COMPLAINT
1. Plaintiff, Donald Fisher, Sr., is an adult residing at
370 Yocumtown Road, Etters, York County, Pennsylvania.
2. Plaintiff, Donald Fisher, Jr., is an adult residing at
333 Equus Drive, Camp Hill, Cumberland County, Pennsylvania.
3. Plaintiff, Judy Treaster, is an adult residing at 470
Lewisberry Road, New Cumberland, Cumberland County, Pennsylvania.
4. Defendants, Victor B. and Katherine S. Crum, husband and
wife, are adults residing at Trail Run, Box 148, Enola, Cumberland
County, Pennsylvania.
5. Defendant Steward A. Crum, is the adult son of the
Defendants and resides at Trail Run, Box 148, Enola, Cumberland
County, Pennsylvania.
6. Plaintiffs are the owners in fee simple absolute of a
tract of land situate in East Pennsboro Township, Cumberland
County, Pennsylvania which they acquired from Ellsworth Fisher and
his wife Gladys by deed dated June 3, 1985, and recorded in Deed
Book 31, Volume H, Page 80, Cumberland County Recorder of Deeds.
The tract hereinafter will be referred to as "Fisher Tract". A
copy of the deed is attached as exhibit A.
7. The Fisher Tract is designated as Tract No. 09-11-3007-
029 in the Cumberland County Tax Map Office.
8. Ellsworth Fisher and Gladys Fisher purchased the Fisher
Tract at a Sheriff's Sale by deed dated February 26, 1969, and
recorded in Deed Book 23, Volume C, Page 560, Cumberland County
Recorder of Deeds. An Abstract of title for the tract is attached
as exhibit B.
9. B.F. Shuman, by Indenture dated November 8, 1904,
recorded in Book 15Z, page 81, was the predecessor in title to the
Fisher Tract. A copy of the deed is attached as exhibit C.
10. In July 1999 Plaintiffs contracted with Charles M.
Fogarty, Title Abstractor, to research the title and determine the
location of the Fisher Tract.
11. Mr. Fogarty's research concluded that the Fisher Tract
had been mistakenly included in a real estate transaction and
accompanying deed from Appalachian Trail Ranch to Defendants. A
copy of the Mr. Fogarty's summary letter with accompanying exhibits
is attached as exhibit D.
12. Since February 14, 1995 Defendants have claimed title and
ownership of the Fisher Tract.
13. Plaintiffs have advised Defendants that they are
unlawfully claiming title to their land and have demanded that they
abrogate their interest in the Fisher Tract.
14. Despite repeated demands, Defendants have refused to
remove themselves from the land and abrogate their claimed interest
in the Fisher Tract.
WHEREFORE, Plaintiffs requests this honorable court to eject
Defendants from their land, remove the cloud over their title and
confirm their fee simple title in the subject tract of land.

6. Denied. The Defendants are without knowledge or information
sufficient to form a belief as to the truth of the averments of paragraph number 6
and strict proof thereof is demanded at trial. By way of further answer thereto, the
Defendants aver that the Plaintiffs have no title which has any superior interest to
the lands owned by the Defendants. Furthermore, the tax sale which fortns the basis
of the Plaintiffs title is defective. In addition, the Plaintiffs title is based on a
leasehold interest that has expired as will be more fully set forth in the following
New Matter. In addition, Plaintiffs never acquired fee simple absolute title to their
land.

8. Admitted in part and denied in part. It is admitted that Elsworth
Fisher and Gladys Fisher purchased the Fisher tract at a sheriffs sale in February
1969 and that a tax claim bureau deed is recorded in Cumberland County Recorder
of Deeds Office, Deed Book C-23, Page 560. It is denied that Plaintiffs acquired a
fee simple tide to the Fisher tract by way of the tax sale deed. Defendants further
aver that the tax sale of an interest to the Plaintiffs predecessors in tide was defective
for lack of personal service on the record tide holder and lack of posting upon the
premises and further that the purported owner did not own tide in fee simple tide.
It is further averred by the Defendants that the Plaintiffs tide is based on a leasehold
interest that has now expired. Strict proof of Plaintiffs averment is hereby
demanded.
9. Admitted in part and denied in part. It is admitted that an Indenture
dated November 8, 1904 and recorded in Cumberland County Book 15Z, Page 81
purports to be a conveyance of a leasehold interest from a Zacharias Quigg and
Connie Quigg to B. Frank Shuman. Said indenture is a conveyance of a leasehold
interest and is not a conveyance of fee simple tide. The deed purports to convey a
leasehold interest in a portion ofland containing "about 6 acres more or less". By
way of further answer, the Defendants aver that B. Frank Shuman was not an owner
as defined in the terms of the tax sale law because his interest was only that of a long
term lease. Strict proof of the averment is hereby demanded. Defendants aver that B.
Frank Shuman did not acquire an ownership interest from Zacharias Quigg because
the clear terms of the instrument show a lease only and that fee simple tide was not
conveyed in the referenced transaction.
10. Denied. The Defendants are without knowledge or information
sufficient to form a belief as to the truth of the averments in paragraph 10 and strict
proof thereof is demanded at trial. By way of further answer thereto, Charles M.
Fogarty as a tide abstractor cannot determine the exact location of the Fisher tract.
Plaintiffs have failed to state in their Complaint the exact location of the Plaintiffs
land. The deed of the Plaintiffs attached to Plaintiffs Complaint as Exhibit A refers
to a tract of land of "approximately 6 acres of mountain land (back of
Summerdale)". Plaintiffs have not set forth with any specificity the location of their
tract of land. By way of further answer thereto, the description of the Plaintiffs tract
of land as set forth in prior conveyances refers to a tract of land that is bounded on
the north by the division line of Perry and Cumberland Counties. If this is true, the
Plaintiffs tract of land would be to the north of the Defendants northern most
boundary, therefore not within the Defendants property.

11. Denied. Defendants are without knowledge or information
sufficient to form a belief to the truth of the averments of paragraph 11 and proof
thereof is demanded at trial. By way of further answer thereto, Defendants aver that
Plaintiffs have not set forth a survey of their tract of land depicting the exact location
of the tract of land, nor does Mr. Fogarty, as a title abstractor, certify to the location
of the Plaintiffs tract of land, nor to Defendants knowledge Mr. Fogarty is not a
licensed surveyor, nor has Mr. Fogarty performed a survey of the Fisher tract.
12. Denied. As set forth in the previous Answers, Defendants aver that
Plaintiffs do not own fee simple title to any portion of land that is located within the
tract of land owned by the Defendants. By way of further answer thereto,
Defendants aver that the Plaintiffs do not own fee simple title to the six acre tract of
land that they are claiming because Plaintiffs title is based on a tax sale that was
defective and a leasehold interest that has now expired. Strict proof of the averments
of paragraph 12 of Plaintiffs Complaint is hereby demanded.
13. Admitted in part and denied in part. It is admitted that Plaintiffs,
through their attorney, have attempted to assert title to a portion of land that
Plaintiffs allege lies within Defendants tract of land. Defendants deny that Plaintiffs
have acquired title to any portion of land that lies within the Defendants land. As set
forth above, Defendants aver that Plaintiffs have failed to set forth with any
specificity the exact location of their tract of land; that Plaintiffs have failed to
provide any survey depicting the location of their tract of land; that Defendants do
not own fee simple title to the land they are claiming in that their title was acquired
through a defective tax sale and furthermore Plaintiffs title is based on a leasehold
estate that is now expired.
14. Admitted. By way of further answer thereto, Defendants admit that
they have rejected Plaintiffs demands because Plaintiffs do not own fee simple title
to any portion of land located within Defendants property. Plaintiffs have not
established that they own fee simple title to the tract of land that they are claiming.

15. Defendants hereby incorporate by reference the foregoing answers
1 thru 14 of this Answer and make them part of the following New Matter as if set
forth in their entirety.

16. Defendants aver that they acquired title to their propeny by way of
a deed from Appalachian Trail Ranch Inc., dated February 14,1995 and recorded in
the Recorder of Deeds Office in and for Cumberland County in Record Book 118,
Page 799. (See attached copy as Exhibit "A").
17. Defendants aver that their tract of land was the subject of a survey
prepared by Betz Associations, Inc., dated January 17, 1994 and recorded in
Cumberland County Plan Book 67, Page 106.
18. Defendants aver that Appalachian Trail Ranch, Inc. acquired the
propeny that was subsequently conveyed to the Defendants by way of a deed from
Nelle M. Bell, dated July 9,1957 and recorded in the Cumberland County Recorder
of Deeds Office in Deed Book Y -17, Page 40.
19. Defendants aver that their propeny was subsequently subdivided
by way of a subdivision plan prepared by Roger C. Watson Surveying Services, Inc.,
dated May 17, 2002 and recorded in the Recorder of Deeds Office in and for
Cumberland County in Plan Book 85, Page 133.
20. Defendants aver that Defendants Victor B. Crum and Katherine S.
Crum acquired title to a 17.88 acre tract ofland identified as Lot # 1 on the
subdivision plan prepared by Roger C. Watson Surveying Services, Inc., dated May
17,2002 and recorded in the Recorder of Deeds Office in and for Cumberland
County in Plan Book 85, Page 133. Defendants Victor B. Crum and Katherine S.
Crum acquired title by way of a deed dated September 25, 2002 and recorded in
Record Book 253, Page 3948 (see copy of deed attached hereto as Exhibit "B").
21. Defendants aver that Steward A. Crum and Christina L. Crum, his
wife, acquired title to a 17.89 acre tract ofland being Lot #2 on the subdivision
plan prepared by Roger C. Watson Surveying Services Inc., dated May 17, 2002
and recorded in Cumberland County Plan Book 85, Page 133 by way of a deed
dated September 25, 2002 and recorded in the Recorder of Deeds Office in and for
Cumberland County in Record Book 253, Page 3952 (see copy of deed attached
hereto as Exhibit "C").

22. Defendants aver that at all times material to this action that they
and their predecessors in title have an open, notorious and continuous adverse
possession of the premises free and clear of any claim by the Defendants or their
purported predecessors in title so that the Plaintiffs have no claim for any ownership
or property interest in and to the lands owned by the Defendant.
23. Defendants aver that their predecessor in title Appalachian Trail
Ranch, Inc., had previously owned the property now owned by the Defendants
since 1957 and at no time during their period of ownership has any individual or
individuals challenged the ownership of the land by Appalachian Trail Ranch, Inc.
or subsequently when owned by the Defendants.
24. Defendants believe and aver that Appalachian Trail Ranch, Ine. has
previously timbered the land that is now owned by the Defendants during their
period of its ownership and at no time has any individual or individuals challenged
or contested the ownership of the land now owned by the Defendants.
25. Defendants aver that the Plaintiffs have made no attempt to locate
their alleged premises in the field by having a survey performed.
26. Defendants aver that the Plaintiffs do not have fee simple title to
their lands due to the fact that they acquired title by way of a defective tax sale and
that their alleged predecessor in title only possessed a leasehold interest in the
property which has now expired.
27. Defendants aver that prior indentures and conveyances alleged by
the Plaintiffs to be their predecessors in title, identify the northern boundary of the
six (6) acre tract of land claimed by Plaintiffs as having a northern boundary located
on the division line of Perry and Cumberland Counties which would place the
alleged six (6) acre tract of land to the north of the northern boundary of
Defendants tract of land.
28. Defendants aver that the Plaintiffs only acquired a leasehold interest
when they acquired title from the Cumberland County Tax Claim Bureau by way of
the previously referred to tax sale in that the holder of the property at the time of the
tax sale was a B. Frank: Shuman who only owned a leasehold interest in the property
as evidenced by a deed from Zacharias Quigg and his wife, Connie Quigg, date

November 8,1904 and recorded in the Recorder of Deeds Office in and for
Cumberland Cotlllty in Deed Book 15 - Z, Page 81 in which it is indicated that the
leasehold was for a period of 99 years commencing January 6, 1886, said term of
the lease has now expired.
29. Defendants aver that Plaintiffs tract of land is not located within
the lands owned by the Defendants.
WHEREFORE, Defendants respectfully request this Honorable Court
to dismiss Plaintiffs Complaint in Ejectment and enter an Order confirming
Defendants ownership of the lands described in this New Matter and further aver
that the Defendants are owners in fee simple of said premises free and clear of any
and all right, title, interest and claim of the Plaintiffs and further enjoin the Plaintiffs
and their heirs, successors and assigns from impeaching or in any way attacking the
Defendants ownership in and to the land set forth herein.

15. Plaintiffs hereby incorporate their allegations in
paragraphs 1-14 of the complaint as if set forth in their entirety.
16. Admitted that Defendants aver that they acquired title to
their property by way of deed from Appalachian Trail Ranch, Inc..
17. Admitted that a survey was prepared by Betz Associations,
Inc.
18. Denied that Appalachian Trail Ranch, Inc. acquired title
to the Fisher tract in a deed from Nelle M. Bell.
Rather
Appalachian Trial Ranch, Inc. acquired only title to the 17.88
acres of land owned by Nelle M. Bell which did not include the
Fisher tract.
19. Admitted that Defendants have filed a subdivision plan.
By way of further answer, the subdivision plan was prepared after
Defendants were put on notice as to Plaintiffs' claim to a portion
of the subdivided land and Defendants never notified Plaintiffs of
their intention to subdivide land that included the Fisher tract.
20. Admitted that Defendants claim title to Lot #1 of the
subdivision plan through a deed executed after the Plaintiffs'
initiated this ejectment action.
21. Admitted that Defendants transferred their alleged
interest in Lot #2 of the subdivision plan in a deed executed after
the Plaintiffs' initiated this ejectment action.
22. Denied that Defendants have claimed title to the Fisher
tract in an open, notorious and adverse possession.
The Fisher
tract is mountain ground which has been open and available to
Plaintiffs and until recently neither Defendants nor their
predecessors in title had taken any action to exclude Plaintiff or
exercised such control over the mountain land to put Plaintiffs' on
notice that they were claiming title to the mountain ground.
23. Denied. Appalachian Trail Ranch, Inc., by deed from
Nelle M. Bell only acquired title to 17.:38 acres that did not
include the Fisher tract. It was only after a 1994 survey and 1995
sale of the land to Defendants that the Fisher tract was included
in the deed of Appalachian Trail Ranch, Inc., subsequently sold to
Defendants.
24. After reasonable investigation the Plaintiffs are without
sufficient knowledge or information as to whether Appalachian Trail
Ranch, Inc. received money for timber on its land. By why of
further answer, Plaintiffs received money for timbering of the
Fisher tract.
25. Denied. In the Fall of 2001 Plaintiffs contracted with
a licensed engineer to conduct a survey on Fisher tract. Defendant
denied the surveyor access to the land through the threat of bodily
harm. Plaintiffs' counsel notified Defendants' counsel who
attempted to get assurances from his clients that they would permit
the survey to be conducted. Despite repeated inquires, no
assurances have been received by Plaintiffs.
26. Denied that the tax sale was defective. It is admitted
that the then occupant of the Plaintiffs land was a leaseholder.
However, the tax sale was for the taxes owed on the real estate and
the real estate was sold, not the leasehold interest. By way of
further answer, Defendants lack standing to challenge the tax sale.
Even if the Defendants have standing, laches prevents them from
raising the issue more than 30 years after the sale.
27. Admitted that the Plaintiffs' deed identifies the
northern boundary of the Fisher tract as the Perry and Cumberland
County border. By way of further answer, it is common for deed
descriptions in mountain land in the 19th century to be general in
nature and not totally accurate and such inaccuracies do not render
the title defective if the land can be properly located and
identified.
28. Admitted that B. Frank Shuman had a 99-year leasehold
interest, from Zacharias Quigg and his wife, Connie Quigg who had
obtained the leasehold interest from Rudolph Swab in 1886, in the
Fisher tract at the time of the tax sale. ]~r. Shuman had occupied
the land for more than 60 years.
By way of further answer,
Defendants have not alleged or shown a chain of title from
Zacharias Quigg and his wife, Connie Quigg, or Rudolph Swab, to
them or any predecessor in title. Plaintiffs' claim to the 6 acres
of mountain ground obtained through a tax sale is superior to any
claim asserted by Defendants.
29. Denied. The Fisher tract is included in the land claimed
by Defendants in their deed from Appalachian Trail Ranch, Inc.
which has subsequently been subdivided.
WHEREFORE, Plaintiffs requests this honorable court to eject
Defendants from their land, remove the cloud over their title and
confirm their fee simple title in the subjElct tract 'of land.
