COMPLAINT
AND NOW, come the plaintiffs, Elizabeth J. Baker, Phyllis L.
Marks, C. Edward Owens and George K. Owens, by their attorneys,
Fowler, Addams, Shughart & Rundle, and make the f.ollowing
complaint:
1. The plaintiffs are Elizabeth J. Baker, Phyllis L. MarkS,
C. Edward Owens and George K. owens, c/o Elizabeth J. Baker, an
adult individual residing at 20 Walnut street, Boiling Springs,
cumberland county, PA 17007.
2. The defendant is Lee F. Vanasdlen, an adult individual
residing at 16 Hill Road, Carlisle, cumberland county, PA 17013.
3. The plaintiffs bring this action as Executors of the
Estate of Gladys R. Owens, deceased.
4. Gladys R. Owens died on October 18, 1994, and the
plaintiffs were appointed as Executors of her Estate in the Court
of Common Pleas of cumberland county, pennsylvania to Estate
No. 21-94-897
5. The defendant is a public accountant who was paid
$100.00 by the Estate of clarence L. Owens, deceased to prepare
fiduciary income tax returns upon his representation that he was
competent and capable of preparing said fiduciary income tax
returns.
6. The defendant was instructed by legal counsel for the
Clarence L. Owens Estate to prepare one fiduciary tax return to
create only one fiscal year for the Estate covering the period
from his death 011 June 1, 1993 through May 31, 1994.
7. Gladys R. Owens was the Executrix and sole beneficiary
of the Estate of Clarence L. Owens, administered in the Court of
Common Pleas of Cumberland County, Pennsylvania to Estate
No. 21-93-522.
8. contrary to the instructions, the defendant prepared and
filed a fiduciary income tax return for the period from June 1,
1993 through December 31, 1993, thereby also creating two tax
years and also inaccurately reported income between the fiduciary
tax return and the final personal tax returns for Mr. and
Mrs. Owens. Defendant failed to provide a copy of the return to
legal counsel for the Estate of Clarence L. Owens
9. Believing Defendant prepared the returns as directed and
agreed, the Clarence L. Owens Estate was distributed to Gladys R.
Owens in June, 1994. Gladys R. Owens and legal counsel first
learned of Defendant's negligence as a result of a notice from
the IRS received in August, 1994.
10. The Clarence L. Owens Estate was unable to amend the
fiduciary tax return. Gladys R. owens, as beneficiary of the
