COMPLAINT
1, The Plaintiff is DAUPHIN DEPOSIT BANK AND TRUST COMPANY, a
Pennsylvania Banking Corporatlon. with 1tS principal place of
business at 213 Market Street, Harrisburg, Pennsylvania 17105.
2, The Defendant, GARY W, MARTIN, is an adult individual whose
last known address is 3710 Boyer Road Chambersburg. PA 17201.
3. The Defendant, PAMELA A, MARTIN, 1S an adult individual whose
last known address IS 226 Fox Hill Road, Newburg, PA 17240.
4. On or about June 10, 1994, the Defendants entered into a Note
and Security Agreement with the Plaintiff for the purpose of
obtaining an installment loan in the pnnc1pal amount of Nine
Thousand SlX Hundred Eighty-seven Dollars and Thirty-five Cents
($9,687,35), a copy of Wh1ch Agreement IS attached hereto as
Exhibit "A" and made part heteof,
5, As provided 1n th", terms and conditions of said Note and
Security Agleemenl, the Defendants agreed to repay the Plaintiff
the pr1nc1pal amount, plus Eleven and Seventy-four One hundredths
percent (11. 74%) interest In consecutlve monthly installments of
Two Hundred Fourteen Dollars and Twenty.one Cents ($214,21)
beglllnlng July 10. 1~';l4 fUJ a total repayment of Twelve Thousand
EIght Hundled Flfty.two Dollals and Slxly Cents ($12,852.60),

6. The Defendants defaulted on the repayment of said Installment
Loan by failing to make the regular monthly payment due and owing
on June 10, 1995 and all monthly payments thereafter,
7. As provided in the Note and Security Agreement, in the event
of default, the Defendants agreed to pay the Plaintiff reasonable
attorney's fees of fifteen percent (15%) of the amount due,
8. The amount due and owing by the Defendants to the Plaintiff as
of September 12, 1995 is the sum of Eight Thousand Seven Hundred
Fifty-three Dollars and Seven Cents ($8,753,07), plus interest,
attorney's fees of fifteen percent (15%) and costs.
9, The Plaintiff has demanded payment from the Defendants, who
have refused and neglected, and still refuse and neglect to repay
the balance due,
WHEREFORE, Plaintiff demands judgment against the Defendants,
GARY W, HARTIN and PAMELA A. HARTIN, in the amount of Eight
Thousand Seven Hundred Fifty-three Dollars and Seven Cents
($8,753.07), plus interest at the Contract rate of 11.74\,
attorney's fees of fifteen percent (15%) and costs of this action.
