known as 22 East street, Apt.
3, Mt. Holly Springs, Cumberland County, Pennsylvania;
(bl Enter judgment in Plaintiff's favor and against
Defendant for $755.70, the amount of rent and late charges
due and owing at the present time, together with all other
rental amounts becoming due during the pendency of this
proceeding; and
(cl Enter judgment in Plaintiff's favor and against
Defendant for all costs of this action.

Comes now the defendant, Susan D. Smith, by counsel, Philip
c. Briganti, Esquire, Legal Services, Inc., and as her Answer to
the plaintiff's Complaint, states as follows:
1. Admitted.
2. Admitted.
3. Admitted in part and denied in part. Defendant admits
that she executed the Lease Agreement attached to Plaintiff's
Complaint as Exhibit "A", and that the Lease states that the
lease term is for a period of one y~ar, commencing on April 1,
1995. However, Defendant denies that the parties actually
entered into the Lease Agreement on April 1, 1995, but rather
avers that the Lease was not signed by the parties until April
15, 1995.
4. Admitted in part and denied in part. Defendant admits
that Plaintiff served upon her the Notice attached to Plaintiff's
Complaint as Exhibit "B", in the manner described in Plaintiff'.
Complaint. However, Defendant denies that she failed to pay rent
for the month of July, 199~, and that she was allowing two men to
reside in the apartment with her. Also, to the extent it is
implied, Defendant denies that this Notice is a legally
sufficient notice to quit under Pennsylvania law.
5. Denied. Defendant denies that she has allowed Brian
Peiffer or Michael Smith to reside in the apartment with her.
6. Denied. Although the language in Paragraph 11 of the
Lease purports to prohibit Defendant from subleasing the premises
or permitting additional individuals to occupy the premises, this
provision is in violation of the Plain Language Consumer Contract
Act (73 P.S. Section 2201 ~ ~.) and is not enforceable.
However, even if this provision were enforceable, Defendant
denies that she has been in violation of it since early July,
1995.
7. Admitted in part and denied in part. Defendant admits
that she is assisted in her rental payments by the U.S.
Department of Housing and Urban Development (HUD), but denies
that she has refused to tender her share of said rental payments
to Plaintiff. Defendant further denies that commencing with the
month of July, 1995, and continuing each month thereafter, she
has refused to pay her rental payments to Plaintiff. By way of
further Answer, Defendant avers that her July rent was pre-paid
on her behalf by the Salvation Army'S rental assistance program
on or about June 8, 1995. Moreover, her August 1995 rent was
offset by a rent overpayment she and HUD made to Plaintiff in
April 1995, when rent was paid for the entire month but she did
not take possession of the premises until on or about April 15,
1995, when the lease was signed. Defendant's share of the
Sept..ber 1995 rent and October 1995 rent has been paid into
escrow with the Prothonotary, as required by Rule 357 of the
Cumberland County Rules of Procedure.
8. Admitted in part and denied in part. Defendant admits
that her share of the rent was $229.00 per month through
September, 1995, but avers that it was reduced to $107.00 per
month effective October 1, 1995. She denies that she has not
paid her rent for July, August and September, 1995, and
incorporates by reference her averments set forth above in
Paragraph 7. Defendant admits that the Lease provides for a 10%
late fee if rental payments are not made on or before the due
date. However, as set forth below in her New Matter, she
contends that the late fee provisions in the Lease are not
enforceable. Defendant denies that she is indebted to Plaintiff
for $755.70. Defendant admits that Plaintiff is entitled to
rental payments for months after September, 1995 if Defendant
continues to occupy the premises, but denies that he is entitled
to late charges.
9. Denied. Defendant repeats and incorporates by reference
her averments set forth above in Paragraphs 7 and 8.
10. Admitted in part and denied in part. Defendant denies
that Plaintiff's notice to vacate was consistent with Paragraph
21 of the lease, and asserts that it was not an adequate notice
under the terms of the Lease or under Pennsylvania law.
Defendant admits that the purported notice was served on her by
certified mail, consistent with Paragraph 27 of the Lease.
However, as set forth below in her New Matter, Defendant avers
that the notice provisions of the lease are invalid, in that they
violate the Plain Language Consumer Contract Act and do not serve
to waive the notice procedures required by 68 P.S. section
250.501. Defendant admits that Plaintiff apprised the
appropriate HUD representative of the contents of the purported
notice as well as the commencement of these legal proceedings.
11. Admitted in part and denied in part. Defendant admits
that she has refused to remove herself from the apartment, but
denies that her refusal is not in accordance with the purported
notice to vacate, which does not require her to vacate the
premises. Defendant denies that she has violated the terms of
her Lease with Plaintiff and provided Plaintiff with good cause
to evict her.

I. Violation of the Plain Lanauaae Con.uaer Contraot Aot
12. The parties' written Lease, which is attached to
Plaintiff's Complaint as Exhibit "A" and incorporated herein by
reference, is a "consumer contract" within the meaning of the
Plain Language Consumer Contract Act, 73 P.S. Section 2201 ~
jUlg. (hereinafter: "PLCCA").
13. The parties' Lease, in its entirety, violates the
PLCCA's "test of readability" set forth under 73 P.S. Section
2205.
14. Specifically, Paragraph 11 the Lease (relating to use
and occupancy of the premises) and Paragraph 21 (relating to
waiver of Defendant's rights in the eviction process) do not
comply with the PLCCA's "test of readability" because these
provisions:
a. fail to use short words, sentences, and paragraphs
b. use technical legal terms which are not commonly
understood, and use sentences that contain more than one
condition and\or double negatives
c. have type size, line length, column width, margins and
spacing between lines and paragraphs which make the lease
difficult to read
d. are printed in ink that does not contrast sharply with
the paper
e. do not have a statement that adequately informed
Defendant that her rights in this residential lease were being
waived
f. are not generally written, organized or designed so that
they are easy to read and understand
15. Paragraph 27 of the parties' Lease (relating to service
of notices) also violates the PLCCP's test of readability, in
that it does not contain a clear statement that Defendant's right
to other types of service under the Landlord and Tenant Act of
1951 were being waived, it is buried in the contract in an
obscure location, and it is printed in ink that does not contrast
well with the paper.
II. Deaurrer - I~roDer Motic.
16. Defendant repeats and incorporates by reference her
averments set forth above in Count I of her New Matter.
17. Defendant did not knowingly or intelligently waive any
of her rights as a tenant to a notice to quit and proper service
thereof, as set forth under 68 P.S. section 250.501.
18. As set forth in Paragraph 4 of plaintiff's complaint,
on July 25, 1995, plaintiff served Defendant with a written
notice to vacate the premises by certified mail rather by
personal service, posting, or leaving the notice at a principal
building on the leased premises, in violation of 68 P.S. section
250. SOL
19. Moreover, plaintiff's notice to quit, which is attached
to plaintiff's complaint as Exhibit "B" and is incorporated
herein by reference, states that Defendant had until July 30,
1995, only five days after service of the notice, to vacate the
premises, rather than fifteen days, as required by 68 P.S.
section 250.501 in cases where the landlord is alleging
nonpayment of rent as a ground for eviction.
20. In addition, plaintiff did not wait the requisite
fifteen days after service of the notice before commencing
eviction proceedings against Defendant, pursuant to 68 P.S.
250.501, but instead filed a Landlord and Tenant complaint before
District Justice susan K. Day on August 1, 1995.
21. The instant case is an appeal from a judgment rendered
by District Justice Day in the above-described action on August
15, 1995.
22. plaintiff has failed to comply with the notice
requirements set forth under 68 P.S. Section 250.501. and
therefore has failed to state a claim for which relief can be
granted.
III. Laok of Jurisdiotion
23. Defendant repeats and incorporates by reference the
averments set forth in Counts I and II of her New Matter.
24. Because of Plaintiff's failure to comply with the
requirements of 68 P.S. 250.501 before filing an eviction action
against Defendant, District Justice Day did not have, and this
Court does not have on appeal, jurisdiction over the subject
matter of these proceedings.
IV. Late Pee provisions are Unenforoeable
25. Paragraph 4 of the Lease provides that "tal penalty of
lOt late fee will be imposed on rents not paid on or before --due
date." See Plaintiff's Exhibit "A".
26. This late fee provision is unenforceable as a penalty,
in that the fees it purports to require are excessive, and bear
no reasonable relationship to Plaintiff's actual or reasonably
anticipated losses occasioned by the late payment of rent.
WHIR.PO.., Defendant requests that Plaintiff's complaint be
dismissed and the relief requested by Plaintiff be denied, and
that Defendant be awarded such other and further relief as this
Court may deem reasonable and just.

Violation of the Plain Lanauaae Consuaer Contract Act
27. Defendant repeats and incorporates by reference the
averments set forth in Count I of her New Matter.
WHIRBFORB, pursuant to 73 P.S. Section 2207, because
Plaintiff failed to comply with the test of readability set forth
under Section 5 of the Plain Language Consumer Contract Act (73
P.S. Section 2205), Defendant respectfully requests that this
Court enter judgment in her favor and against Plaintiff for
statutory damages in the amount of $100.00 and court costs, and
for the reasonable attorney's fees of Defendant's counsel in
pursuing this claim.

12. Denied. This is a conclusion of law to which no
response is required.
13. Denied. This is a conclusion of law to which no

14. Denied. The relevant provisions of Paragraphs 11 and 21
of said Lease meet the test of readability and are otherwise not
deficient as alleged in subparagraphs a. through f. Paragraph
11(b.) plainly and legibly states that the lessee shall not "....
sublease the demised premises." Moreover, Paragraph 40 of the
Rider plainly states that "No overnight guest or geusts [sic]
allowed". This language enabled Defendant to understand her
obligations in this regard.
Similarly Paragraph 21 plainly and legibly states that "
Lessee specifically waives the right ..." to the statutory
notice to quit and "... agrees that five (5) days notice shall be
sufficient in either or any such case." Once again, this
language enabled Defendant to understand her obligations in this
regard.
15. Admitted in part and denied in part. It is admitted
that Paragraph 27 makes no specific reference to a waiver of
other types of service under the Landlord and Tenants Act.
However, it is denied that this paragraph violates the test of
readability, is buried in an obscure location or is not printed
in dark enough ink. To the contrary, this paragraph plainly and
legibly states that all notices are to be by certified mail,
which language enabled Defendant to understand her rights and
obligations with regard to service of any notices.
16. Plaintiff repeats and incorporates by reference his
responses as contained in Paragraph 12 through 15, supra.
17. Denied. This is a conclusion of law to which no
response is required. Moreover, Defendant's execution of the
Lease constituted a knowing and intelligent waiver of these
rights.
18. Admitted.
19. Admitted in part and denied in part. It is admitted
that Plaintiff's notice to quit afforded to Defendant five days
to vacate. It is denied that Defendant was entitled to 15 days
notice - by executing the Lease Defendant waived this right.
(see Paragraph 21 of said Lease).
20. Admitted in part and denied in part. It is admitted
that the Complaint was filed on August 1, 1995. However, for the
reasons stated in Paragraph 19, supra, it is denied that
Plaintiff was required to wait 15 days.
21. Admitted.
22. Denied. This is a conclusion of law to which no
response is required.
23. Plaintiff repeats and incorporates by reference his
responses as contained in Paragraphs 12 through 15 and 17 through
22, supra.
24. Denied. Plaintiff did comply with the notice
requirements, as waived by the Lease, and thus this Honorable
Court does have jurisdiction on appeal.
25. Admitted.
26. Denied. A landlord who does not receive rental payments
on time can suffer the following losses:
(a) said landlord will not have the ability to timely
make his mortgage payments, pay taxes, etc., thereby causing
him to incur penalties;
(b) said landlord will lose interest on monies that
would have been deposited into a bank account; and
(c) said landlord will have to devote time and money to
contacting the delinquent tenant in an attempt to secure
payment.
For these reasons it is manifest that the 10% late charge is
a reasonable measure of liquidated damages, not a penalty, and
thus it is an enforceable provision of the Lease.
WHBRBFORE, Plaintiff reiterates his demands as alleged in
the prayer for relief at the end of his Complaint.
ANSWER TO COUNTERCLAIM
27. Plaintiff repeats and incorporates by reference his
responses as confined in Paragraphs 12 through 15, SUDra.
WHEREFORE, Plaintiff requests that Defendant's counterclaim
be dismissed and the relief requested by Defendant be denied.
