I. fACTS AS TO LIABILITY.
On January 26, 1994 at approximately 6:30 p.m., Mrs. Kauffman fell as a
result of what she subsequently learned was a wet floor resulting in injuries. The
accident happened inside the catalog department ofthe J.C. Penney's store in
Carlisle. The floor was linoleum tile and naturally slippery when wet.
The Defendant had area carpet mats to eliminate this dangerous and
slippery condition and had wet floor signs to warn customers of the slippery
condition. however, the Defendant failed to use any of these items on January 26
when Mrs. Kauffman fell,
The merchandise manager, Jennifer Ahrens, filled out an accident report
contemporaneously with the happening of the accident stating that there were
water puddles in the area of the fall. Ahrens testified in deposition that there

were no area carpet mats where the water was found and the Defendant had
failed to put up any wet floor signs. The aecident report is attached aa Exhibit
"A".
II. FACTS AS 'cr> DAMAGES.
When Mrs. Kauffman fell, she hit her head on the counter and fell hard to
the floor. She injured her head, shoulder, back, hip and leg. Subsequent MRI
study of the back showed that Mrs. Kauffman suffered a bulging/protruding disk.
An MRI of her knee indicated a linear tear of the meniscus. Mrs. Kauffman
missed over three months of work because of this accident and sustained lost
wages in the amount of$3,673.27. Medical bills incurred total $3,087.76.
Since this accident, Mrs. Kauffman haa had daily pain in her back and leg
and takes extra-strength Tylenol daily.
III.
It is Plaintiffs position that liability is clear and the Plaintiff has suffered a
permanent injury resulting in daily pain for over two years.

IV. j&GAlJSSUES.
Plaintiff has filed a Motion to Compel, a copy of which is attached hereto as
Exhibit "8ft.
The Plaintiff has filed a Request for Admissions, a copy of which is attached
hereto as Exhibit "Cft. Plaintiff requests that the Defendant stipulate to medical
bills and lost wages as set forth in the requests for admissions.
Plaintiff reserves the right to take additional depositions when Defendant
fully answers discovery.

VII.
Plaintiffs initial demand in this case was $49,000 and the Defendant's
initial offer was $13,000. After negotiating for a lengthy period of time, the
Defendant offered $20,000 in settlement. The Plaintiff has substantially reduced
her demand to $30,000.

MOTION TO COMPEL OF PLAINTIFF
rURSUANT TO LOCAL RULE 4001-1
AND NOW, comes Plaintiff, JANET KAUFFMAN, by her attorneys, Mette,
Evans & Woodside, and files this Motion to Compel pursuant to Local Rule
4001-1 based on the following:
1. The above-captioned case is a slip and fall that occurred in the J.C.
Penney store in Carlisle, Pennsylvania on January 26, 1994.
2. On December 5, 1995 the Plaintiff served on the Defendant a Request
for Production of Documents, a copy of which is attached hereto as Exhibit "A".
3. On March 15, 1996, Plaintiff filed a Motion to Compel because the
Defendant failed to respond to Plaintiffs discovery request. A copy of the Motion
to Compel is attached as Exhibit "Bn.
4, Pursuant to the Plaintiffs Motion, the Court signed an Order dated
March 19, 1996, a copy of which is attached hereto as Exhibit "Cn,
5, On April 11, 1996, Plaintiff received Defendant's response to
Plaintiffs Request for Production of Documents pursuant to the Court Order.
6. On June 6, 1996, Plaintiff took the deposition of Jennifer Ahrens, the
merchandise manager of J.C. Penney store concerning an accident report she
authored as a result of the Plaintiffs slip and fall. The deposition revealed that
the accident report was inappropriately redacted by the Defendant before it was
produced to the Plaintiff deleting crucial infonnation that this employee observed
the day of the accident including defects discovered by the Defendant on the day of
the accident and information concerning the lighting conditions.
7. During Ms. Ahrens' deposition, counsel for the Defendant stated on
the record that items 24, 25, 29, 30, 40, 41 and 42 were redacted from the accident
report.
8. The deposition of Ms. Ahrens and statements made by counsel for the
Defendant during the deposition also revealed that there are other discoverable
portions of the Defendant's claims file that has not been produced including
statements taken of witnesses.
9. Plaintiff requests that the Defendant produce the entire
investigative/claims file without redaction to the Court so the Court can properly
decide the discoverable portions.
10. This is the second Motion to Compel that the Plaintiff was required
to file incurring unnecessary expense and expending unnecessary time.
11. This case is listed for trial for the term commencing July 8, 1996.
WHEREFORE, Plaintiff requests this Court to enter an Order compelling
the Defendant to produce the entire investigative/claims file to the Court at a
discovery conference to resolve this matter.

AND NOW, comes Plaintiff, JANET KAUFFMAN, by her attorneys, Mette,
Evans & Woodside, and files this Motion to Compel based on the following:
1. This case involves a slip and fall that occurred on January 26, 1994
resulting in personal injury to the Plaintiff.
2. The Complaint in the above matter was filed in September of 1995.
3. On December 5, 1995, the Plaintiff filed a "Request for Production of
Docwnents" on the Defendant. A copy of the document request is attached as
Exhibit "An.
4. To date, the Defendant has not responded to the document request.
5. The plaintiff attempted to amicably resolve this matter as evidence
by the correspondence attached Exhibit "Bn dated February 13, 1996 requesting
that the Defendant respond to the document request. There has been no response
to the February 13, 1996 letter.
6. The Defendant is represented by Kathleen B. Gereaghty, Esquire,
Kelly, McLaughlin & Foster, 1700 Atlantic Building, 260 South Broad Street,
Philadelphia, PA 19102-5092
WHEREFORE, Plaintiff requests that the Court compel the Defendant to
fully and completely respond to the request for Production of Documents or suffer

2. As a result of the injuries Plaintiff sustained arising out of the above.
captioned matter, she was off work for half days on January 31, February 3, and
February 15; and the Plaintiff was off work for full days from February 16, 1994
through May 9, 1994. Plaintiff sustained lost wages in the amount of $3,673.27 as
a result of the accident that occurred on January 26, 1994 at the Defendant's
store.

AND NOW, comes Plaintiff, JANET KAUFFMAN, by her attorneys, Mette,
Evans & Woodside, and files this Motion to Compel pursuant to Local Rule
4001-1 based on the following:
1. The above-captioned case is a slip and fall that occurred in the J.C.
Penney store in Carlisle, Pennsylvania on January 26, 1994.
2. On December 5, 1995 the Plaintiff served on the Defendant a Request
for Production of Documents, a copy of which is attached hereto as Exhibit "A".
3. On March 15, 1996, Plaintiff filed a Motion to Compel because the
Defendant failed to respond to Plaintiffs discovery request. A copy of the Motion
to Compel is attached as Exhibit "B".
4. Pursuant to the Plaintiffs Motion, the Court signed an Order dated
March 19, 1996. a copy of which is attached hereto as Exhibit "CWo
5. On April 11, 1996, Plaintiff received Defendant's response to
Plaintiffs Request for Production of Documents pursuant to the Court Order.
6. On June 6, 1996, Plaintiff took the deposition of Jennifer Ahrens, the
merchandise manager of J.C, Penney store concerning an accident report she
authored as a result of the Plaintiffs slip and fall. The deposition revealed that
the accident report was inappropriately redacted by the Defendant before it was
produced to the Plaintiff deleting crucial information that this employee observed
the day of the accident including defects discovered by the Defendant on the day of
the accident and information concerning the lighting conditions.
7. During Ms. Ahrens' deposition, counsel for the Defendant stated on
the record that items 24, 25, 29, 30, 40, 41 and 42 were redacted from the accident
report.
8. The deposition of Ms. Ahrens and statements made by counsel for the
Defendant during the deposition also revealed that there are other discoverable
portions of the Defendant's claims file that has not been produced including
statements taken of witnesses.

1. This case involves a slip and fall that occurred on January 26, 1994
resulting in personal injury to the Plaintiff.
2. The Complaint in the above matter was filed in September of 1995.
3. On December 5, 1995, the Plaintiff filed a "Request for Production of
Documentsn on the Defendant. A copy of the document request is attached as
Exhibit "An.
4. To date, the Defendant has not responded to the document request.

AND NOW, comes Plaintiff, JANET KAUFFMAN, by her attorneys, Mette,
Evans & Woodside, and files this Complaint against the Defendant, J.C. Penney
Co., based on the following:
1. Plaintiff, JANET KAUFFMAN, is an adult individual residing at
P. O. Box 225, Carlisle, Cumberland County, Pennsylvania.
2. Defendant, J.C. PENNEY CO., INC., is a Delaware Corporation with
registered offices at CT CORPORATION SYSTEM, 1635 Market Street,
Philadelphia, Philadelphia County, Pennsylvania 19103.
3. The accident hereinafter related occurred on January 26, 1994 in the
catalogue department of the J.C, Penney Co. store located at 250 Carlisle Plaza
Mall, Carlisle, Pennsylvania.
4. At the aforesaid time and place, the Plaintiff was shopping at the
Defendant's establishment and, therefore, was a business invitee of the Defendant
to which the highest degree of care is owed by the Defendant to the Plaintiff.
5. At the aforesaid time and place, the Plaintiff fell as a result of what
Plaintiff subsequently learned was a wet floor resulting in serious injuries as
hereinafter described.
6. The Defendant had a duty to maintain the aforesaid floor area in a
safe condition for its customers,
7. The Defendant had a duty to inspect the aforesaid floor area for
dangerous and defective conditions,
8. At the aforesaid time and place, the aforesaid floor area existed in a
dangerous and defective condition,
9. The negligence, carelessness and/or recklessness of the Defendant
consisted, iDW: BliJl, of the following:

(a) Maintaining the floor area of the catalogue department
in a dangerous and defective condition;
(b) Failing to inspect the floor area of the catalogue
department for dangerous and defective conditions;
(c) Failing to remove, clean or eliminate the water on the
floor in the catalogue department;
(d) Failing to warn customers of the wet floor in the
catalogue department;
(e) Failing to place carpet in the aforesaid mentioned area
to prevent the slippery condition caused by water on a
tile floor.
10. As a direct result of the Defendant's negligence, carelessness and/or
recklessness, Plaintiff suffered serious and permanent injuries including:
(a) Injuries to Plaintiffs head when her head hit the counter
as she fell on the wet floor;
(b) Injuries to her shoulder and back;
(c) Injuries to her hip and leg;

ld) Injuries to her nerves and discs of her spinal column
causing a bulging and protruding disc;
(e) Injury to her knee.
11. As a direct result of the aforesaid negligence, carelessness and/or
recklessness, Plaintiff incurred medical bills and will continue to incur medical
bills.
12. As a direct result of the aforesaid negligence, carelessness and/or
recklessness, Plaintiff sustained lost wages and a loss of earning capacity.
WHEREFORE, plaintiff demands judgment in her favor and against the
Defendant and the Plaintiff be awarded an amount in excess of $25,000 and that
the Plaintiff be awarded costs and other relief as the Court deems just.

The Response of Defendant, J.C. Penney Company, Inc., to the

1. Denied as stated. It is averred, to the contrary, that
Plaintiff's Complaint alleges that plaintiff slipped and fell on or
about January 26, 1994 and allegedly sustained injuries.

J.C. Penney), hereby Answers Plaintiff's Complaint in accordance with
the numbered paragraphs as follows:
1. Denied. After reasonable investigation, J.C. Penney Co.,
Inc. is without knowledge or information sufficient to form a belief
as to the truth of the allegations contained in Paragraph 1 and,
therefore, these allegations are denied.

3. Denied. After reasonable investigation, J.C. Penney Co.,
Inc. is without knowledge or information sufficient to form a belief
as to the truth of the allegations contained in Paragraph 3 of Plain-
tiff's Complaint and, therefore, these allegations are denied.
4. Denied. After reasonable investigation, J.C. Penney Co.,
Inc. is without knowledge or information sufficient to form a belief
as to the truth of the factual allegations contained in Paragraph 4

Inc. is without knowledge or information sufficient to form a belief

conclusions of law to which no response is required.
8. Denied. It is denied that the subject floor was in a
dangerous and/or defective condition. To the contrary, the subject
floor was in a safe and proper condition. The remaining allegations
contained in paragraph 8 are conclusions of law to which no response
is required.
9. Denied. It is denied that J.C. Penney Co., Inc. was
negligent, careless and/or reckless as alleged in this paragraph. It
is specifically denied that J.C. Penney, Co., Inc. failed to inspect
the floor area, failed to remove, clean or eliminate water on the
floor, failed to warn customers of wet floor and/or failed to place
carpet in the area in question or that it maintained the floor of the
Catalog Department in a dangerous and/or defective condition. To the
contrary, J.C. Penney Co., Inc. acted at all times in a safe, proper
and prudent manner with regard to the floor of the Catalog Department.
The remaining allegations contained in Paragraphs 9 (a-e) inclusive
are conclusions of law to which no response is required.

10. Denied. After reasonable investigation, J.C. Penney Co.,
Inc. is without knowledge or information sufficient to form a belief
as to the truth of the factual allegations contained in Paragraph 10
and, therefore, these allegations are denied. The remaining allega-

response is required. However, should a response be deemed necessary,
it is denied that J.C. Penney Co., Inc. acted in a negligent, careless
and/or reckless manner with regard to the Plaintiff and averred, to
the contrary, that J.C. Penney, Co., Inc. acted at all times in a
safe, proper and prudent manner.
11-12. After reasonable investigation, J.C. Penney Co., Inc. is
without knowledge or information sufficient to form a belief as to the
truth of the allegations contained in Paragraph 11 and, therefore,
these allegations are denied. The remaining allegations contained in
Paragraph 11 are conclusions of law to which no response is re-
quired.
WHEREFORE, Defendant, J.C. Penney Co., Inc., demands judgment in
its favor and that Plaintiff's Complaint be dismissed with costs and
