RONAN, Owner(s), of 110 North Morris Street, Shippensburg, PA 17257, entered into a contract with LOBAR ASSOCIATES, INC., Contractor, of 4 Bar10 circle, P.O. Box 432, Di11sburg, PA 17019, to provide materials and perform labor necessary for the construction of a funeral parlor upon a tract of land situate in South Middleton Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows: SEE ATTACHED EXHIBIT "A" NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any subcontractor or material man, nor any other person furnishing labor or materials to the said Contractor under his contract, shall file a lien, commonly called a mechanics' lien, for work done or materials furnished to the said building, improvements or any part thereof. THIS STIPULATION is made and intended to be filed with the CUmberland County Prothonotary within ten (10) days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided. TRACT NO.1: ALL that certain improved tract of land situate in South Middleton Township, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at a point on the concrete road leading from Carlisle to Boiling Springs (York Road, S.R. 0074), which point is at the intersection of Fairfield Avenue, and extending thence West along the said York Road 100 feet to a line of other property now or formerly of Raymond W. Peterman, which property is known as 251 York Road; and extending thence North 300 feet to a 20 feet wide alley; thence by the same East, 100 feet to Fairfield Avenue; thence by the same, South 300 feet to the place of BEGINNING. BEING Lot No. 12 and the western 40 feet of Lot No. 11 of Fairfield Plan as recorded in Cumberland County Plan Book 2, Page 41, and being improved with a residence known as and numbered 255 York Road. BEING the same premises which Raymond W. Peterman, by his deed dated June 13, 1995, and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 123, Page 516, granted and conveyed to Lynn A. Ronan and Sherry L. Ronan, his wife, Mortgagors herein. TRACT NO.2: ALL that certain house and lot of ground located in South Middleton Township, Cumberland County, Pennsylvania, and being more particularly a lot of ground having a frontage on said highway of 72~ feet and extending in depth 300 feet and being composed of the eastern 12% feet of Lot No. 9 and all of Lot No. 10 and the western 10 feet of Lot No. 11 on the plan of lots of Fairfield recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 2, Page 41, and being improved with a residence known as and numbered 251 York Road. BEING the same premises which Raymond W. Peterman, by his deed dated September 20, 1995, and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book , page , granted and conveyed to Lynn A.
