AND NOW, TO WIT, this
day of September, 1995, comes
the Plaintiff, HARRISBURG GLASS COMPANY, by and through the Law
Firm of Kain, Brown & Roberts of 119 East Market Street, York,
Pennsylvania, upon a cause of action of which the following is a
statement:
COUNT I
1. That the Plaintiff is HARRISBURG GLASS COMPANY, a
corporation organized and existing under the laws of the
Commonwealth of Pennsylvania, with its principal place of business
at 444 Railroad Avenue, Shiremanstown, Cumberland County,
Commonwealth of Pennsylvania, and hereinafter sometimes referred to
as "PLAINTIFF".
2 . Tha t the De f endan tis CUMBERLAND GROUP, LIMITED, a
corporation organized and existing under the laws of the
Commonwealth of Pennsylvania, with its principal place of business
at 1707 South Cameron Street, City of Harrisburg, Dauphin County,
Commonwealth of Pennsylvania, and hereinafter sometimes referred to
as "DEFENDANT".
3. That during the following period of time, the Defendant,
through its authorized agents, requested of the Plaintiff, orally
and in writing, through Defendant's authorized agents, to purchase
from the Plaintiff certain goods, wares and merchandise: November
22, 1993 through March 31, 1995.
4. That the Defendant, through its authorized agents, orally
and in writing, promised to pay to the Plaintiff the usual and
reasonable market price for said goods, services, wares and
merchandise charged by the Plaintiff.
5. That the Plaintiff, through authorized agents, accepted
the Defendant's offers to purchase certain goods, services, wares
and merchandise at the usual and reasonable market price charged by
the Plaintiff in Cumberland County.
6. That pursuant to the requests and offers of the
Defendant, through its authorized agents, the Plaintiff did send
and deliver to the Defendant at Defendant's principal place of
business, and at other locations designated by Defendant, the said
goods, services, wares and merchandise requested by the Defendant.
7. That attached hereto, marked Exhibit "A" and incorporated
herein by reference, is an itemized list of charges, credits and
demands made by the Plaintiff to the Defendant for the goods,
services, wares and merchandise requested and ordered by the
Defendant and delivered by the Plaintiff to the Defendant showing
a balance due and owing of $27,320.05.

8. That from time to time, the Plaintiff, through authorized
agents, has made demand upon the Defendant by presenting to the
Defendant various statements and bills for the payment of the usual
and reasonable market price for the said goods, services, wares and
merchandise for which the Defendant agreed to be obligated, but the
Defendant persistently and willfully refused to pay the balance due
and owing to the Plaintiff.
9. The orders and contracts referred to in Averments 3
through 6 were made in Cumberland County, Commonwealth of
Pennsylvania.
10. The attachments contained in Exhibit "A" of this
Complaint evidence:
a. Each and every order and request made by Defendant
through its authorized agent;
b. The date of each request and order; and,
c. The amount of each request and order.
11. Defendant, through its authorized agents, also agreed to
be liable for interest on each unpaid invoice listed in and copy of
which is contained in Exhibit "A" at the rate of 1-1/2% per month
with interest beginning to accrue thirty (30) days from each
invoice date.
12. The total interest due Plaintiff on the outstanding
invoices listed in Exhibit "A" is $3,248.78 as of August 31, 1995.
13. Attached hereto, marked Exhibi t "B" and incorporated
herein by reference is a detailed accounting of the interest due
Plaintiff by Defendant on each invoice.

14. Additionally, Defendant, through its authorized agent,
agreed to be liable for an attorney's fee of twenty-five (25%)
percent of the amount of each invoice if Plaintiff was required to
initiate legal action to collect each invoice, with the total legal
fees being due of $6,830.01.
WHEREFORE, the Plaintiff demands judgment against the
Defendant as follows:
(1) Outstanding Invoices
(2) Interest to 08/31/95
(3) Legal Fees
(4) Total

COUNT II
15. Paragraphs 1 through 14 inclusive are hereby incorporated
herein by reference thereto.
16. That the said orders requested by the Defendant through
the Defendant's's authorized agents were made pursuant to and under
the Uniform Commercial Code of the Commonwealth of Pennsylvania
(l2A P.S. l-lOl, et seq.).
WHEREFORE, the Plaintiff demands judgment against the
Defendant as follows: $27,320.05, plus interest at the legal rate
and costs of suit. The total interest from date of invoice to
08/31/85 at legal rate is $1,082.83, as set forth in Exhibit "C".
COUNT III
17. Paragraphs 1 through 16 inclusive are hereby incorporated
herein by reference thereto.

18. That during the following period of time, the Defendant,
through its authorized agents, at various times, requested of the
Plaintiff to deliver to the Defendant certain goods, services,
wares and merchandise: November 22, 1993 through March 31, 1995.
19. That the Plaintiff, through authorized agents, did send
and deliver certairl goods, services, wares and merchandise to the
principal place of business of the Defendant or at location
designated by Defendant.
20. That by reason of the failure of the Defendant to pay to
the Plaintiff the sum which the Plaintiff had demanded of the
Defendant, a sum equal to the fair market value of the goods, the
Defendant has been and continues to be unjustly enriched to the
extent of such unpaid amount, plus lawful interest upon such
amount.
WHEREFORE, the Plaintiff demands judgment against the
Defendant as follows: $27,320.05, plus interest at legal rate and
costs of suit. Total interest at legal rate from date of invoice
to 08/31/95 is $1,082.93. See Exhibit "C".
