Defendants Kenneth and Ethel Trego are adult individuals with a place of residence at Lot 36, Mountain View Terrace, Newville, Pennsylvania 17241. 3, At all times relevant hereto, Plaintiffs were in the business of operating dnd maintaining a mobile home park known as Mountain View Terrace, 4. At aJltimes relevant hereto, Defendants, pursuant to an oral, month-to-month lease, leased Lot 36 in aforesaid mobile home park from Plaintiffs, 5, Pursuant to said lease agreement, monthly advance payments of$135,OO were to be paid to Plaintiffs for said Lot. 6. Pursuant to the Park Rules and customs, which are incorporated into said lease agreement, a late fee of $1.00 a day is assessed for rent over seven days late. 7, Beginning in June 1995, Defendants failed to timely make monthly rental payments for Lot 36 as per the lease agreement. 8. On or about August II, 1995, Plaintiffs' tiled a Landlord and Tenant Complaint against Defendants with District Justice Shulenberger, 9. As a result of said action, Plaintiffs received a judgment in the amount ofS505,50 and possession of said real property, 10. Defendants have paid S285,OO toward said judgment for back rent. II. Defendants have, despite said judgment for possession. continued to unlawfully remain in possession of said Lot without payment of rent or late charges, COUNT I BREACH OF CONTRACT 12, Paragraphs I through 11 of this Complaint are incorporated herein by reference, 13, The aforedescribed conduct of Defendants constitutes a breach of contract. WHEREFORE, Plaintiffs respectfully request this Honorable Court to enter judgrnent against Defendants and in favor of Plaintiffs in the amount of $220.50, plus all further rents and late fees accruing until possession of said property is returned to Plaintiffs, and all costs and interests allowed thereon by law. COUNT II lJNJlJST ENRICHMENT 14, Paragraphs I through 13 of this Complaint are incorporated herein by reference, 15. As a result of Defendants' failure to pay arnounts owed and continued unlawful possession of said real estate, Defendants have been unjustly enriched in the amount of said amounts now and amounts due until possession is returned to Plaintiffs. WHEREFORE, Plaintiffs respectfully request that this Honorable Court enter judgment against Defendants and in favor of Plaintiffs in the amount of$220.50, plus all further rents and late fees for the rnonths of continued possession, and all costs and interests allowed thereon by law. Defendants tiled an appeal from a District Justic~ Order on September 27, 1995. 2. On or about October 5, 1995, Plaintiffs, in response to such appeal, tiled a Complaint and a Motion to Quash Appeal from District Justice (hereinafter referred to as "Motion to Quash"), · 3. In said Motion to Quash, Plaintiffs sought to quash Defendants' appeal as untimely and in violation ofPa, R,C.P.D.J. 1002 and also for recovery of costs incurred in responding to such untimely appeal. A copy of that Motion to Quash is all ached hereto and marked as Exhibit "A". 4. On October 12, 1995, this Honorable Court entered a Rule against Defendants Kenneth Trego and Ethel Trego to show cause why their appeal should not be quashed pursuant to Pa. R,C.P.D.J, 1002, This Rule was returnable in seven days from service. A copy of said Rule is attached hereto as Exhibit "B". 5. Plaintiffs served Defendants with said Rule on October 17, 1995, the period in which to show cause under the Rule having now eKpired. 6, Defendants tiled a Response to Plaintiffs' Motion to Quash Appeal (hereinafter referred to as "Response"). A copy of said Response is attached hereto as Exhibit "C". 7, In said Response. Defendants admit that the relevant District Justice judgement was entered on August 25, 1995 (see Response at paragraph 6) and also that they filed their appeal on September 27.1995 (see Response at paragraph 7), 8, Defendants have failed to show cause why their appeal should not be quashed. 9, Defendants' averment that they filed their appeal within thirty (30) days of receipt of judgment does not support a tinding that their appeal was timely or that they have good cause to extend the statutorily prescribed period in which to tile an appeal. Goldberil v Goldberi. 315 Pa. Super, 333, 461 A.2d 1307 (1983). 10, As a result of Defendants' blatantly untimely and frivolous appeal, Plaintiffs have incurred attorney's fees in excess of$500.00. I \. Plaintiffs are entitled to recover attorney's fees in responding to this untimely, frivolous appeal. 720 Partnership v City of Philadelphia. 129 Pa.
