JUDGMENT NOTE
Date: September ~1.L, 1995
$30,000.00
Mechanicsburg, Pennsylvania,
FOR VALUE RECEIVED, I promise to pay to the order of Sheldon D. Kiser at 225 I
Orchard Drive, Camp Hill, Pennsylvania,
THE SUM OF Thirty Thousand and no/lOO Dollars ($30,000.00) with interest at the rate of
5 % per annum from date, said sum to be payable as follows: Payments to commence thirty
days after completion of work under construction agreement of even date, which shall be
called settlement date, at which time the balance due and payable under this note shall be the
sum of costs of construction approved by the parties pursuant to agreement, but not in excess
of $30,000. This shall be due by obligor to obligee from the date sums are advanced and
shalt be paid on date of settlement. Regular payments shall be paid on the balance due
commencing one month from settlement date and monthly thereafter for a period of three
years from settlement date until paid in full. However, note shall be d'le upon 30 days of
death of Obligee, unless obligor cannot obtain by diligent, prompt, and bona fide efforts
refinancing of the note at the then current average interest rates from three reputable lending
institutions in the Harrisburg area, in which event Obligor shall be bound by the terms of this
note until such time as Obligor can obtain such refinancing.
This note shall be recorded in the Prothonotary's Office of Cumberland County as a lien
upon any real estate interests owned by the obligor, including premises owned jointly by
obligor and obligee with right of survivorship at 225 I Orchard Drive, Lower Allen Township,
Camp Hill, Pennsylvania.
UPON FAILURE to make any payments as herein agreed, this note shall, at the option of its
holder, become immediately due and payable, without demand or notice.
AND FURTHER, I do hereby authorize and empower the Prothonotary or any attorney of any
Court of Record in Pennsylvania or elsewhere, to appear for and confess judgement for any
sums due and payable hereon, with or without declaration, with costs of suit, release of errors,
without declaration, with costs of suit, retease of errors, without stay of execution; with 10%
added for attorney's fees; and also waive the right of inquisition on any real estate that may
be levied upon to collect this note; and do hereby voluntarily condemn the same and
authorize the Prothonotary to enter said voluntary condemnation upon any Fieri Facias that
may be issued to collect said judgement; and further agree that said estate may be sold on a
Fieri Facias, and do hereby waive and release all relief from any and all appraisement, stay of
execution, exemption or bankruptcy laws of this or any other state nor in force of hereafter to
be passed; and further agree that my interest in any jointly held property, real or personal,
shall be subject to execution for this obligation.
