1, Plaintiffs Ray T, Burkholder and Sheryl y, Burkholder
are adult individuals residing at 570 Shed Road, Newville, (Lower
Mifflin Township) Cumberland County, Pennsylvania 17241,
2, Plaintiffs own and operate Burkholder's Mobile Home Park
located on Middle Road, (no numerical address) Newville, (Lower
Mifflin Township) Cumberland County, Pennsylvania,
3, Defendant Donna B, Owensby is an adult individual
residing in Burkholder's Mobile Home Park at 26 Ray's Drive,
Newville, (Lower Mifflin Township) Cumberland County,
Pennsylvania 17241.
4, Plaintiffs are the owners of the real property
described, in pertinent part, as follows:

ALL THAT CERTAIN tract of land situate in Lower Mifflin
Township, Cumberland County, Pennsylvania, bounded and described
in accordance with Plan of Land a subdivision for Lee L,
Burkholder, prepared by Carl David Bert, Registered Surveyor, a
copy of said Plan being recorded in the hereinafter mentioned
Recorder's Office in Plan Book 28, Page 113, as follows:
BEGINNING at a Railroad spike in the center line of Township
Road, T-397, at corner of land now or formerly of Edgar F,
Brownawell; thence along the Southern [sic] of said land now or
formerly of Edgar F. Brownawell and continuing along the Southern
line of land now or formerly of Robert R, Kline, North 56 degrees
45 minutes 00 seconds East, a distance of One Thousand Five
Hundred Nineteen and Fourteen Hundredths (1,519,14) feet to an
iron pin; thence along line of land retained by Lee L, Burkholder
and wife of which the within conveyed premises was a part, South
01 degree 32 minutes 57 seconds East a distance of Six Hundred
Ninety-five and Ten Hundredths (695,10) feet to an iron pin;
thence still along said line of land retained by Lee L,
Burkholder and wife, south 51 degrees 48 minutes 58 seconds West,
a distance of Six Hundred (600) feet to an iron pin; thence still
along the said line of land retained by Lee L, Burkholder and
wife, south 51 degrees 10 minutes 27 seconds West, a distance of
six Hundred Thirty and Seventy-two Hundredths (630,72) feet to a
railroad spike in the center line of Township Road, T-397; thence
along the center line of said Township Road, T-397, North 26
degrees 29 minutes 19 seconds West, a distance of Five Hundred
Seventy-six and Three Tenths (576,3) feet to a railroad spike;
thence still along the centerline of said Township Road, T-397,
North 31 degrees 36 minutes 38 seconds West, a distance of One
Hundred Thirty-two and Four Hundredths (132,04) feet to a
railroad spike at the Place of BEGINNING,
5, Plaintiffs acquired title to the above-described real
property on or about September 10, 1976 through a deed recorded
in the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania, in Deed Book 26, Volume "U", Page 258, a
true and correct copy of which is attached hereto as Exhibit "A"
and incorporated herein by reference,
6, The above-described real property is known as
Burkholder's Mobile Home Park, Middle Road, Newville, (Lower
Mifflin Township) Pennsylvania.
7. On or about November 30, 1990 Plaintiffs, as landlord,
and Defendant, as tenant, entered into a mobile home lot lease, a

nd incorporated herein by reference (hereinafter "Lea.."),

8, The Lease was for a portion of the above-described real
property known as lot or space number 26 (hereinafter
"Premises").
9, The term of the Lease was initially for one year,
10, Following the end of the initial one year lease term
the Lease was renewed and extended on a month to month basis,
11, By letter dated June 19, 1995, a true and correct copy
of which is attached hereto as Exhibit C and incorporated herein
by reference, Plaintiffs, inter alia, informed Defendant of their
decision not to renew the Lease,
12, As the term of the Lease has ended, Defendant has no
valid legal right to remain in possession of the Premises.
13, Defendant has willfully remained in possession of the
Premises after the term of the Lease has ended and has refused to
uit the Premises,
14. Plaintiffs are entitled to immediate possession of the
remises,
15, Defendant has not paid rent to Plaintiff since August,
1995,

16, Plaintiffs are entitled to rent in the amount of
150,00 per month plus applicable late fees and costs, if any,
eginning with September, 1995 until such time as the Defendant'.

mobile home is removed from the Premises as per section Twelve of
the Lease,
17, Plaintiffs have expended and will continue to expend
funds for enforcement of their Lease,
18, Plaintiffs are entitled to payment from Defendant for
all reasonable costs, attorney's fees and expenses made or
incurred by Plaintiffs pursuant to section Eighteen of the Lease.
WHEREFORE, Ray T, Burkholder and Sheryl T. Burkholder
t/d/b/a Burkholder's Mobile Home Park request your Honorable
Court to enter judgment in favor of Plaintiffs and against
Defendant for possession of the Premises known as 26 Ray's Drive,
lot or space number 26, Newville, Pennsylvania and for damages in
the amount of $150,00 per month plus applicable late fees and
costs, if any, until the mobile home is removed from the Premises
together with reasonable costs, attorney's fees and expenses
incurred by Plaintiffs pursuant to section Eighteen of the Lease,

Drive, Newville, Pennsylvania,
3, Movants initiated the within Action in Ejectment on
October 5, 1995 following Respondent's appeal of a District
Justice decision which awarded Movants a Writ of Possession for
the premises in question.

COMES NOW the defendant, Donna B. Owensby, by counsel, Philip
C. Briganti, Legal Services, Inc., and respectfully represents as
follows:
1. Rule 1301-1 of the Cumberland County Rules of Procedure,
pursuant to 42 Pa, C.S.A. Section 7361, provides that:
All civil cases which are at issue in which the total
amount in controversy is Twenty Five Thousand Dollars
($25,000) or less, exclusive of interests and costs,
except those cases involving title to real estate, shall
be submitted for hp.aring and award to three members of
the Bar of Cumberland County to be designated as a Board
of Arbitrators,
2. On November 9, 1995, Plaintiffs filed a Praecipe for
Listing Case for Trial, without first sUbmitting the above-
captioned matter for hearing and award to a Board of Arbitrators.
See Exhibit "A",
3, Because the total amount in controversy is less than
$25,000.00, and because this matter is an ejectment proceeding
which does not involve title to real estate, but rather involves
p~ssension of real property, collection of rent and other alleged
monetary damages, Rule 1301-1 requires that this action be
submitted for hearing and award to a Board of Arbitrators before
being listed for trial with this Court.
4. In the experience of Defendant's counsel, ejectment and
eviction cases are routinely submitted for arbitration in
Cumberland County, as they are in other Pennsylvania counties.
Please see Lunardi v. Still, 130 P.L.J 478 (Allegheny County,
1982), a copy of which is attached hereto,
5. Pursuant to Rule 1302-4 of the Cumberland County Rules
of Procedure:
In any case listed for trial before the court, if it
shall come to the attention of the court that the case
qualifies for compulsory arbitration under Local Rule
1301-1, the court may direct the plaintiff to file a
Petition for Appointment of a Board of Arbitrators.
WHEREFORE, Defendant respectfully requests that this
Honorable Court enter a Rule against Plaintiffs to show cause why
this matter should not be submitted for arbitration, and why it

34, Paragraph 34 is a legal conclusion to which no response
is required and same is deemed to be denied. By way of further
answer, it is averred that the Lease at issue complies with the
Plain Language Consumer Contract Act's "test of readability" set
forth under 73 P,S, Section 2205,
WHEREFORE, Plaintiffs respectfully request that judgment be
entered in their favor and against Defendant and that the relief
requested by Defendant be denied,
REPLY TO COUNTERCLAIM
35, Plaintiffs repeat and incorporate by reference their

Comes now the defendant, Donna B. Owensby, by counsel,
Philip C, Briganti, Esquire, Legal Services, Inc" and as her
Answer to Plaintiffs' complaint, states as follows:

9. Admitted in part and denied in part. Defendant admits
that the lease states that it is for an initial term of one year,
However, pursuant to the Mobile Home Park Rights Act (68 P,S,
Section 398,1 It ~.), the Lease actually extends for an
indefinite period of time, and cannot be terminated except for
the reasons set forth under 68 P.S. Section 398,3,
10. Admitted in part and denied in part, Defendant admits
that the Lease states that it is extended on a month to month
basis following the end of the initial one-year term, However,
Defendant asserts that the lease actually extends indefinitely as
set forth above in Paragraph 9, which is incorporated herein by
reference.

12, Denied, Defendant denies that the term of the Lease
has ended, and denies that she has no legal right to remain in
possession of the premises, Defendant repeats and incorporates
by reference her averments set forth above in Paragraph 9.
13, Admitted in part and denied in part, Defendant admits
that she has willfully remained in possession of the premises and
has refused to quit the premises, but denies that the term of the
Lease has ended.
14. Denied. Defendant denies that Plaintiffs are entitled
to immediate possession of the premises,
15. Denied, Defendant denies that she not paid rent to
Plaintiffs since Auqust, 1995, Defendant avers that her rent for
September, 1995 and October, 1995 has been paid into escrow with
the Prothonotary, as required by Rule 357 of the Cumberland
County Rules of Procedure.
16, Admitted in part and denied in part. Defendant avers
that, beginning in September, 1995, Plaintiffs are entitled to
monthly rent of $155.00 (rather than $150.00), because Defendant
has a pet for which there is a charge of $5,00 per month.
Defendant denies that she owes or will owe late fees and costs,
and denies that Plaintiffs are entitled to remove the home from
the premises pursuant to Paragraph Twelve of the Lease,
17, Denied. Defendant denies that Plaintiffs have expended
and will continue to expend funds for enforcement of their Lease,
By way of further response, and as set forth below in her New
Matter, Defendant avers that Plaintiffs are not properly
enforcing the Lease, either by the Lease's stated terms or its
terms as modified by the Mobile Home Park Rights Act,
18, Denied, Defendant denies that Plaintiffs are entitled
to payment from Defendant for all reasonable costs, attorney's
fees and expenses made or incurred by Plaintiffs pursuant to
section Eighteen of the Lease.
NEW MATTER
I, Failure to Give Notice Reauired bv Lease
19, section Thirteen, Paragraph (2)(c) of the parties'
Lease, which is attached to Plaintiffs' Complaint as Exhibit "B"
and incorporated herein by reference, provides as follows:

In the case of a breach of Tenant's duty to return
possession of the premises to Landlord at the end of a lease
term, if Notice to Tenant has been given by Landlord at least
thirty (30) days prior to the end of the said lease term,
Landlord shall send a notice stating the breach, and Landlord's
intention to commence eviction proceedings; and Landlord may, in
fact, commence eviction proceedings if Tenant has not redelivered
possession to Landlord within ten (10) days of the date the
second notice is sent to Tenant,
20. Plaintiffs failed to send to Defendant the second
notice required by Section Thirteen, Paragraph (2)(c) of the
parties' Lease, before commencing eviction proceedings against
Defendant.
II. Termination of Lease Term is Not a Ground for Eviction
Under the Mobile Home Park Riahts Act
21. section 3 of the Mobile Home Park Rights Act (68 P.S,
Section 398.3) provides that a mobile home resident "shall only
be evicted" for the following reasons: nonpayment of rent; a
second or subsequent violation of the rules of the mobile home
park occurring within a six-month period; if there is a change in
the use of the park land or parts thereof; or termination of the
mobile home park.
22. The termination of Defendant's lease term is not a
permissible basis for evicting her,
III. Demurrer- Failure to Give Notice Reauired bv the Mobile
Home Park Riahts Act
23, In Paragraph 15 of Plaintiffs' Complaint, Plaintiffs
allege that Defendant has not paid rent to them since August,
1995.
24. In Plaintiff's letter to Defendant dated June 19, 1995,
which is attached to Plaintiffs' Complaint as Exhibit "C" and
incorporated herein by reference, Plaintiff wrote as follows:
"While we are displeased in your performance and that you do not
fulfill all of the terms under the Lease and your adherence to
the Rules and Regulations, I regret to inform you that we have
decided not to renew your Lease,"
25, Pursuant to 68 P,S, Section 398,3(b)(2)(i), "in the
case of nonpayment of rent, the notice shall state that an
eviction proceeding may be commenced if the mobile home resident
does not pay the overdue rent within 20 days from the date of
service if the notice is given on or after April 1 and before
September 1", or an additional nonpayment of rent occurring
within six months of the giving of the notice may result in
immediate eviction proceedings,"
26. Pursuant to 68 P,S, Section 398,3(b)(2)(ii), "in the
case of a breach of the lease or violation of the park rules,...
the notice shall describe the particular breach or violation, No
eviction action shall be commenced unless the mobile home park
resident has been notified as required by this section",."
27. The notice attached to Plaintiffs' Complaint as Exhibit
"c" fails to contain the language required by 68 P.S, section
398.3(b) (2)(i) in cases where the mobile home park is attempting
to evict the resident for nonpayment of rent, and fails to
describe a particular alleged breach of the lease or violation of
park rules as required by 68 P.S, Section 398,3(b) (2) (ii),
28, Because Plaintiffs' notice fails to comply with the
requirements of the Mobile Home Park Rights Act, as set forth
under 68 P.S. 398.3(b) (2), Plaintiffs cannot be awarded
possession of the rental premises and their Complaint fails to
state a claim for which relief can be granted,
IV. Lack of Subiect Matter Jurisdiction
29. Defendant repeats and incorporates by reference her
averments set forth above in Counts I, II and III of her New
Matter,
30, Because of Plaintiffs' failure to give notices required
by the parties' Lease and under the Mobile Home Park Rights Act
before commencing legal proceedings seeking possession of the
rental premises, this Court does not have jurisdiction over the
subject matter of this action,
V, Late Fee provisions of Lease are Not Enforceable
31, section One of the parties' Lease provides that "[a]
late charge of ten ($10.00) Dollars plus one ($1,00) Dollar per
day shall be paid by Tenant for any rent, late charges, or other
fees or costs not paid within seven (7) days of first coming
due,"
32, The late fees assessed by this provision are
unenforceable as a penalty, in that they are excessive, and bear
no relationship to Plaintiffs' actual or reasonably anticipated
losses occasioned by the late payment of rent or other charges.
VI, ViOlation of the Plain Lanauaae Consumer Contract Act
33. The parties' Lease is a "consumer contract" within the
meaning of the Plain Language Consumer Contract Act, 73 P,S.
Section 2201 ~ ~,
34, This Lease, which is attached to Plaintiffs' Complaint
as Exhibit "B" and incorporated herein by reference, does not
comply with the Plain Language Consumer Contract Act's "test of
readability" set forth under 73 P,S. Section 2205.
WHEREFORE, Defendant respectfully requests that judgment be
entered in her favor and against Plaintiffs, that the relief
requested by Plaintiffs be denied, and that Defendant be granted
such other and further relief as this Court may deem reasonable
and just,
COUNTERCLAIM
I. ViOlation of the Plain Lanauaae Consumer Contract Act

DEFENDANT'S ANSWER TO PLAINTIFFS' MOTION TO
TERMINATE SUPERSEDEAS
COMES NOW the defendant, Donna B, Owensby, by counsel,
Philip C, Briganti, Esquire, Legal Services, Inc" pursuant to a
Rule to show cause why the supersedeas in this matter should not
be terminated, and responds to Plaintiffs' Motion to Terminate
Supersedeas as follows:

5, Admitted in part and denied in part. Defendant admits
that she is the appellant from the district justice decision and
that her rent payments were paid into Court after the due date,
However, all rent payments have now been made, and her rent
escrow account is current,
6, Admitted.
7, Admitted in part and denied in part, Defendant admits
that, as of December 7, 1995, the Docket for this case indicated
that the Respondent failed to pay rent when due for the months of
November and December, 1995. However, Defendant subsequently
paid the rent due for those months, and all rent due since the
~
filing of her appeal has now been paid, A copy of the Docket in
this matter, certified as of December 14, 1995, which indicates
these payments, is attached hereto as Exhibit "A" and
incorporated herein by reference,
NEW MATTER
8. Plaintiffs have not been harmed by the late payment of
Defendant's rent into court, as this money is being held in
escrow and Plaintiffs do not have access to it, Moreover,
because all of the rent has now been paid, Plaintiffs will
receive the amount to which they are currently entitled upon the
conclusion of this litigation,
9, Defendant was unable to pay her rent into court in a
timely manner due to financial hardships. Her present income is
less than $700,00 per month and other obligations, including
obtaining mental health treatment for her son and heating fuel,
totally consumed her resources,
10. Defendant and her son would suffer homelessness and
other severe hardships if the supersedeas is terminated, as they
would be removed from the mobile home lot where Defendant's
mobile home is located, Defendant's income is well below the
poverty line and she cannot afford to move her home to a
different lot, even in the unlikely event one would become
available, and she cannot afford to rent other housing,
11. Defendant has meritorious defenses to this ejectment
action, which would be rendered moot if the supersedeas is
terminated,

12, Defendant will strive to pay her rent on time in the
future,
WHEREFORE, Defendant respectfully requests this Honorable
Court to deny Plaintiffs' Motion for Termination of Supersedeas,
and permit the supersedeas to remain in effect,
