Floyd G. Peck, pursuant to the Mechanics' Lien Law of 1963
P.L.1175 No. 497 Sec. 503(49P.S.1503) files this claim of lien as
a contractor against Robert D. Brennan and Eileen M. Brennan,
husband and wife, the owner of and against the building and
premises herein described and the curtilage appurtenant thereto
for the debt of $12,622.00, together with lawful interest from
June 29, 1994, due to him as contractor in erection and
construction of an addition to the building on said premises and
the alteration of the basement, walk and windows of said building
and makes the following claim:
1.) The name of the claimant is Floyd G. Peck.
2.) The address of the claimant is 9 South York street,
P.O. Box 3343, Mechanicsburg, PA 17055.
3.) The name of the owner of the premises and building
against which the claim is filed is Robert D. Brennan
and Eileen M. Brennan, husband and wife, and the
address is 507 Kentwood Drive, Mechanicsburg, (Hampden
Township), PA 17055.
4.) The claimant contracted directly with Robert D. Brennan
and Eileen M. Brennan, the owner.
5.) The claim of the claimant is based on the contract for
labor and materials entered into by the owner and the
claimant on April 17, 1995, for construction of an
addition to the building (Exhibit A attached) and for
installation of building improvements and alterations
(EXhibit B attached). The work and materials were
furnished from May 10, 1995 to June 29, 1995. The
nature and character of the work was construction of a
sun room, installation of windows, a walkway, a bay
window, finish interior and exterior trim for bay
window, trim for french doors and basement alterations
including electrical work, insulation, drywall
installation, drop ceiling and carpenter work together
with the labor necessary for installation thereof.
6.) The sum of $12,622.00 together with lawful interest
from June 29, 1995, is due the claimant. The claimant
has no note or other collateral security for his
claims.
7.) The work was done and the materials furnished for the
construction and alteration of the residential dwelling
at 507 Kentwood Drive, Mechanicsburg, PA, legal
description of which is:
ALL THAT tract of land, with improvements thereon
erected, situate in Good Hope Farms, Hampden Township,
Cumberland County, Pennsylvania, being Lot No.1,
Section "G" on Plan NO. 5 of Good Hope Farms and
identified as No. 507 Kentwood Drive, more particularly
bounded and described as follows:
BEGINNING at a point, being the intersection of the
northerly line of Kentwood Drive with the easterly line
of Strathmore Drive as shown on the herein mentioned
plan of lots; thence by the northerly line of Kentwood
Drive, North 66 degrees, 20 minutes East 140 feet to
the dividing line between Lots Numbered 1 and 28 of
Section "G" as shown on the herein mentioned plan of
lots; thence by said dividing line, North 23 degrees 40
minutes West 130 feet to a point; thence South 66
degrees 20 minutes West 140 feet to the easterly line
of Strathmore Drive; thence by the same, South 23
degrees 40 minutes East 130 feet to the place of
BEGINNING.
BEING Lot No.1, Section "G", on Plan No.5 of Good
Hope Farms which plan was on March 29, 1968, duly
recorded in the Office of the Recorder of Deeds in and
for CUmberland County, Pennsylvania, in Plan Book 19,
Page 72, and being further identified on said plan as
No. 507 Kentwood Drive.

COMPLAINT
1.) plaintiff FLOYD G. PECK is an adult individual and a
resident of Mechanicsburg, cumberland County, pennsylvania.
2.) Defendants ROBERT D. BRENNAN and EILEEN M. BRENNAN,
husband and wife, are adult individuals and residents of Hampden
Township, cumberland county, pennsylvania.
3.) On september 18, 1995 plaintiff filed a mechanics lien
claim against Defendants to the above term and number, a copy of
which is attached as Exhibit A.
4.) On April 17, 1995, plaintiff submitted two proposals to
do certain work on the dwelling owned by the Defendants which
were accepted by the Defendants, these proposals are attached as
Exhibits Band C.
5.) The work contemplated by the proposal designated
Exhibit B consisted of an addition to the dwelling for the price
of $34,800.00 and the work contemplated by Exhibit c consisted of
improvements to the basement for the price of $6,400.00.
6.) plaintiff commenced work on or about May 10, 1995 and
worked continually until June 29, 1995, when Defendants refused

him access to the premises to complete the work.
7.) When Plaintiff commenced construction of the addition,
it was discovered that Defendants' septic tank was located at the
site of the proposed addition which necessitated a reduction in
size of the addition; the parties agreed to reduce the contract
price $506.00 to compensate for the reduction.
8.) The parties agreed to an allowance of $20.00 per yard
for carpet to be installed in the addition, a total of $800.00.
9.) The defendants requested changes in the contract and
additional work, all of which plaintiff agreed to perform and for
which the defendants agreed to pay; these items were:
a.) Additional outlets in basement: 4 overhead
outlets, 6 extra wall outlets, 2 wall switches and
2 exterior GF1 outlets - $275.00
b.) Change in exterior bay window finish;
materials and labor - $300.00
c.) Change in interior bay window finish;
materials and labor - $560.00
d.) Change in interior french door finish;
materials and labor - $300.00
10.) Defendants requested a larger window than that
specified in Exhibit C an agreed to pay the increased price of
$263.00 set forth therein.
11.) Defendants requested the plaintiff to remove bushes
which work was not part of the contract and for which they agreed

to pay; the costs thereof was $106.00.
12.) Defendants requested the plaintiff to install basement
insulation which was not a part of the contract and for which
they agreed to pay; the cost thereof was $415.00.
13.) Defendants requested installation of a replacement
window which plaintiff agreed to install; the increased cost was
$468.00.
14.) Plaintiff performed his work in a workmanlike manner
and was prevented from completing the work by the unjustified
refusal of defendants to give him access to the premises.
15.) Defendants paid $29,960.00 on account of the contract
price and extras, but refuses to pay the balance.
16.) The account between the parties is as follows:

AND NOW, come the Owners, Robert D. Brennan and Eileen M.
Brennan, by and through their counsel, Fowler, Addams, Shughart'
Rundle, and set forth the following answer and counterclaim to
the Contractor's Complaint:
1. Admitted.

6. Denied. The Contractor commenced work on or about
May 8, 1995.
7. Denied. The contractor, although agreeing to construct
an addition that was to be 22 feet wide by 20 feet deep,
submitted a building permit application, a copy of which is
attached hereto as Exhibit "A", for a 20' x 20' structure. The
footer trench was dug for the 20' x 20' structure. The septic
tank was discovered after the footer trench was dug. The parties
never reached an agreement on the dollar amount that the
construction cost would be reduced.
8. Denied. The parties agreed to an allowance of $20 per
yard for carpet to be installed in the 22' x 20' addition, which
Owners believe to be $1,060.
9. Denied.
A. The Owners did request two exterior GF1 outlets,
three overhead outlets, two wall swi;~hes, and one wall

outlet. No price was ever agreed upon for installation of
these items.
B. The Owners did not request any change in the
exterior bay window finish, materials and labor.
C. The Owners did not request any change in the
interior bay window finish, materials and labor.
D. The Owners did not request any change in the French
door finish, materials and labor.

13. Denied. Said window required replacement because the
Contractor erred in design and construction of the addition. The
Owners did not agree to pay the cost of replacement of said
window. On the contrary, they demanded the window be replaced at
the Contractor's expense.
14. Denied. The Contractor performed work in a defective
and unworkmanlike manner which required numerous repairs as is
more fully set forth in Paragraphs 17 through 41 of the Owner's

15. Admitted.
16. Denied. The averments set forth in Paragraphs 17
through 41 are incorporated herein by reference.
NEW MATTER
17. The Contractor performed his work in a defective and
unworkmanlike manner which required numerous repairs to be made
by other contractors and the Owner to complete the contract.
18. The Contractor improperly installed siding on the
addition constructed on the Owners' home requiring removal of the
siding and reinstallation in a workmanlike manner. Specifically,
the Contractor failed to align the siding on the addition with
the existing siding on the Owner's home and failed to utilize a
foam backboard in the installation.
19. The Contractor failed to provide vented soffiting on the
addition constructed on the Owners' home as required by the
contract requiring removal of the improper soffiting and
reinstallation of vented soffiting in a workmanlike manner.
20. The total cost for labor and material to repair siding
and soffiting was $1,943, as is more fully set forth on
Exhibits "B-1" and "B-2" attached hereto and made a part hereof.
21. The Contractor failed to provide for a watertight seal
where the addition joined the Owners' house and failed to provide
for proper flashing around the Owners' chimney.
22. The cost to repair the faulty work performed by the
Contractor on the roof and around the chimney was $428 as is set
forth on Exhibit "C" attached hereto and made a part hereof.
23. The cost to complete the carpentry work in the addition
and to repair the faulty workmanship performed by the Contractor
around the bay window was $906 as is set forth on Exhibit "0"
attached hereto and mad~ a part hereof.
24. The Contractor installed the drywall in the basement and
in the addition in a defective and unworkmanlike manner requiring
repair, the cost of which was $450 as is set forth on Exhibit "E"
attached hereto and made a part hereof. Specifically, the
Contractor left large gaps between sheets of drywall and
installed the tape in a manner which caused the tape to come
loose from the wall.
25. The Contractor installed the electrical wiring in a
defective and unworkmanlike manner requiring repair. The cost to
make said repairs and to complete the remainder of the electrical
work was $1,104.13 as is set forth on Exhibit "F" attached hereto
and made a part hereof. Specifically, the Contractor connected
wires without providing for junction boxes, left wires dangling
and had wiring connected to water pipes.
26. The Owner paid $632.76 to purchase an air conditioner
for the addition which was required by the original contract.
The receipt for said air conditioner is attached hereto as
Exhibit "G" and made a part hereof.
27. The Owner paid $158.82 to purchase a ceiling fan tor the
addition which was required by the original contract. The
receipt for said fan is attached hereto as Exhibit "H" and made a
part hereof.
28. The Owner paid $258.75 to purchase paint and paint
related materials (exclusive of brushes, rollers, and roller
pans) which were required as part of the original contract. The
receipts for same are attached as Exhibits "I-I", "1-2", and
"1-3" and made a part hereof.
29. The Owner paid $630.95 to purchase lumber and
miscellaneous construction supplies which were required by the
original contract. The receipts for same are attached Exhibits
"J-l" through "J-7" and made a part hereof.
30. The allowance for carpeting of 22' x 20' addition at $20
per yard is $1,060.
31. The allowance for reduction of the size of the addition
from 22' x 20' to 20' x 20' at $79.09 per ~quare foot is
$3,163.60.
32. The allowance for deletion of the closet on the second
floor is $470.
33. The Owners personally devoted 90 man hours of labor to
painting and 14~ man hours of labor to performing carpentry which
were required to complete the original contract. A fair hourly
rate for this labor is $15 per hour for a total of $1,567.50.
34. The Contractor installed custom trapezoidal windows
which were considerably smaller than required by the contract.
The cost differential between the windows supplied and the
windows installed is $540.
35. The total amount which would have been due to the
Contractor had he completed the job in a workmanlike manner prior
to deletions and allowances is $41,984, computed as follows:

36. The total amount of allowances for deletions to the
contract is $4,693.60 computed as follows:

37. The total amount due to the Contractor less allowances
is $36,750.40.
38. The Contractor has been paid $29,960 leaving a true
balance of his claim of $6,790.40.
39. The total amount paid by Owner to others for labor and
materials and claimed by Owners for personal labor to complete
the contract is $8,079.91 computed as follows:

REPLY
FLOYD G. PECK, Plaintiff and Contractor, answers Defendant
and Owner's New Matter as follows:
17.) It is denied the work was defective and on the
contrary the work was done in a workmanlike manner and complied
with the contract.
18.) It is denied the siding was improperly installed and
on the contrary it was properly installed in accordance with the
contract.
19.) The siding was installed as provided by the contract
and any replacement thereof was unwarranted.
20.) After reasonable investigation Plaintiff is without
sufficient information to determine the truth of the averment and
proof is demanded, if relevant.
21.) It is denied the Plaintiff failed to provide proper
flashing and watertight seal, said work was properly done.
22.) After reasonable investigation Plaintiff is without

proof is demanded, if relevant.
23.) It is denied the work around the bay window was
defective and on the contrary it was performed by a cabinet maker
in accordance with the specifications of Mrs. Brennan. As to the
allegation as to costs, after reasonable investigation Plaintiff
is without sufficient information to determine the truth of the
averment and proof is demanded, if relevant.
24.) It is denied the basement drywall was improperly
installed. As to the allegation as to costs, after reasonable
investigation Plaintiff is without sufficient information to
determine the truth of the averment and proof is demanded, if
relevant.
25.) It is denied the electrical work was defective as far
as it was installed. Plaintiff was denied access to the premises
to complete the electrical installation. As to the allegation as
to costs, after reasonable investigation Plaintiff is without
sufficient information to determine the truth of the averment and
proof is demanded, if relevant.
26.) It is denied the air conditioning was part of the
contract. As to the price paid, after reasonable investigation
Plaintiff is without sufficient information to determine the
truth of the averment and proof is demanded, if relevant.
27.) It is denied the ceiling fan was part of the contract.
As to the price paid, after reasonable investigation Plaintiff is
without sufficient information to determine the truth of the

averment and proof is demanded, if relevant.
28.) It is denied the Plaintiff failed to provide paint for
all work up until he was denied access to the premises to
complete his contract. As to the price paid, after reasonable
investigation Plaintiff is without sufficient information to
determine the truth of the averment and proof is demanded, if
relevant.
29.) It is denied the Plaintiff failed to provide lumber
and material for all work up until he was denied access to the
premises to complete his contract. As to the price paid, after
reasonable investigation Plaintiff is without sufficient
information to determine the truth of the averment and proof is
demanded, if relevant.
30.) The inside dimensions of the room were 19.5 feet by 21
feet which is 45.5 yards or an allowance of $910.00.
31.) It is denied the reduction was on a square foot basis,
as many items (such as windows) did not change and the unexpected
location of the septic tank increased costs. The $516.00 was the
agreed upon reduction.
32.) Admitted.
33.) It is denied the Plaintiff failed to complete his
contract up until he was denied access to the premises. lie was
prepared to complete the contract, but was wrongfully prevented
from doing so. It is denied the Defendant completed the contract
by doing the work themselves and it is denied they are entitled
to be paid therefor. As to the hours spent and work done,

after reasonable investigation plaintiff is without sufficient
information to determine the truth of the averment and proof is
demanded, if relevant.
34.) The trapezoidal windows were designed by Anderson
Windows to conform to the ceiling and roof rafters and were
approved by Defendant. As to the costs of the windows, after
reasonable investigation Plaintiff is without sufficient
information to determine the truth of the averment and proof is
demanded, if relevant.
35.) Admitted.
36.) It is denied the allowances for deletions are
accurately set forth in this allegation and the answer to each
allegation is contained in Paragraphs 30, 31, 32 and 34 of this
Reply.
37.) It is denied the calculations of Paragraph 36 are
correct and the allegation of this Paragraph is merely an
arithmetic calculation which is equally incorrect.
38.) It is admitted the Plaintiff has been paid $29,600.00,
but it is denied the balance of his claim is as stated for
reasons given in Paragraphs 36 and 37 above.
39.) It is denied the $8,079.91 claim is correct for the
reasons given in Paragraphs 17 thru 35 which deny each specific
allegation which makes up the total.
40.) It is denied the amount owed by Defendant exceeds the
claim of the Plaintiff for the specific reasons contained in the
foregoing Paragraphs.
