Dear Mr. Harbaugh:
This will confirm our telephone conversation of September 13,
1995. You indicated to me that you are not able to secure a
loan from the Credit Union to pay the full balance of the legal
fee due and owing. The adjusted balance is $2437.50.
Please recall that I adjusted this balance in order to
accommodate you and in some way to help you expedite the funds
in order to pay me.
You should also recall that on September 7, 1995, I sent you
a letter indicating that the total amount of $2,487.50 should
be paid in full, immediately. It was my understanding that
when I adjusted the balance you would get the full amount and
pay me.
You now advise that you intend to pay the approximate amount
of $50.00 per month, and are not even sure if you can afford
to pay that, on account of your having a child in the near
future. This is unacceptable. If I do not receive the full
balance in a reasonable amount of time I will pursue my legal
remedies against you in a Court of law.
I believe that ten (10) days from this date is a reasonable
amount of time and if I do not get paid in full within that
time, I will conclude that you have no intention of honoring
your obligation to my office and I will proceed accordingly.
The accommodation referred to herein was conditional upon
immediate and full payment. You should not construe the
accommodation to mean that the services were not performed,
or are not due and owing.

Plaintiff, James M. Bach, by and through his legal counsel, Lisa Marie Coyne, Esquire,
propound the within Interrogatories upon the named garnishee, Members I st Federal Credit
Union, in accordance with the Pennsylvania Rules of Civil Procedure, Rules 3111-3118.

1. James M. Bach is an adult individual residing at 352 South
Sporting Hill Road, Mechanicsburg, Pennsylvania.
2. David E. Harbaugh is an adult individual residing at 522
West Simpson Street, Mechanicsburg, Pennsylvania.
3. On or about September 6, 1994, Defendant Harbaugh, contracted
for legal services with Plaintiff Bach. Defendant Harbaugh agreed
to pay for services at the rate of $150.00 per hour. (See Exhibit
"A"I.
4. Plaintiff Bach performed legal services for Harbaugh and
at the end of said representation submitted an Invoice to
Harbaugh for payment (See Exhibit "B"I.
5. Repeated demands for payment in full have been made to
Harbaugh and Harbaugh has refused to pay same.
