A. ABUSE:
1. The Plaintiff S'mPIIANIE WEAVER is an adult individual residing at
110 Springhouse Road, Shiwensburg, CUntlerland County, Pennsylvania.
2. 'I11e Defendant KIMBERLY L. McCURDY is an adult individual residing
at 295 Cameo Drive, Fayetteville, Franklin COunty, Pennsylvania.
3. 'I11e Defendant is the separated spouse of the individual with whan
the Plaintiff cohabitates and is intimate.
4. Within the past, the Defendant has attBtpted to cause and has
intentionally and knowingly, caused abuse to the Plaintiff, by physical
assault and physical menace as follows:
A) On August l2, 1995, the Defendant attacked without
provocation the Plaintiff gratbing and scratching the Plaintiff which resulted
in nultiple bruises and contusions on the Plaintiff.
5. The Plaintiff believes and therefore avers that she will be in
iIlmedi.ate and present danger of aWse fran the Deferxiant and that she is in
need of protection fran such abuse.
6. The Plaintiff desires that the Defendant be restrained fran
entering her residence, or that she have any contact with her.
~, pursuant to the provisions of the "Protection fran Abuse Act"
of October 7, 1976, 23 Pa.C.S.A. Section 6102 et sea., as amended, the
Plaintiff prays this Honorable court to grant the following relief:
A. Schedule a hearing in accordance with the provisions of the
"Protection fran Abuse Act," and, after such hearing, enter an order to be in
effect for a pericxl of one year:
I. Requiring the Defendant to refrain fran abusing the
Plaintiff, S'lEPHANIE WEAVER or placing her in fear of abuse.
2. Requiring the Defendant to refrain fran having any contact
with Plaintiff S'lEPHANIE WEAVER, including, but not limited to, restraining
the Defendant fran entering the residence or Ellployment of said Plaintiff and
fran harassing said Plaintiff.

PlaintifflRespondent, Stephanie Weaver, filed a Petition under the Protection from Abuse
Act on September 19, 1995. The court issued a Temporary Protective Order against
DefendantIPetitioner, Kimberly L. McCurdy, on September 19, 1995.
As correctly noted in paragraph 3 of the Petition for Protective Order, "The defendant
is the separated spouse of the individual with whom the plaintiff cohabitates and is intimate."
The defendant, Kimberly McCurdy promptly filed "Preliminary Objections - Motion to Dismiss"
asking that the case be dismissed as the parties do not fall within any of the n:lationships covered
by the Protection from Abuse Act, 23 Pa.C.S. f 6102.
DISCUSSION OF THE LAW
"The purpose of the Protection from Abuse Act is to protect victims of domestic violeoce
..... ,-- v. ('.JI~, 43S Pa.Supcr. 4OS, 64S A.2d 1363 (1994). The term domestic violence,
therefore, implies the existence of a statutorily recognized mftionship betweea lite victim IIId
the abuser. The Protection from Abuse Act specifically enumerala lite reII1iclIlIbipI Car wbk:h
it provides protection. "Abuse" is defined as "1Icts betw~ family or ........... memllen,
sexual or intimate partners or persons who share biolOlical pareotbood:.... 23 PLC.S.A. I

6102. "Family and household members" are further defined as "[s]pouses or persons who have
been spouses, persons living as spouses or who lived as spouses, parents and children, other
persons related by consanguinity or affinity, current or former sexual or intimate partners or
persons who share biological parenthood." 23 Pa.C.S.A. 16102. No such relationship exists,
nor has been pled to exist, between the Defendant/Petitioner, Kimberly L. McCurdy, and the
Plaintiff/Respondent, Stephanie Weaver.
As set forth in Yankoskie v. Lenker, 363 Pa. Super. 448, 526 A.2d (Pa. Super. 1987),
being in a relationship of "family and household members" constitutes a "second condition for
an order" which must be "satisfied." 363 Pa, Super. 452, 429 A.2d at 431. [N.D. The
Protection from Abuse Act's statutory definition of "family and household members" was
somewhat more restrictive when Yankoskie was decided, but the rule of law remains the same
and there is no claim here that plaintiff and defendant fall within the current statutory defmition.]
Similarly in Vanderhurst v. Rice, 17 D. and C. 3d 225 (C.P. Phil. 1980), (copy
attached), the court dismissed a Protection from Abuse action for lack of a "family and
household members" relationship, noting:
When the words of the statute are clear and free from ambiguity their letter will
not be disregarded on the pretext of pursuing its spirit: Statutory Construction
Act of 1972, 1 Pa.C.S.A. I 1921(b). The test to determine whether the exercise
of jurisdiction is proper "is the competency of the court to hear and determine
controversies of the general class to which the case presented for consideration
belongs." In re Jones &. Laughlin Steel Corp., 488 Pa. 524, 412 A. 2d 1099
(1980). Thus, our inquiry is whether respondent herein is within that
classification of individuals envisioned when the legislature gave this court
jurisdiction over all proceedings under the act. See 35 P.S. I 10183. Based
upon the facts here this court does not have jurisdiction over the partics to
entertain the matter under the act.
[Again, the statutory definition was different when Vanderbuilt was decided, but the principle
remains the same, the statutory language is clear and the issue goes to jurisdiction.]
Defendant/Petitioner is the separated spouse of Mr. McCurdy. Plaintiff/Respondent is
the girlfriend of Mr. McCurdy. There simply exists no relationship between the two women,
Plaintiff and Defendant, which is enumerated in the Protection from Abuse Act.
CONCLUSION
Plaintiff/Respondent, Stephanie Weaver, is not entitled to relief under the Protection from
Abuse Act. The Temporary Protective Order should be vacated and the Petition dismissed with
prejudice.

NOW COMES the Defendant/Petitioner, Kimberly L. McCurdy, by and through her
attorneys, the Family Law Clinic, and files this preliminary objection-motion to dismiss pursuant
to Pennsylvania Rules of Civil Procedure, Rule 1028 (a)(2).
1. "Abuse" is defined in the Protection From Abuse Act as "acts between family or
household members, sexual or intimate partners or persons who share biological parenthood."

2. "Family or household members" is further defined as "Spouses or persons who
have been spouses, persons living as spouses or who lived as spouses, parents and children,

3. Defendant, Kimberly McCurdy, is the spouse of Michael McCurdy and has lived

5. Plaintiff/Respondent, Stephanie Weaver, is not entitled to relief because no

NOW COMES the Defendant/Petitioner, Kimberly L. McCurdy, by and through her
attorneys, the Family Law Clinic, and files this preliminary objection-motion to dismiss pursuant
to Pennsylvania Rules of Civil Procedure, Rule 1028 (a)(2).
1. "Abuse" is defined in the Protection From Abuse Act as "acts between family or
household members, sexual or intimate partners or persons who share biological parenthood. "
23 Pa.C.S.A. I 6102.
2. "Family or household members" is further defined as "Spouses or persons who
have been spouses, persons living as spouses or who lived as spouses, parents and children,
other persons related by consanguinity or affinity, current or former sexual or intimate partners
or persons who share biological parenthood." 23 Pa.C.S.A. I 6102.
3. Defendant, Kimberly McCurdy, is the spouse of Michael McCurdy and has lived
separate and apart from her husband since July 24, 1994.
4. Plaintiff, Stephanie Weaver, is the girlfriend of Michael McCurdy; she has
cohabited with him since July 24, 1994.
5. Plaintiff/Respondent, Stephanie Weaver, is not entitled to relief because no
relationship exists between Plaintiff and Defendant which brings her within the definition of

persons entitled to relief under the Protection From Abuse Statute.
WHEREFORE, Defendant/Petitioner, Kimberly McCurdy, respectfully prays this
Honorable Court to:
1. Dismiss the Temporary Protection Order entered on September 19, 1995;
2. Dismiss with prejudice the Petition for relief under the Protection From Abuse
Act;
3. Grant any and all other relief which the Court deems appropriate.
