the amount of $221,407.45, with interest at the rate of 10 1/4
percent per annum from September 16, 1995 ($56.17 per diem)
together with attorney's fees in the amount of 5 percent and
the costs of suit, by reason of the failure of the defendants
to enter an appearance or to file an answer within 20 days of
the date of service of the complaint endorsed with a notice to

AND NOW, this ~. day of December. 1995. the Plaintiff. Farmers Trust
Company. by its attorney. William A. Duncan. Esquire. and the Defendant. Dean
Touloumes and Thomas N. Kaunas. as Executors of the Estate of Spero J.
Touloumes. by its attorney. Steve C. Nicholas. Esquire, have entered into the
fOllowing Stipulation after having informed and advised their respective clients
of the provisions hereinafter set forth:
1. Farmers Trust Company shall enter judgment as set forth in the
Complaint filed in this matter but agrees to forebear from execution on said
judgment against certain real estate owned by the Defendant until March 1,
1996.
2. The Estate of Spero J. Touloumes waives its rights to Object to the
entry of such judgment.
3. The Defendant has listed the real estate known generally as the
"Holly Inn" with a commercial real estate broker and will actively continue efforts
to sell the said property, In addition. the Defendant will keep the Plaintiff
informed of such efforts,

1. The property to be sold pursuant to the above captioned
judgment is all that certain tract of real estate situate in
the Borough of Mount Holly Springs, Cumberland County,
Pennsylvania, as more fully described in Exhibit "A" attached
hereto and made a part hereof.
2. The judgment of the Court in which the sale is being
held is Civil No. 95-4962 in the Court of Common Pleas of
cumberland County, Pennsylvania.
3. The names of the owners of the property to be sold
pursuant to the above captioned judgment are Spero J.
Touloumes, deceased, by his Executors Dean Touloumes and Thomas
N. Kounas.
4. The time and the place of the Sheriff Sale is 10
o'clock A.M., June 5, 1996 in the County Commissioner's
Conference Room, Second Floor, Cumberland County Court House,
Carlisle, Pennsylvania.

EXHIBIT A
ALL those certain tracts or parcels of land and premises,
situate, lying and being in the Borough of Mt. Holly Springs,
in the County of cumberland, Commonwealth of Pennsylvania, more
particularly described as follows:
BEGINNING at a point on the centerline of a public highway
known as Baltimore Avenue; thence along said centerline North
39 degrees 20 minutes 30 seconds West 26.96 feet to a point;
thence still along said centerline, North 50 degrees 48 minutes
30 seconds West 265 feet to a point; thence still along same
North 38 degrees 23 minutes 30 seconds West 93.29 feet to a
point in said centerline; thence North 66 degrees 20 minutes
East 25 feet to a point at the Eastern edge of the right-of-way
for Baltimore Avenue; thence by same North 38 degrees West
24.6 feet to a point; thence by lands now or formerly of
Bessie D. Touloumes North 72 degrees 57 minutes 20 seconds East
206,71 feet to a point at the line of lands now or formerly of
Mount Holly Paper Company; thence by said latter lands South
17 degrees 43 minutes East 329.2 feet to a point; thence by
the same South 35 degrees 24 minutes West 47.82 feet to a point
in the centerline of the aforesaid Baltimore Avenue, the place
of beginning.
SAID PREMISES containing 1.161 acres and being described
according to a survey of Thomas A. Neff, Registered Surveyor.
HAVING thereon erected a three story stone and frame hotel
building and other improvements commonly known as The Holly Inn
property.
TRACT NO. 2
BOUNDED, on ,the North by property now or formerly of D. Fred
Souders, Jr.; on the South by property now or formerly of
Bessie D. Touloumes; on the West by Baltimore Avenue and on
the East by Mountain Creek.
SAID PREMISES, containing 107 feet, more or less, in front on
Baltimore Avenue and extending to Mountain Creek. Having a
width along mountain Creek of 134 feet, more or less and a
distance along the northern boundary of 202 feet, more or less
and a distance along the southern boundary of 200 feet, more or
less.
BEING the same premises which Spero J. Touloumes and James J.
Touloumes, by deed dated January 15, 1982, and recorded in
Cumberland County Deed Book 29, Vol. "R". Page 16, granted and
conveyed unto Spero J. Touloumes.

AND NOW, comes Farmers Trust Company, through its attorney,
william A. Duncan, Esquire, and files this Complaint in
Mortgage Foreclosure, of which the following is a statement:
1. Plaintiff is Farmers Trust Company, a corporation
organized and existing under the laws of the Commonwealth of
Pennsylvania with its main office and principal place of
business located at 1 West High Street, Carlisle, CUmberland
County, Pennsylvania 17013.
2. Defendants, Dean Touloumes of 253 CUmberland Street,
Harrisburg, Pennsylvania, 17102 and Thomas N. Kounas of 84
Silver Crown Road, Mechanicsburg, Pennsylvania, Executors of
the Estate of Spero J. Touloumes, late of 31 S. Baltimore
Street, Mt. Holly Springs, CUmberland County, Pennsylvania
17065. Spero J. Touloumes died January 28, 1995 whereas letter
testamentary were issued on March 1st, 1995 unto Dean Touloumes
and Thomas N. Kounas.
3. On or about March 29, 1988, Decedent made, executed and
delivered to Plaintiff a note and a real estate mortgage
financing Two Hundred Sixty Thousand Dollars and 00/100
($260,000.00), a copy of said note and said real estate
mortgage being attached hereto as Exhibits "AR and "B",
respectively, and are incorporated herein by reference as
though fully set forth.
4. Said note and said real estate mortgage have not been
assigned.
5. SPERb J. TOULOUMES, deceased is the sole record owner
in fee simple of said premises subject to said mortgage, by
virtue of a Deed dated and recorded on January 28, 1982, and
recorded in the Cumberland County Recorder's Office in Deed
Book "R", Volume 29, Page 16, more specifically set forth in
Exhibit "C", attached hereto and made a part hereof by
reference.
6. Said note and said real estate mortgage are in default
because Defendants herein have failed to pay the payments that
were due and owing for the months of JULY 1995, AUGUST 1995 AND
SEPTEMBER 1995.
7. By reason of the aforesaid default, the entire
principal balance of Two Hundred Seven Thousand Seven Hundred
Eight Dollars and 02/100 ($207,708.02), with interest thereon
at the rate of 10.25') percent per annum computed from
September 14, 1995, accruing insurance premiums, attorney's
fees in the amount of Ten Thousand Three Hundred Eighty Five
Dollars and 40/100 ($10,385.40) are now due and payable.
VERIFICATION
I, John H. Bowers, hereby verify that I am Sr. Vice
president of Farmers Trust Company, that I make this
verification being authorized to do so, and the facts set forth
in the foregbing complaint are true and correct to the best of
my knowledge. I understand that false statements herein are
