Said loan was further evidenced and secured by a Note which accompanied said Mortgage dated July 28, 1976, a copy of which is attached hereto, marked Exhibit "B", and made a part hereof by reference. 6. Harris Savings Bank, in consideration of the said Mortgage and accompanying Note, advanced to Lawrence C. Hull and Lorraine T. Hull, the sum of FORTY FIVE THOUSAND NINE HUNDRED AND NO/lOO DOLLARS ($45,900.00). 7. The premises subject to said Mortgage is more specifically set forth in Exhibit "A", attached hereto and made a part hereof by reference. 8. Lawrence C. Hull and Lorraine T. Hull are the sole owners of the said premises contained in said Mortgage. 9. Said Mortgage and Note have not been assigned in whole or in part by the Plaintiff herein. 10. Lawrence C. Hull and Lorraine T. Hull are the sole record owners in fee simple of said premises by virtue of a Deed dated July 2, 1976 and recorded in the Cumberland County Recorder's Office in Book S-26, Page 218 11. No judgment has previously been entered on said Mortgage or Note in any jurisdiction, and said instruments are less than twenty (20) years old except for prior default paid current. , I . 12. The said Mortgage is in default because Defendants herein have failed to pay the monthly payments of $493.00 that was due and owing for the months of April, May, June, July, and August, 1995. 13. The plaintiff has given to the Defendants written notice of intention to foreclose on said Mortgage as required by law under Act 6, dated April 6, 1995, copies of which are marked Exhibit "C" and "0" and attached hereto and made a part hereof by reference. 14. HULL, his wife Defendants No,: 95-5061 Civil Term IN MORTGAGE FORECLOSURE MOTION TO REINSTATE MORTGAGE PURSUANT TO ACT 6 OF 1974 AND NOW comes Plaintiff, Harris Savings Bank, formerly The Harris Savings Association, by and through its counsel, Robert E, Myers, Attorney at Law, and states the following in support of its Motion: 1. Plaintiff is Harris Savings Bank, formerly The Harris Savings Association, a Pennsylvania corporation, having its principal place of business at Second and Pine Streets, Harrisburg, PA 17101, and the Movant in the above captioned matter, 2. The Defendants/ Respondents above are Lawrence C. Hull and Lorraine T. Hull, adult individuals and mortgagors of a single family residence at 5235 Meadowbrook Drive, Mechanicsburg, PA 17055, Cumberland County, Pennsylvania. 3, That on September 22, 1995, Plaintiff filed a Complaint in Mortgage Foreclosure on the above captioned matter with respect to Defendants' family residence situate at 5235 Meadowbrook Drive, Mechanicsburg, PA 17055. 1 4. Plaintiff entered judgment against the Defendants on November 14, 1995,in the amount of $41,530.22 and the property was listed for judicial sale, 5. Subsequent to the entry of said Judgment but prior to scheduled Sheriff's Sale the said Defendants paid to the Plaintiff sufficient funds to make the mortgage current at the time thereof pursuant to the provisions of Act 6 of 1974 and the sale was cancelled. 6. By the said Defendants curing the default which resulted in the commencement of the above captioned action and the said judgment, Plaintiff has agreed to reinstate the said mortgage loan and not proceed with foreclosure because of the default set forth in the complaint filed in the above captioned matter. 7. That pursuant to Act 6 of 1974, P,S. Section 404, Right to Cure a Default, Defendant's mortgage was restored to the same position as if the default had not occurred. 8. That in order to evidence narris' compliance with Act 6 provisions and in order to reinstate the mortgage without prejudice to Plaintiff or Defendants, the Plaintiff desires to evidence said fact and strike the Judgment in mortgage foreclosure entered to the above referenced term and number. 9. The Defendants have exercised the right to reinstate the said mortgage loan under Section 404 of Act No.6 of 554 (41 P,S, Section 404) by curing the default which resulted in the commencement of the above captioned action. 2 " 10, This Motion is to effectuate the purpose of the above Act No.6 of 1974, 41 P.S., Section 404, WHEREFORE, Harris Savings Bank, formerly The Harris Savings Association, requests this Honorable Court to enter an Order providing as follows: A. Reinstate the mortgage of Lawrence C. Hull and Lorraine T. Hull to Harris Savings Bank, formerly The Harris Savings 3 Association, to the same position as if default had not occurred; and B. Strike the Judgment in Mortgage Foreclosure in favor of Harris Savings Bank, formerly The Harris Savings Association, and against Lawrence C. Hull and Lorrainp. T. Hull without prejudice to Harris Savings Bank, formerly The Harris Savings Association to enforce its rights under the mortgage in the future.
