AND NOW, comes the above named Plaintiff, ALLENVIEW HOMEOWNERS
ASSOCIATION, by its Attorney, Karl M. ledebohm, and makes the following complaint:
1. The Plaintiff, A1lenview Homeowners Association, is a non-profit corporation
organized under Ihe laws of Ihe Commonwealth of Pennsylvania, with its principal place of
business at 5001 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania, 17055.
2. The Defendants, Bony Dawood and Neelofar Dawood, are adult individuals who
reside at 855 Clubhouse Drive, Mechanicshurg, Cumberland County, Pennsylvania, 17055.
3. The Defendants, Bony Dawood and Neclofar Dawood, are the owners of a townhouse
situate at and known as 726 A1lenvicw Drivc, Upper Allen Township, Cumberland County,
Pennsylvania, which is part of thc A1lenview Dcvelopment and under and subject 10 the
Declaration of Covcnants and Restrictions datcd Septcmber 8, 1982, a copy of which is attached
and incorporated herein by reference as Exhibit "A".
4. The Defendants, as owners of the A1lenview townhouse, are members of the
A1lenview Homeowners Association, hereinafter referred to as the "Association", and are
governed by the By-Laws of the As.<;l.lCialion.

5, Article V of thc said Covcnanls and Rcstrictions and Articlc III of the Association's
By-Laws, a copy of which is auachcd hcrcto and incorporatcd hercin by refcrcncc as Exhibit
"B", provide that owner shall pay annual and special a.'iSCssments to the Association, which
assessments are 10 be paid in advancc on a quartcrly ba.~is.
6, Each annual assessment, payablc to the Plaintiff, is delermincd as sel forth in Article
V, Section 3 of Ihc said Declaration of Covenants and Rcstrictions and as sel forth in Article III,
Seclion 2 of the Association's By-Laws through thc Associalion's Board of Direclors with
written notice of Ihe assessment 10 be senllo evcry owncr subjectlherelo pursuant to Article V,
Section 8 of the said Covenants and Restrictions.
7. Thc DefendanL~ wcre nOlified that Ihc following annual and special assessmcnts
balances werc due and payablc 10 Plaintiff in advance, as follows:
A. Assessmenl for 1st quarter, 2nd quartcr, 3rd quarter and 41h quarter of 1993 due on
March I, 1993, June 1, 1993, September I, 1993 and December I, 1993, respeclively, in the
amount of ONE HUNDRED SEVENTY ONE AND 00/100 DOLLARS (SI7\.OO) each.
B. Assessmenls duc for 1st quartcr, 2nd quartcr, 3rd quarter and 4th quarter of 1994
due on March 1, 1994, June I, 1994, September I. 1994 and December \, 1994, respeclively,
in the amount of ONE HUNDRED EIGHTY THREE AND 94/100 DOLLARS ($183.94) each.
C. Assessments duc for 1st quartcr of 1995 duc on March I, 1995 and for the second
quarter due on June \, 1995 in thc amount of ONE HUNDRED EIGHTY NINE AND 00/100
DOLLARS (SI89.(IO) cach.
D. Special asscs.~ment fur snow rcmoval due on April I, 1994 in Ihe amount of
SEVENTY TWO AND (1l1/1l1l1 DOLLARS (S72,(IlI).

8, Defendants purchased Ihe said townhouse under and subject to the Condominium
documents and rules and regulations of the Homeowners Association and became personally
liable therefor.
9. Except for a partial payment in the amounl of ONE HUNDRED SIXTY FOUR AND
00/100 DOLLARS ($164.00) applied to the balance of the assessment for the firsl quarter of
1993 and a partial payment in the amount of THREE HUNDRED AND 00/100 DOLLARS
($300.00) 10 Plaintiff on or about July 11, 1994, despilc demands by the Plaintiff, the
Defendants have failed and refused 10 make payment to the A1lenview Homeowners Association
for the outstanding assessments from the first quarter of 1993 to the present.
10. Article V, Section 9, of the Covenants and Restrictions provides Ihat the Association
has the right to collect all delinqucnl assessments together with such intercstlhereon and the cost
of collection thereof; and if the assessment is not paid within thirty (30) days after the
delinquency date, the assessment shall bear interest from the dale of the delinquency at the rate
of seven percent (7%) per annum with reasonable legal fees and costs of suit.
11. The Defendants, Bony Dawood and Neelofar Dawood, have damaged the
Association by Iheir failure to make payment of the assessmenls in accordance with the By-Laws
of the A1lenview Homeowners Association.
12. Plaintiff believes and Iherefor avers thai reasonable legal fees for collection is
SEVEN HUNDRED AND 00/100 DOLLARS ($7IKI.!XI).
13. Defendants will owe additional assessment cost of ONE HUNDRED EIGHTY NINE
AND 00/100 DOLLARS ($ 11l9.IKI) per quarter to Plainliff subject to annual change commencing
March lsl of each year.

been paid.
9. Effect of ~on-Pa ment of Assessment: The Personal Ob1i ation
of O~~er; The Lien; Remedies of Association. If the assessments
are not paid on the date ~hen due (being the dates specified in
Section 7 hereof), then such assessment shall become delinquent
and shall, together with such interest thereon and cost of col-
1ection thereof as hereinafter provided, thereupon become a con-
tinuing lien on the proper ty .-hich shall bind such property in
{ the hands of the then O\ol1ler, his heirs, devisees, personal rep-

resentatives and assigns. The personal obligation of the then
Owner to pay such assessment, however, shall remain his personal
obligation for the statutory period and shall not pass to his suc-
ccssors in title unless expressly assumed by them.

If the assessment is not paid within thirty (30) days after

the delinquency date, the assessment shall bear interest from the
date of delinquency at the rate of six (6) per cent per annum, and

10. Subordination of the Lirn to ~Iort&nge~. The lien of the
assessments provided for herein shall be subordinate to the lien
of any mortgage or mortgages now or hereafter placed upon the
properties subject to assessment; provided, however, that such
subordination shall apply only to the assessments which have be-
come due and payable prior to a sale or trnnsfer of such property
pursuant to a decree of foreclosure, or any other proceeding in
lieu of ' foreclosure. Such sale or transfer shall not relieve such

property from liability for any assessments thereafter becoming
due, nor from the lien of any ,such subsequent assessment.
11. Exempt Property. The following property subject to this
Declaration shall be exempted from the assessments, charge and
lien created herein: (a) all properties to the extent of any

casement or other interest therein dedicated and accepted by the
local public authority and devoted to puhlic use; (b) all Co~on
Properties as defined in Article I, Section I, of the Declaration
of Covenants and Restrictions; (c) all properties exempted from
taxation by the laws of the Commonwealth of Pennsy1v~nia, upon
the terms and to the extent of such legal ex~mption.
Notwithstanding any provisions herein, no land or improve-
ments devoted to dwelling use shall be exempt from said assess-
ments, charges or liens.

Section 3. The membership rights of any person whose interest in
,he Properties is subject to a$$essments under Article Ill, Section 2, whether
or not he be personally obligated to pay such assessments, may be suspended by
