PENNEY CO., INC., Defendant eBB.'J'R1AL MEMORANDVM I. fACTS AS TO LIABILITY. On January 26, 1994 at approximately 6:30 p.m., Mrs. Kauffman fell as a result of what she subsequently learned was a wet floor resulting in injuries. The accident happened inside the catalog department ofthe J.C. Penney's store in Carlisle. The floor was linoleum tile and naturally slippery when wet. The Defendant had area carpet mats to eliminate this dangerous and slippery condition and had wet floor signs to warn customers of the slippery condition. however, the Defendant failed to use any of these items on January 26 when Mrs. Kauffman fell, The merchandise manager, Jennifer Ahrens, filled out an accident report contemporaneously with the happening of the accident stating that there were water puddles in the area of the fall. Ahrens testified in deposition that there ._,~ ~ . ' . '. were no area carpet mats where the water was found and the Defendant had failed to put up any wet floor signs. The aecident report is attached aa Exhibit "A". II. FACTS AS 'cr> DAMAGES. When Mrs. Kauffman fell, she hit her head on the counter and fell hard to the floor. She injured her head, shoulder, back, hip and leg. Subsequent MRI study of the back showed that Mrs. Kauffman suffered a bulging/protruding disk. An MRI of her knee indicated a linear tear of the meniscus. Mrs. Kauffman missed over three months of work because of this accident and sustained lost wages in the amount of$3,673.27. Medical bills incurred total $3,087.76. Since this accident, Mrs. Kauffman haa had daily pain in her back and leg and takes extra-strength Tylenol daily. III. It is Plaintiffs position that liability is clear and the Plaintiff has suffered a permanent injury resulting in daily pain for over two years. ~ ',- / . . , IV. j&GAlJSSUES. Plaintiff has filed a Motion to Compel, a copy of which is attached hereto as Exhibit "8ft. The Plaintiff has filed a Request for Admissions, a copy of which is attached hereto as Exhibit "Cft. Plaintiff requests that the Defendant stipulate to medical bills and lost wages as set forth in the requests for admissions. PENNEY CO., INC., Defendant MOTION TO COMPEL OF PLAINTIFF rURSUANT TO LOCAL RULE 4001-1 AND NOW, comes Plaintiff, JANET KAUFFMAN, by her attorneys, Mette, Evans & Woodside, and files this Motion to Compel pursuant to Local Rule 4001-1 based on the following: 1. The above-captioned case is a slip and fall that occurred in the J.C. Penney store in Carlisle, Pennsylvania on January 26, 1994. 2. On December 5, 1995 the Plaintiff served on the Defendant a Request for Production of Documents, a copy of which is attached hereto as Exhibit "A". 3. On March 15, 1996, Plaintiff filed a Motion to Compel because the Defendant failed to respond to Plaintiffs discovery request. A copy of the Motion to Compel is attached as Exhibit "Bn. 4, Pursuant to the Plaintiffs Motion, the Court signed an Order dated March 19, 1996, a copy of which is attached hereto as Exhibit "Cn, 5, On April 11, 1996, Plaintiff received Defendant's response to Plaintiffs Request for Production of Documents pursuant to the Court Order. 6. On June 6, 1996, Plaintiff took the deposition of Jennifer Ahrens, the merchandise manager of J.C. Penney store concerning an accident report she authored as a result of the Plaintiffs slip and fall. The deposition revealed that the accident report was inappropriately redacted by the Defendant before it was produced to the Plaintiff deleting crucial infonnation that this employee observed the day of the accident including defects discovered by the Defendant on the day of the accident and information concerning the lighting conditions. 7. During Ms. Ahrens' deposition, counsel for the Defendant stated on the record that items 24, 25, 29, 30, 40, 41 and 42 were redacted from the accident report. 8. The deposition of Ms. Ahrens and statements made by counsel for the Defendant during the deposition also revealed that there are other discoverable portions of the Defendant's claims file that has not been produced including statements taken of witnesses. 9. Plaintiff requests that the Defendant produce the entire investigative/claims file without redaction to the Court so the Court can properly decide the discoverable portions. 10. This is the second Motion to Compel that the Plaintiff was required to file incurring unnecessary expense and expending unnecessary time. 11. This case is listed for trial for the term commencing July 8, 1996. WHEREFORE, Plaintiff requests this Court to enter an Order compelling the Defendant to produce the entire investigative/claims file to the Court at a discovery conference to resolve this matter. On December 5, 1995, the Plaintiff filed a "Request for Production of Docwnents" on the Defendant. A copy of the document request is attached as Exhibit "An. 4. To date, the Defendant has not responded to the document request. 5. The plaintiff attempted to amicably resolve this matter as evidence by the correspondence attached Exhibit "Bn dated February 13, 1996 requesting that the Defendant respond to the document request. On March 15, 1996, Plaintiff filed a Motion to Compel because the Defendant failed to respond to Plaintiffs discovery request. A copy of the Motion to Compel is attached as Exhibit "B". 4. Pursuant to the Plaintiffs Motion, the Court signed an Order dated March 19, 1996. a copy of which is attached hereto as Exhibit "CWo 5. On April 11, 1996, Plaintiff received Defendant's response to Plaintiffs Request for Production of Documents pursuant to the Court Order. 6. On June 6, 1996, Plaintiff took the deposition of Jennifer Ahrens, the merchandise manager of J.C, Penney store concerning an accident report she authored as a result of the Plaintiffs slip and fall. The deposition revealed that the accident report was inappropriately redacted by the Defendant before it was produced to the Plaintiff deleting crucial information that this employee observed the day of the accident including defects discovered by the Defendant on the day of the accident and information concerning the lighting conditions. 7. During Ms. Ahrens' deposition, counsel for the Defendant stated on the record that items 24, 25, 29, 30, 40, 41 and 42 were redacted from the accident report. 8. The deposition of Ms. Ahrens and statements made by counsel for the Defendant during the deposition also revealed that there are other discoverable portions of the Defendant's claims file that has not been produced including statements taken of witnesses. At the aforesaid time and place, the Plaintiff fell as a result of what Plaintiff subsequently learned was a wet floor resulting in serious injuries as hereinafter described. 6. The Defendant had a duty to maintain the aforesaid floor area in a safe condition for its customers, 7. The Defendant had a duty to inspect the aforesaid floor area for dangerous and defective conditions, 8. At the aforesaid time and place, the aforesaid floor area existed in a dangerous and defective condition, 9. The negligence, carelessness and/or recklessness of the Defendant consisted, iDW: BliJl, of the following: - 2 . (a) Maintaining the floor area of the catalogue department in a dangerous and defective condition; (b) Failing to inspect the floor area of the catalogue department for dangerous and defective conditions; (c) Failing to remove, clean or eliminate the water on the floor in the catalogue department; (d) Failing to warn customers of the wet floor in the catalogue department; (e) Failing to place carpet in the aforesaid mentioned area to prevent the slippery condition caused by water on a tile floor. 10. As a direct result of the Defendant's negligence, carelessness and/or recklessness, Plaintiff suffered serious and permanent injuries including: (a) Injuries to Plaintiffs head when her head hit the counter as she fell on the wet floor; (b) Injuries to her shoulder and back; (c) Injuries to her hip and leg; .3. ld) Injuries to her nerves and discs of her spinal column causing a bulging and protruding disc; (e) Injury to her knee. 11.
